| 7 | 7 | | relating to certain conditions of suspension or renewal of a |

| 8 | 8 | | driver's license. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 521.242(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) A person whose license has been suspended for a cause |
|---|
| 13 | 13 | | other than a physical or mental disability or impairment or a |
|---|
| 14 | 14 | | conviction of an offense under Sections 49.04-49.08, Penal Code, |
|---|
| 15 | 15 | | may apply for an occupational license by filing a verified petition |
|---|
| 16 | 16 | | with the clerk of a municipal, justice, county, or district court |
|---|
| 17 | 17 | | with jurisdiction that includes the precinct or county in which: |
|---|
| 18 | 18 | | (1) the person resides; or |
|---|
| 19 | 19 | | (2) the offense occurred for which the license was |
|---|
| 20 | 20 | | suspended. |
|---|
| 21 | 21 | | SECTION 2. Section 521.343(b), Transportation Code, is |
|---|
| 22 | 22 | | amended to read as follows: |
|---|
| 23 | 23 | | (b) If a license is suspended under this subchapter for a |
|---|
| 24 | 24 | | subsequent period, the subsequent suspension is for one year [18 |
|---|
| 25 | 25 | | months] except as otherwise provided by a section listed in |
|---|
| 26 | 26 | | Subsection (a). |
|---|
| 27 | 27 | | SECTION 3. Section 706.004, Transportation Code, is amended |
|---|
| 28 | 28 | | by adding Subsection (c) to read as follows: |
|---|
| 29 | 29 | | (c) Notwithstanding Subsection (a), the department may deny |
|---|
| 30 | 30 | | renewal of a person's driver's license under this section until the |
|---|
| 31 | 31 | | earlier of: |
|---|
| 32 | 32 | | (1) the date the department receives clearance notice |
|---|
| 33 | 33 | | under Section 706.005; or |
|---|
| 34 | 34 | | (2) the second anniversary of the date the person |
|---|
| 35 | 35 | | failed to appear or failed to pay or satisfy a judgment. |
|---|
| 36 | 36 | | SECTION 4. Section 706.006, Transportation Code, is amended |
|---|
| 37 | 37 | | by amending Subsection (c) and adding Subsection (d) to read as |
|---|
| 38 | 38 | | follows: |
|---|
| 39 | 39 | | (c) The department may deny renewal of the driver's license |
|---|
| 40 | 40 | | of a person who does not pay a fee due under this section until the |
|---|
| 41 | 41 | | earlier of: |
|---|
| 42 | 42 | | (1) the date the fee is paid; or |
|---|
| 43 | 43 | | (2) the second anniversary of the date the person |
|---|
| 44 | 44 | | failed to appear or failed to pay or satisfy a judgment. |
|---|
| 45 | 45 | | (d) The fee required by this section is in addition to any |
|---|
| 46 | 46 | | other fee required by law. |
|---|
| 47 | 47 | | SECTION 5. Section 708.152(b), Transportation Code, is |
|---|
| 48 | 48 | | amended to read as follows: |
|---|
| 49 | 49 | | (b) A license suspended under this section remains |
|---|
| 50 | 50 | | suspended until the earlier of: |
|---|
| 51 | 51 | | (1) the date the person pays the amount of the |
|---|
| 52 | 52 | | surcharge and any related costs; or |
|---|
| 53 | 53 | | (2) the second anniversary of the date of suspension. |
|---|
| 54 | 54 | | SECTION 6. Section 708.154(c), Transportation Code, is |
|---|
| 55 | 55 | | amended to read as follows: |
|---|
| 56 | 56 | | (c) A license suspended under this section remains |
|---|
| 57 | 57 | | suspended until the earlier of: |
|---|
| 58 | 58 | | (1) the date the person pays the amount of the |
|---|
| 59 | 59 | | surcharge and any related costs; or |
|---|
| 60 | 60 | | (2) the second anniversary of the date of suspension, |
|---|
| 61 | 61 | | whichever date is earlier. |
|---|
| 62 | 62 | | SECTION 7. Section 708.158, Transportation Code, is amended |
|---|
| 63 | 63 | | by adding Subsection (c) to read as follows: |
|---|
| 64 | 64 | | (c) Not later than the fifth day after the date the court |
|---|
| 65 | 65 | | receives information described by Subsection (b) establishing that |
|---|
| 66 | 66 | | a person is indigent, the court shall notify the department that the |
|---|
| 67 | 67 | | person is indigent for the purposes of this chapter. |
|---|
| 68 | 68 | | SECTION 8. This Act takes effect September 1, 2017. |
