55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain conditions of suspension or renewal of a
88 driver's license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 521.242(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) A person whose license has been suspended for a cause
1313 other than a physical or mental disability or impairment or a
1414 conviction of an offense under Sections 49.04-49.08, Penal Code,
1515 may apply for an occupational license by filing a verified petition
1616 with the clerk of a municipal, justice, county, or district court
1717 with jurisdiction that includes the precinct or county in which:
1818 (1) the person resides; or
1919 (2) the offense occurred for which the license was
2020 suspended.
2121 SECTION 2. Section 521.343(b), Transportation Code, is
2222 amended to read as follows:
2323 (b) If a license is suspended under this subchapter for a
2424 subsequent period, the subsequent suspension is for one year [18
2525 months] except as otherwise provided by a section listed in
2626 Subsection (a).
2727 SECTION 3. Section 706.004, Transportation Code, is amended
2828 by adding Subsection (c) to read as follows:
2929 (c) Notwithstanding Subsection (a), the department may deny
3030 renewal of a person's driver's license under this section until the
3131 earlier of:
3232 (1) the date the department receives clearance notice
3333 under Section 706.005; or
3434 (2) the second anniversary of the date the person
3535 failed to appear or failed to pay or satisfy a judgment.
3636 SECTION 4. Section 706.006, Transportation Code, is amended
3737 by amending Subsection (c) and adding Subsection (d) to read as
3838 follows:
3939 (c) The department may deny renewal of the driver's license
4040 of a person who does not pay a fee due under this section until the
4141 earlier of:
4242 (1) the date the fee is paid; or
4343 (2) the second anniversary of the date the person
4444 failed to appear or failed to pay or satisfy a judgment.
4545 (d) The fee required by this section is in addition to any
4646 other fee required by law.
4747 SECTION 5. Section 708.152(b), Transportation Code, is
4848 amended to read as follows:
4949 (b) A license suspended under this section remains
5050 suspended until the earlier of:
5151 (1) the date the person pays the amount of the
5252 surcharge and any related costs; or
5353 (2) the second anniversary of the date of suspension.
5454 SECTION 6. Section 708.154(c), Transportation Code, is
5555 amended to read as follows:
5656 (c) A license suspended under this section remains
5757 suspended until the earlier of:
5858 (1) the date the person pays the amount of the
5959 surcharge and any related costs; or
6060 (2) the second anniversary of the date of suspension,
6161 whichever date is earlier.
6262 SECTION 7. Section 708.158, Transportation Code, is amended
6363 by adding Subsection (c) to read as follows:
6464 (c) Not later than the fifth day after the date the court
6565 receives information described by Subsection (b) establishing that
6666 a person is indigent, the court shall notify the department that the
6767 person is indigent for the purposes of this chapter.
6868 SECTION 8. This Act takes effect September 1, 2017.
