66 AN ACT
77 relating to civil liability of a local government for failure to
88 comply with an immigration detainer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 101, Civil Practice and
1111 Remedies Code, is amended by adding Section 101.0216 to read as
1212 follows:
1313 Sec. 101.0216. LIABILITY OF LOCAL GOVERNMENT FOR FAILURE TO
1414 COMPLY WITH IMMIGRATION DETAINER. (a) In this section, "local
1515 government" means a county, municipality, or political subdivision
1616 of this state.
1717 (b) A local government that releases from custody a person
1818 who is the subject of an immigration detainer issued by United
1919 States Immigration and Customs Enforcement is liable for damages
2020 resulting from a felony committed by the person in this state within
2121 four years following the person's release.
2222 (c) This section does not create liability for damages
2323 sustained by a person who is subject to an immigration detainer
2424 following the person's release by a local government.
2525 SECTION 2. The change in law made by this Act applies only
2626 with respect to the release of a person from custody on or after the
2727 effective date of this Act.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
