| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subtitle C, Title 5, Local Government Code, is |
|---|
| 12 | 12 | | amended by adding Chapter 179 to read as follows: |
|---|
| 13 | 13 | | CHAPTER 179. VERIFICATION OF EMPLOYEE INFORMATION |
|---|
| 14 | 14 | | Sec. 179.001. DEFINITIONS. In this chapter: |
|---|
| 15 | 15 | | (1) "E-verify program" has the meaning assigned by |
|---|
| 16 | 16 | | Section 673.001, Government Code. |
|---|
| 17 | 17 | | (2) "Political subdivision" means a county, |
|---|
| 18 | 18 | | municipality, school district, junior college district, other |
|---|
| 19 | 19 | | special district, or other subdivision of state government. |
|---|
| 20 | 20 | | Sec. 179.002. VERIFICATION. A political subdivision shall |
|---|
| 21 | 21 | | register and participate in the E-verify program to verify |
|---|
| 22 | 22 | | information of all new employees. |
|---|
| 23 | 23 | | Sec. 179.003. STATE FUNDING PROHIBITED FOR FAILURE TO |
|---|
| 24 | 24 | | PARTICIPATE IN E-VERIFY. Beginning the September 1, 2018, state |
|---|
| 25 | 25 | | fiscal year, a political subdivision may not receive state funds if |
|---|
| 26 | 26 | | the political subdivision fails to register or participate in the |
|---|
| 27 | 27 | | E-verify program as required by Section 179.002. A political |
|---|
| 28 | 28 | | subdivision denied state funds under this section may receive state |
|---|
| 29 | 29 | | funds beginning the state fiscal year following the state fiscal |
|---|
| 30 | 30 | | year in which the political subdivision fully complies with the |
|---|
| 31 | 31 | | requirements of Section 179.002. The Governor's Office of Budget, |
|---|
| 32 | 32 | | Planning, and Policy shall adopt rules to implement this section |
|---|
| 33 | 33 | | uniformly among state agencies from which state funds are |
|---|
| 34 | 34 | | distributed to a political subdivision. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2017. |
