77 relating to requiring political subdivisions to participate in the
88 federal electronic verification of employment authorization
99 program or E-verify.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 5, Local Government Code, is
1212 amended by adding Chapter 179 to read as follows:
1313 CHAPTER 179. VERIFICATION OF EMPLOYEE INFORMATION
1414 Sec. 179.001. DEFINITIONS. In this chapter:
1515 (1) "E-verify program" has the meaning assigned by
1616 Section 673.001, Government Code.
1717 (2) "Political subdivision" means a county,
1818 municipality, school district, junior college district, other
1919 special district, or other subdivision of state government.
2020 Sec. 179.002. VERIFICATION. A political subdivision shall
2121 register and participate in the E-verify program to verify
2222 information of all new employees.
2323 Sec. 179.003. STATE FUNDING PROHIBITED FOR FAILURE TO
2424 PARTICIPATE IN E-VERIFY. Beginning the September 1, 2018, state
2525 fiscal year, a political subdivision may not receive state funds if
2626 the political subdivision fails to register or participate in the
2727 E-verify program as required by Section 179.002. A political
2828 subdivision denied state funds under this section may receive state
2929 funds beginning the state fiscal year following the state fiscal
3030 year in which the political subdivision fully complies with the
3131 requirements of Section 179.002. The Governor's Office of Budget,
3232 Planning, and Policy shall adopt rules to implement this section
3333 uniformly among state agencies from which state funds are
3434 distributed to a political subdivision.
3535 SECTION 2. This Act takes effect September 1, 2017.
