7 | 7 | | relating to the abolishment of the Music, Film, Television, and |

8 | 8 | | Multimedia Office in the office of the governor and the moving image |
---|
9 | 9 | | industry incentive program. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 444.030(b), Government Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (b) The commission shall enter into an agreement as required |
---|
14 | 14 | | by Subsection (a) with the: |
---|
15 | 15 | | (1) Texas [Central] Education Agency regarding the |
---|
16 | 16 | | arts in education program in the public schools; and |
---|
17 | 17 | | (2) office of the governor [Music, Film, Television, |
---|
18 | 18 | | and Multimedia Office in the governor's office regarding work with |
---|
19 | 19 | | the state's music and film industries; and |
---|
20 | 20 | | [(3) Texas Department of Commerce], Texas Department |
---|
21 | 21 | | of Transportation, and Parks and Wildlife Department regarding |
---|
22 | 22 | | state tourism promotion efforts. |
---|
23 | 23 | | SECTION 2. Section 2155.444(h), Government Code, is amended |
---|
24 | 24 | | to read as follows: |
---|
25 | 25 | | (h) The [Music, Film, Television, and Multimedia Office |
---|
26 | 26 | | within the] office of the governor has exclusive rulemaking |
---|
27 | 27 | | authority for purposes of: |
---|
28 | 28 | | (1) determining whether an advertising campaign is |
---|
29 | 29 | | subject to the requirements of this section; |
---|
30 | 30 | | (2) establishing a bid process for purposes of the |
---|
31 | 31 | | services described by Subsection (f); and |
---|
32 | 32 | | (3) establishing criteria to determine whether a |
---|
33 | 33 | | commercial production company or advertising agency is located in |
---|
34 | 34 | | this state for the purposes of this section. |
---|
35 | 35 | | SECTION 3. Section 2165.008(a)(1), Government Code, is |
---|
36 | 36 | | amended to read as follows: |
---|
37 | 37 | | (1) "Office" means the office of the governor [Music, |
---|
38 | 38 | | Film, Television, and Multimedia Office]. |
---|
39 | 39 | | SECTION 4. Section 504.639(b), Transportation Code, is |
---|
40 | 40 | | amended to read as follows: |
---|
41 | 41 | | (b) After deduction of the department's administrative |
---|
42 | 42 | | costs, the remainder of the fee for issuance of the license plates |
---|
43 | 43 | | shall be deposited to the credit of the general revenue fund [Texas |
---|
44 | 44 | | Music Foundation account established by Section 7.027, Education |
---|
45 | 45 | | Code]. |
---|
46 | 46 | | SECTION 5. The following statutes are repealed: |
---|
47 | 47 | | (1) Section 7.027, Education Code; |
---|
48 | 48 | | (2) Section 403.029, Government Code; |
---|
49 | 49 | | (3) Chapters 485 and 485A, Government Code; and |
---|
50 | 50 | | (4) Section 151.3415, Tax Code. |
---|
51 | 51 | | SECTION 6. (a) The Music, Film, Television, and Multimedia |
---|
52 | 52 | | Office in the office of the governor is abolished. |
---|
53 | 53 | | (b) All records and other property in the custody of the |
---|
54 | 54 | | Music, Film, Television, and Multimedia Office are transferred to |
---|
55 | 55 | | the office of the governor. |
---|
56 | 56 | | (c) All unobligated and unexpended appropriations of the |
---|
57 | 57 | | Music, Film, Television, and Multimedia Office lapse. |
---|
58 | 58 | | (d) All donations, gifts, and grants made to the Music, |
---|
59 | 59 | | Film, Television, and Multimedia Office shall be transferred to the |
---|
60 | 60 | | office of the governor to be used for purposes consistent with the |
---|
61 | 61 | | mission of the Music, Film, Television, and Multimedia Office. |
---|
62 | 62 | | SECTION 7. This Act takes effect September 1, 2017. |
