55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to credits to certain accounts of the Parks and Wildlife
88 Department resulting from the allocation of the proceeds from taxes
99 imposed on the sale, storage, or use of sporting goods.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 11.035(b), Parks and Wildlife Code, is
1212 amended to read as follows:
1313 (b) The department shall deposit to the credit of the state
1414 parks account all revenue, less allowable costs, received from the
1515 following sources:
1616 (1) grants or operation of concessions in state parks
1717 or fishing piers;
1818 (2) publications on state parks, state historic sites,
1919 or state scientific areas;
2020 (3) fines or penalties received from violations of
2121 regulations governing parks issued pursuant to Subchapter B,
2222 Chapter 13;
2323 (4) fees and revenue collected under Section 11.027(b)
2424 or (c) that are associated with state park lands;
2525 (5) credits made to the department under Section
2626 151.801, Tax Code, in an amount equal to the amount of the
2727 department's share [not to exceed the amount] of the tax proceeds
2828 under that section minus the sum of the amounts appropriated from
2929 other accounts that receive credits from the tax proceeds as
3030 provided by Sections 11.043(b), 24.003(a), and 24.053(a) [account]
3131 for use during the then-current state fiscal biennium [plus the
3232 amount necessary to fund the cost of state contributions for
3333 benefits of department employees whose salaries or wages are paid
3434 from the account]; and
3535 (6) any other source provided by law.
3636 SECTION 2. This Act takes effect September 1, 2017.
