66 AN ACT
77 relating to enhancing the security of the electric grid; making an
88 appropriation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is
1111 amended by adding Section 39.918 to read as follows:
1212 Sec. 39.918. ELECTRIC GRID SECURITY PROGRAM. (a) In this
1313 section, "committee" means the electric grid security advisory
1414 committee.
1515 (b) The commission shall establish a program to pay expenses
1616 incurred to increase the security of the electric grid in ERCOT.
1717 Eligible expenses of the program include:
1818 (1) an audit related to security of the electric grid
1919 and associated computer systems and networks conducted by:
2020 (A) an independent security expert for a
2121 transmission and distribution utility;
2222 (B) an independent organization certified under
2323 Section 39.151;
2424 (C) an electric cooperative;
2525 (D) a river authority; or
2626 (E) a municipally owned utility operating in
2727 ERCOT;
2828 (2) reimbursement of investments or expenses made to
2929 implement measures recommended by the committee or to implement
3030 recommendations made in an audit described by Subdivision (1);
3131 (3) an expense incurred by the committee related to
3232 the retention of consultants or other necessary experts to assist
3333 the committee in performing the committee's duties;
3434 (4) reimbursement to a member of the committee for
3535 travel expenses; and
3636 (5) reimbursement of costs incurred by the commission
3737 in administering this section.
3838 (c) Entities other than the commission seeking
3939 reimbursement from the program must provide adequate documentation
4040 to the committee to demonstrate that the expense is eligible for
4141 reimbursement under this section. The commission shall authorize
4242 reimbursement of eligible expenses not later than five business
4343 days after receipt of a certification from the committee that the
4444 expenditures are eligible under this section.
4545 (d) Each quarter, the commission shall report the total
4646 amount paid for each category of expenses listed in Subsection (b)
4747 to the governor, the lieutenant governor, and the speaker of the
4848 house of representatives.
4949 (e) This section does not prevent any recovery authorized
5050 under this title for reasonable and necessary costs incurred in
5151 relation to ongoing efforts to secure electric facilities from
5252 physical and cyber security threats by:
5353 (1) a transmission and distribution utility;
5454 (2) an independent organization certified under
5555 Section 39.151;
5656 (3) an electric cooperative;
5757 (4) a river authority; or
5858 (5) a municipally owned utility operating in ERCOT.
5959 (f) Notwithstanding Chapter 551, Government Code, the
6060 commission may conduct a closed meeting, as defined by Section
6161 551.001, Government Code, to discuss the findings of the committee,
6262 programs required by this section, and other issues related to the
6363 security of the electric grid and associated computer systems and
6464 networks.
6565 SECTION 2. In addition to other appropriations made by the
6666 85th Legislature, Regular Session, 2017, the amount of $25 million
6767 is appropriated from the general revenue fund to the Public Utility
6868 Commission of Texas for the purpose of implementing Section 39.918,
6969 Utilities Code, as added by this Act, for the period beginning on
7070 the effective date of this Act and ending on the second anniversary
7171 of that date.
7272 SECTION 3. The implementation of the changes in law made by
7373 this Act is contingent on legislation that creates the electric
7474 grid security advisory committee being enacted and becoming law.
7575 If that legislation is not enacted and does not become law, this Act
7676 has no effect.
7777 SECTION 4. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2017.
