99 AN ACT
1010 relating to an adult high school diploma and industry certification
1111 charter school pilot program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 29.259, Education Code, is amended by
1414 amending Subsections (c), (d), and (i) and adding Subsections (n),
1515 (o), and (p) to read as follows:
1616 (c) The agency shall [adopt and] administer a state-adopted
1717 standardized secondary exit-level assessment instrument
1818 appropriate for assessing adult education program participants who
1919 successfully complete high school curriculum requirements under a
2020 program provided under this section. The commissioner shall
2121 determine the level of performance considered to be satisfactory on
2222 the state-adopted secondary exit-level assessment instrument for
2323 receipt of a high school diploma by an adult education program
2424 participant in a program provided under this section.
2525 (d) Notwithstanding any other law and in addition to the
2626 number of charters allowed under Subchapter D, Chapter 12, the
2727 commissioner [a charter under the pilot program] may, on the basis
2828 of an application submitted, grant a charter under the pilot
2929 program [be granted] to a single nonprofit entity described by
3030 Subsection (e) to provide an adult education program for [not more
3131 than 150] individuals described by Subsection (g) to successfully
3232 complete:
3333 (1) a high school program that can lead to a diploma;
3434 and
3535 (2) career and technology education courses that can
3636 lead to industry certification.
3737 (i) A charter granted under this section must:
3838 (1) include a description of the adult education
3939 program to be offered under this section; and
4040 (2) establish specific, objective standards for
4141 receiving a high school diploma, including:
4242 (A) successful completion of:
4343 (i) if applicable to the program
4444 participant, the curriculum requirements under Section 28.025; or
4545 (ii) the appropriate curriculum
4646 requirements applicable to the program participant; and
4747 (B) satisfactory performance on the
4848 state-adopted standardized secondary exit-level assessment
4949 instrument described by Subsection (c).
5050 (n) An adult education program operated under a charter
5151 granted under this section is subject to:
5252 (1) a provision of this title establishing a criminal
5353 offense; and
5454 (2) a prohibition, restriction, or requirement, as
5555 applicable, imposed by this title or a rule adopted under this
5656 title, relating to:
5757 (A) the Public Education Information Management
5858 System (PEIMS) to the extent necessary as determined by the
5959 commissioner to monitor compliance with this section and, as
6060 applicable, Subchapter D, Chapter 12;
6161 (B) criminal history records under Subchapter C,
6262 Chapter 22;
6363 (C) high school graduation requirements under
6464 Section 28.025, to the extent applicable to a program participant;
6565 (D) special education programs under Subchapter
6666 A, Chapter 29;
6767 (E) bilingual education under Subchapter B,
6868 Chapter 29;
6969 (F) health and safety under Chapter 38;
7070 (G) the requirement under Section 21.006 to
7171 report an educator's misconduct; and
7272 (H) the right of an employee to report a crime, as
7373 provided by Section 37.148.
7474 (o) The commissioner shall develop and adopt performance
7575 frameworks that establish standards by which to measure the
7676 performance of an adult high school program operated under a
7777 charter granted under this section in a manner consistent with the
7878 requirements provided for an open-enrollment charter school under
7979 Sections 12.1181(a) and (b). Each year, the commissioner shall
8080 evaluate the performance of an adult high school program operated
8181 under a charter granted under this section based on the applicable
8282 performance frameworks adopted under this subsection. The
8383 commissioner shall include in the performance frameworks adopted
8484 under this subsection the following performance indicators:
8585 (1) the percentage of program participants who
8686 performed satisfactorily on the state-adopted standardized
8787 secondary exit-level assessment instrument described by Subsection
8888 (c);
8989 (2) the percentage of program participants who
9090 successfully completed the high school program and earned a high
9191 school diploma;
9292 (3) the percentage of program participants who
9393 successfully completed career and technology education courses and
9494 obtained industry certification;
9595 (4) the percentage of program participants who have
9696 enrolled in an institution of higher education or private or
9797 independent institution of higher education, as those terms are
9898 defined under Section 61.003; and
9999 (5) the percentage of program participants who earned
100100 a wage, salary, or other income increase that was significant as
101101 determined and reported by the Texas Workforce Commission.
102102 (p) The commissioner shall adopt rules as necessary to
103103 implement and administer the reporting requirements under
104104 Subsection (n)(2)(A) and the evaluation provisions of Subsection
105105 (o).
106106 SECTION 2. Section 29.259(l), Education Code, is repealed.
107107 SECTION 3. This Act takes effect September 1, 2017.
