66 AN ACT
77 relating to safety training for employees performing construction
88 work under a contract with a governmental entity; providing
99 administrative penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 2252, Government Code, is
1212 amended by adding Section 2252.902 to read as follows:
1313 Sec. 2252.902. SAFETY TRAINING REQUIRED FOR EMPLOYEES
1414 PERFORMING CONSTRUCTION WORK UNDER CONTRACTS WITH GOVERNMENTAL
1515 ENTITIES. (a) In this section:
1616 (1) "Construction contract" means a contract or
1717 agreement for the performance of general construction for a
1818 governmental entity.
1919 (2) "Construction safety training" means a
2020 construction and general industry safety training class approved by
2121 the federal Occupational Safety and Health Administration that is
2222 at least 10 hours in duration.
2323 (3) "Contractor" means a person, firm, or corporation
2424 contracting with a governmental entity for general construction.
2525 (4) "Employee" means an individual paid by a
2626 contractor or subcontractor to perform general construction work or
2727 services.
2828 (5) "General construction" means:
2929 (A) erecting or preparing to erect a structure,
3030 including a building, bridge, roadway, public utility facility, or
3131 related structure;
3232 (B) remodeling, extending, repairing, or
3333 demolishing a structure; or
3434 (C) otherwise improving real property or a
3535 structure related to real property.
3636 (6) "Governmental entity" means:
3737 (A) this state; and
3838 (B) a political subdivision of this state,
3939 including a municipality, county, public school district, or
4040 special-purpose district or authority.
4141 (7) "Subcontractor" means a person, firm, or
4242 corporation contracting with a contractor for general
4343 construction.
4444 (b) To the extent consistent with federal law, a
4545 governmental entity that enters into a construction contract must
4646 require that the contractor ensure that all employees working on
4747 the general construction site that is the subject of the
4848 construction contract have completed construction safety training.
4949 Before an employee works on the general construction site, the
5050 contractor must receive and provide to the governmental entity a
5151 certificate of training completion for the employee.
5252 (c) A governmental entity that enters into a construction
5353 contract shall include in the contract notice and penalty
5454 provisions that:
5555 (1) require the governmental entity to provide the
5656 contractor with written notice, hand delivered or by certified
5757 mail, of a violation of Subsection (b) by the contractor;
5858 (2) require the contractor to comply with Subsection
5959 (b) by the 20th day after the date the contractor receives any
6060 notice of noncompliance with that subsection;
6161 (3) inform a contractor that the governmental entity
6262 may impose an administrative penalty if the contractor fails to
6363 comply with Subsection (b) after the 20th day after the date the
6464 contractor receives any notice of noncompliance with that
6565 subsection; and
6666 (4) explain that a penalty amount may be withheld from
6767 a payment otherwise owed to the contractor under the construction
6868 contract.
6969 (d) The amount of a penalty imposed under Subsection (c)(3)
7070 is $100 per day for each employee working in noncompliance.
7171 (e) Each governmental entity shall develop procedures for
7272 the administration of this section.
7373 SECTION 2. Section 2252.902, Government Code, as added by
7474 this Act, applies only to a contract for which the solicitation of
7575 qualifications, proposals, or other similar expressions of
7676 interest is published on or after September 1, 2017.
7777 SECTION 3. This Act takes effect September 1, 2017.
