66 AN ACT
77 relating to an allotment under the foundation school program for
88 students with dyslexia or related disorders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.006(a-1), Education Code, is amended
1111 to read as follows:
1212 (a-1) The commissioner by rule shall require each school
1313 district and open-enrollment charter school to report through the
1414 Public Education Information Management System information
1515 regarding the number of students enrolled in the district or school
1616 who are identified as having dyslexia or related disorders. The
1717 agency shall maintain the information provided in accordance with
1818 this subsection.
1919 SECTION 2. Subchapter C, Chapter 42, Education Code, is
2020 amended by adding Section 42.1561 to read as follows:
2121 Sec. 42.1561. ALLOTMENT FOR STUDENT WITH DYSLEXIA OR
2222 RELATED DISORDER. (a) Subject to Subsection (b), for each student
2323 that a school district serves who has been identified as having
2424 dyslexia or a related disorder, the district is entitled to an
2525 annual allotment equal to the district's adjusted basic allotment
2626 as determined under Section 42.102 or Section 42.103, as
2727 applicable, multiplied by 0.2 for each school year or a greater
2828 amount provided by appropriation.
2929 (b) A school district is entitled to the allotment under
3030 Subsection (a) only for a student who:
3131 (1) is receiving instruction that:
3232 (A) meets applicable dyslexia program criteria
3333 established by the agency; and
3434 (B) is provided by a person with specific
3535 training in providing that instruction; or
3636 (2) has received the instruction described by
3737 Subdivision (1) and is permitted, on the basis of having dyslexia or
3838 a related disorder, to use modifications in the classroom and
3939 accommodations in the administration of assessment instruments
4040 under Section 39.023.
4141 (c) Funds allotted under this section must be used in
4242 providing services to students with dyslexia or related disorders.
4343 SECTION 3. This Act takes effect September 1, 2017.
