| 7 | 7 | | relating to permissible teachers assigned to a bilingual education |

| 8 | 8 | | program and the permissible uses of the bilingual education |
|---|
| 9 | 9 | | allotment provided under the foundation school program. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 29.061, Education Code, is amended by |
|---|
| 12 | 12 | | amending Subsections (b) and (b-1) and adding Subsection (b-3) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (b) Except as provided by Subsection (b-3), a [A] teacher |
|---|
| 15 | 15 | | assigned to a bilingual education program using one of the |
|---|
| 16 | 16 | | following program models must be appropriately certified for |
|---|
| 17 | 17 | | bilingual education by the board: |
|---|
| 18 | 18 | | (1) transitional bilingual/early exit program model; |
|---|
| 19 | 19 | | or |
|---|
| 20 | 20 | | (2) transitional bilingual/late exit program model. |
|---|
| 21 | 21 | | (b-1) Except as provided by Subsection (b-3), a [A] teacher |
|---|
| 22 | 22 | | assigned to a bilingual education program using a dual language |
|---|
| 23 | 23 | | immersion/one-way or two-way program model must be appropriately |
|---|
| 24 | 24 | | certified by the board for: |
|---|
| 25 | 25 | | (1) bilingual education for the component of the |
|---|
| 26 | 26 | | program provided in a language other than English; and |
|---|
| 27 | 27 | | (2) bilingual education or English as a second |
|---|
| 28 | 28 | | language for the component of the program provided in English. |
|---|
| 29 | 29 | | (b-3) A school district may assign to any bilingual |
|---|
| 30 | 30 | | education program a teacher certified for English as a second |
|---|
| 31 | 31 | | language for a school year if: |
|---|
| 32 | 32 | | (1) the commissioner has determined that there is a |
|---|
| 33 | 33 | | shortage of teachers certified for bilingual education by the board |
|---|
| 34 | 34 | | for the school year; and |
|---|
| 35 | 35 | | (2) a teacher certified for bilingual education is not |
|---|
| 36 | 36 | | reasonably available to the district. |
|---|
| 37 | 37 | | SECTION 2. Section 42.153(c), Education Code, is amended to |
|---|
| 38 | 38 | | read as follows: |
|---|
| 39 | 39 | | (c) A district's bilingual education or special language |
|---|
| 40 | 40 | | allocation may be used only for program and student evaluation, |
|---|
| 41 | 41 | | instructional materials and equipment, staff development, |
|---|
| 42 | 42 | | supplemental staff expenses, salary [supplements] for teachers, |
|---|
| 43 | 43 | | and other supplies required for quality instruction and smaller |
|---|
| 44 | 44 | | class size. |
|---|
| 45 | 45 | | SECTION 3. This Act applies beginning with the 2017-2018 |
|---|
| 46 | 46 | | school year. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2017. |
