55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to permissible teachers assigned to a bilingual education
88 program and the permissible uses of the bilingual education
99 allotment provided under the foundation school program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 29.061, Education Code, is amended by
1212 amending Subsections (b) and (b-1) and adding Subsection (b-3) to
1313 read as follows:
1414 (b) Except as provided by Subsection (b-3), a [A] teacher
1515 assigned to a bilingual education program using one of the
1616 following program models must be appropriately certified for
1717 bilingual education by the board:
1818 (1) transitional bilingual/early exit program model;
1919 or
2020 (2) transitional bilingual/late exit program model.
2121 (b-1) Except as provided by Subsection (b-3), a [A] teacher
2222 assigned to a bilingual education program using a dual language
2323 immersion/one-way or two-way program model must be appropriately
2424 certified by the board for:
2525 (1) bilingual education for the component of the
2626 program provided in a language other than English; and
2727 (2) bilingual education or English as a second
2828 language for the component of the program provided in English.
2929 (b-3) A school district may assign to any bilingual
3030 education program a teacher certified for English as a second
3131 language for a school year if:
3232 (1) the commissioner has determined that there is a
3333 shortage of teachers certified for bilingual education by the board
3434 for the school year; and
3535 (2) a teacher certified for bilingual education is not
3636 reasonably available to the district.
3737 SECTION 2. Section 42.153(c), Education Code, is amended to
3838 read as follows:
3939 (c) A district's bilingual education or special language
4040 allocation may be used only for program and student evaluation,
4141 instructional materials and equipment, staff development,
4242 supplemental staff expenses, salary [supplements] for teachers,
4343 and other supplies required for quality instruction and smaller
4444 class size.
4545 SECTION 3. This Act applies beginning with the 2017-2018
4646 school year.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2017.
