99 relating to the creation of the offense of theft of petroleum
1010 product.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 31, Penal Code, is amended by adding
1313 Section 31.19 to read as follows:
1414 Sec. 31.19. THEFT OF PETROLEUM PRODUCT. (a) In this
1515 section, "petroleum product" means crude oil, natural gas, or
1616 condensate.
1717 (b) A person commits an offense if the person unlawfully
1818 appropriates a petroleum product with intent to deprive the owner
1919 of the petroleum product by:
2020 (1) possessing, removing, delivering, receiving,
2121 purchasing, selling, moving, concealing, or transporting the
2222 petroleum product; or
2323 (2) making or causing a connection to be made with, or
2424 drilling or tapping or causing a hole to be drilled or tapped in, a
2525 pipe, pipeline, or tank used to store or transport a petroleum
2626 product.
2727 (c) Appropriation of a petroleum product is unlawful if it
2828 is without the owner's effective consent.
2929 (d) An offense under this section is:
3030 (1) a state jail felony if the total value of the
3131 petroleum product appropriated is less than $10,000;
3232 (2) a felony of the third degree if the total value of
3333 the petroleum product appropriated is $10,000 or more but less than
3434 $100,000;
3535 (3) a felony of the second degree if the total value of
3636 the petroleum product appropriated is $100,000 or more but less
3737 than $300,000; or
3838 (4) a felony of the first degree if the total value of
3939 the petroleum product appropriated is $300,000 or more.
4040 SECTION 2. This Act takes effect September 1, 2017.
