5- A BILL TO BE ENTITLED
64 AN ACT
75 relating to the operation of all-terrain vehicles and recreational
86 off-highway vehicles.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Sections 663.037(d) and (g), Transportation
119 Code, are amended to read as follows:
1210 (d) The operator of an all-terrain vehicle may drive the
1311 vehicle on a public street, road, or highway that is not an
1412 interstate or limited-access highway if:
1513 (1) the transportation is in connection with:
1614 (A) the production, cultivation, care,
1715 harvesting, preserving, drying, processing, canning, storing,
1816 handling, shipping, marketing, selling, or use of agricultural
1917 products, as defined by Section 52.002, Agriculture Code; or
2018 (B) utility work performed by a utility;
2119 (2) the operator attaches to the back of the vehicle
2220 [on top of an eight-foot-long pole] a triangular orange flag that is
2321 at least six feet above ground level;
2422 (3) the vehicle's headlights and taillights are
2523 illuminated;
2624 (4) the operator holds a driver's license, as defined
2725 by Section 521.001;
2826 (5) the operation of the all-terrain vehicle occurs in
2927 the daytime; and
3028 (6) the operation of the all-terrain vehicle does not
3129 exceed a distance of 25 miles from the point of origin to the
3230 destination.
3331 (g) A peace officer or other person who provides law
3432 enforcement, firefighting, ambulance, medical, or other emergency
3533 services, including a volunteer firefighter, may operate an
3634 all-terrain vehicle on a public street, road, or highway that is not
3735 an interstate or limited-access highway only if:
3836 (1) the transportation is in connection with the
3937 performance of the operator's [officer's] official duty;
4038 (2) the operator [officer] attaches to the back of the
4139 vehicle [on top of an eight-foot-long pole] a triangular orange
4240 flag that is at least six feet above ground level;
4341 (3) the vehicle's headlights and taillights are
44- illuminated; and
42+ illuminated;
4543 (4) the operator [officer] holds a driver's license,
46- as defined by Section 521.001[; and
47- [(5) the operation of the all-terrain vehicle does not
48- exceed a distance of 25 miles from the point of origin to the
49- destination].
