77 relating to the minimum wage.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 62.051, Labor Code, is amended to read as
1010 follows:
1111 Sec. 62.051. MINIMUM WAGE. Except as provided by Section
1212 62.057, an employer shall pay to each employee not less than the
1313 greater of:
1414 (1) $10.10 an hour; or
1515 (2) the federal minimum wage under Section 6, Fair
1616 Labor Standards Act of 1938 (29 U.S.C. Section 206).
1717 SECTION 2. Section 62.151, Labor Code, is repealed.
1818 SECTION 3. This Act takes effect December 1, 2017, but only
1919 if the constitutional amendment proposed by the 85th Legislature,
2020 Regular Session, 2017, establishing a minimum wage of the greater
2121 of $10.10 an hour or the federal minimum wage is approved by the
2222 voters. If that proposed constitutional amendment is not approved
2323 by the voters, this Act has no effect.
