99 relating to a divorce on the ground of insupportability.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 6.001, Family Code, is amended to read as
1212 follows:
1313 Sec. 6.001. INSUPPORTABILITY. On the petition of either
1414 party to a marriage, the court may grant a divorce without regard to
1515 fault if:
1616 (1) the marriage has become insupportable because of
1717 discord or conflict of personalities that destroys the legitimate
1818 ends of the marital relationship and prevents any reasonable
1919 expectation of reconciliation; and
2020 (2) both parties to the marriage agree to the grant of
2121 a divorce under this section.
2222 SECTION 2. The change in law made by this Act applies only
2323 to a suit for divorce that is filed on or after the effective date of
2424 this Act. A suit for divorce filed before the effective date of
2525 this Act is governed by the law in effect immediately before the
2626 effective date of this Act, and the former law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2017.
