| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 6.001, Family Code, is amended to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Sec. 6.001. INSUPPORTABILITY. On the petition of either |
|---|
| 14 | 14 | | party to a marriage, the court may grant a divorce without regard to |
|---|
| 15 | 15 | | fault if: |
|---|
| 16 | 16 | | (1) the marriage has become insupportable because of |
|---|
| 17 | 17 | | discord or conflict of personalities that destroys the legitimate |
|---|
| 18 | 18 | | ends of the marital relationship and prevents any reasonable |
|---|
| 19 | 19 | | expectation of reconciliation; and |
|---|
| 20 | 20 | | (2) both parties to the marriage agree to the grant of |
|---|
| 21 | 21 | | a divorce under this section. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to a suit for divorce that is filed on or after the effective date of |
|---|
| 24 | 24 | | this Act. A suit for divorce filed before the effective date of |
|---|
| 25 | 25 | | this Act is governed by the law in effect immediately before the |
|---|
| 26 | 26 | | effective date of this Act, and the former law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2017. |
