8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 62.051, Labor Code, is amended to read as |
---|
10 | 10 | | follows: |
---|
11 | 11 | | Sec. 62.051. MINIMUM WAGE. (a) Except as provided by |
---|
12 | 12 | | Sections 62.052 and [Section] 62.057, an employer shall pay to each |
---|
13 | 13 | | employee not less than the greater of: |
---|
14 | 14 | | (1) $10.10 an hour; or |
---|
15 | 15 | | (2) the federal minimum wage under Section 6, Fair |
---|
16 | 16 | | Labor Standards Act of 1938 (29 U.S.C. Section 206). |
---|
17 | 17 | | (b) This subsection applies to wages paid by an employer for |
---|
18 | 18 | | the 2018, 2019, 2020, and 2021 calendar years. Subsection (a) does |
---|
19 | 19 | | not apply in a year to which this subsection applies. Except as |
---|
20 | 20 | | provided by Sections 62.052 and 62.057: |
---|
21 | 21 | | (1) for the 2018 and 2019 calendar years, an employer |
---|
22 | 22 | | shall pay to each employee not less than the greater of: |
---|
23 | 23 | | (A) $8.25 an hour; or |
---|
24 | 24 | | (B) the federal minimum wage under Section 6, |
---|
25 | 25 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206); and |
---|
26 | 26 | | (2) for the 2020 and 2021 calendar years, an employer |
---|
27 | 27 | | shall pay to each employee not less than the greater of: |
---|
28 | 28 | | (A) $9.25 an hour; or |
---|
29 | 29 | | (B) the federal minimum wage under Section 6, |
---|
30 | 30 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 206). |
---|
31 | 31 | | (c) Subsection (b) and this subsection expire January 1, |
---|
32 | 32 | | 2022. |
---|
33 | 33 | | SECTION 2. Section 62.052, Labor Code, is amended by |
---|
34 | 34 | | amending Subsection (a) and adding Subsections (c) and (d) to read |
---|
35 | 35 | | as follows: |
---|
36 | 36 | | (a) In determining the wage of a tipped employee, the amount |
---|
37 | 37 | | paid the employee by the employer may not be less than [is] the |
---|
38 | 38 | | amount described as paid to a tipped employee under Section 3(m), |
---|
39 | 39 | | Fair Labor Standards Act of 1938 (29 U.S.C. Section 203(m)), plus |
---|
40 | 40 | | $2.85 an hour. |
---|
41 | 41 | | (c) This subsection applies to wages paid by an employer for |
---|
42 | 42 | | the 2018, 2019, 2020, and 2021 calendar years. Subsection (a) does |
---|
43 | 43 | | not apply in a year to which this subsection applies. In determining |
---|
44 | 44 | | the wage of a tipped employee, the amount paid the employee by the |
---|
45 | 45 | | employer may not be less than the amount described as paid to a |
---|
46 | 46 | | tipped employee under Section 3(m), Fair Labor Standards Act of |
---|
47 | 47 | | 1938 (29 U.S.C. Section 203(m)), plus: |
---|
48 | 48 | | (1) for the 2018 and 2019 calendar years, $1 an hour; |
---|
49 | 49 | | and |
---|
50 | 50 | | (2) for the 2020 and 2021 calendar years, $2 an hour. |
---|
51 | 51 | | (d) Subsection (c) and this subsection expire January 1, |
---|
52 | 52 | | 2022. |
---|
53 | 53 | | SECTION 3. Section 62.151, Labor Code, is repealed. |
---|
54 | 54 | | SECTION 4. This Act takes effect January 1, 2018. |
---|
