7 | 7 | | relating to a pilot program for the distribution of certain |

8 | 8 | | contraceptives in participating public school districts. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 38, Education Code, is |
---|
11 | 11 | | amended by adding Section 38.025 to read as follows: |
---|
12 | 12 | | Sec. 38.025. LONG-ACTING REVERSIBLE CONTRACEPTIVE |
---|
13 | 13 | | DISTRIBUTION PILOT PROGRAM. (a) In this section, "pilot program" |
---|
14 | 14 | | means the long-acting reversible contraceptive distribution pilot |
---|
15 | 15 | | program. |
---|
16 | 16 | | (b) Using funds specifically appropriated for the purpose |
---|
17 | 17 | | of the pilot program or other funds available to the agency for that |
---|
18 | 18 | | purpose, available federal funds, or other funds received as |
---|
19 | 19 | | authorized by Subsection (g), the agency, in coordination with the |
---|
20 | 20 | | Health and Human Services Commission and the Department of State |
---|
21 | 21 | | Health Services, shall establish a pilot program under which a |
---|
22 | 22 | | school district participating in the pilot program may distribute |
---|
23 | 23 | | or provide for the distribution of long-acting reversible |
---|
24 | 24 | | contraceptives to students enrolled in the district. |
---|
25 | 25 | | (c) The agency shall designate six school districts to |
---|
26 | 26 | | participate in the pilot program. The agency shall include in the |
---|
27 | 27 | | six districts designated: |
---|
28 | 28 | | (1) a district located in an urban area; |
---|
29 | 29 | | (2) a district located in a rural area; |
---|
30 | 30 | | (3) a district to which Chapter 41 applies; |
---|
31 | 31 | | (4) a district that is not required to take action |
---|
32 | 32 | | under Chapter 41; |
---|
33 | 33 | | (5) a district with a rate of teen pregnancy above the |
---|
34 | 34 | | national average at the time of the designation; and |
---|
35 | 35 | | (6) a district with a rate of teen pregnancy below the |
---|
36 | 36 | | national average at the time of the designation. |
---|
37 | 37 | | (d) A district designated under Subsection (c) may qualify |
---|
38 | 38 | | under multiple criteria described by Subsection (c). |
---|
39 | 39 | | (e) The agency by rule shall designate the specific types of |
---|
40 | 40 | | long-acting reversible contraceptives that may be distributed to |
---|
41 | 41 | | students under the pilot program. |
---|
42 | 42 | | (f) A school district participating in the pilot program may |
---|
43 | 43 | | not distribute or provide for the distribution of a long-acting |
---|
44 | 44 | | reversible contraceptive to a student who is under 18 years of age |
---|
45 | 45 | | unless the school district obtains consent from the parent of or |
---|
46 | 46 | | person standing in parental relation to the student. |
---|
47 | 47 | | (g) The agency may accept grants and donations to fund the |
---|
48 | 48 | | pilot program. |
---|
49 | 49 | | (h) Not later than December 31 of each year that funding is |
---|
50 | 50 | | provided for the pilot program, the agency shall provide a report to |
---|
51 | 51 | | the legislature evaluating the effectiveness of the pilot program. |
---|
52 | 52 | | (i) The agency, the Health and Human Services Commission, |
---|
53 | 53 | | and the Department of State Health Services shall adopt rules as |
---|
54 | 54 | | necessary to implement and administer this section. |
---|
55 | 55 | | (j) This section expires September 1, 2021. |
---|
56 | 56 | | SECTION 2. This Act takes effect September 1, 2017. |
