66 AN ACT
77 relating to a pilot program for the distribution of certain
88 contraceptives in participating public school districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1111 amended by adding Section 38.025 to read as follows:
1212 Sec. 38.025. LONG-ACTING REVERSIBLE CONTRACEPTIVE
1313 DISTRIBUTION PILOT PROGRAM. (a) In this section, "pilot program"
1414 means the long-acting reversible contraceptive distribution pilot
1515 program.
1616 (b) Using funds specifically appropriated for the purpose
1717 of the pilot program or other funds available to the agency for that
1818 purpose, available federal funds, or other funds received as
1919 authorized by Subsection (g), the agency, in coordination with the
2020 Health and Human Services Commission and the Department of State
2121 Health Services, shall establish a pilot program under which a
2222 school district participating in the pilot program may distribute
2323 or provide for the distribution of long-acting reversible
2424 contraceptives to students enrolled in the district.
2525 (c) The agency shall designate six school districts to
2626 participate in the pilot program. The agency shall include in the
2727 six districts designated:
2828 (1) a district located in an urban area;
2929 (2) a district located in a rural area;
3030 (3) a district to which Chapter 41 applies;
3131 (4) a district that is not required to take action
3232 under Chapter 41;
3333 (5) a district with a rate of teen pregnancy above the
3434 national average at the time of the designation; and
3535 (6) a district with a rate of teen pregnancy below the
3636 national average at the time of the designation.
3737 (d) A district designated under Subsection (c) may qualify
3838 under multiple criteria described by Subsection (c).
3939 (e) The agency by rule shall designate the specific types of
4040 long-acting reversible contraceptives that may be distributed to
4141 students under the pilot program.
4242 (f) A school district participating in the pilot program may
4343 not distribute or provide for the distribution of a long-acting
4444 reversible contraceptive to a student who is under 18 years of age
4545 unless the school district obtains consent from the parent of or
4646 person standing in parental relation to the student.
4747 (g) The agency may accept grants and donations to fund the
4848 pilot program.
4949 (h) Not later than December 31 of each year that funding is
5050 provided for the pilot program, the agency shall provide a report to
5151 the legislature evaluating the effectiveness of the pilot program.
5252 (i) The agency, the Health and Human Services Commission,
5353 and the Department of State Health Services shall adopt rules as
5454 necessary to implement and administer this section.
5555 (j) This section expires September 1, 2021.
5656 SECTION 2. This Act takes effect September 1, 2017.
