66 AN ACT
77 relating to the registration of voters at a polling place and
88 related procedures.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 12, Election Code, is
1111 amended by adding Section 12.007 to read as follows:
1212 Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER
1313 REGISTRARS. An election officer serving a polling place for early
1414 voting by personal appearance is a deputy voter registrar and has
1515 the same authority as a regular deputy registrar.
1616 SECTION 2. Chapter 63, Election Code, is amended by adding
1717 Section 63.010 to read as follows:
1818 Sec. 63.010. REGISTRATION AT POLLING PLACE; VOTING
1919 PROCEDURES. (a) This section applies to the conduct of voting and
2020 to the registration of voters notwithstanding and in addition to
2121 other applicable provisions of this code.
2222 (b) A person who would be eligible to vote in an election
2323 under Section 11.001, but for the requirement to be a registered
2424 voter, shall be accepted for voting in the precinct of the person's
2525 residence if, on the day the person offers to vote, the person:
2626 (1) submits a voter registration application that
2727 complies with Section 13.002;
2828 (2) presents the proof of identification required by
2929 Section 63.001 and, if that identification does not establish the
3030 person's residence, one of the following forms of identification:
3131 (A) a driver's license, license to carry a
3232 concealed handgun, or personal identification card issued to the
3333 person by the Department of Public Safety, regardless of whether
3434 the license or card has expired;
3535 (B) official mail addressed to the person by name
3636 from a governmental entity;
3737 (C) a copy of a current utility bill, bank
3838 statement, government check, paycheck, or other government
3939 document that shows the name and address of the voter; or
4040 (D) any other form of identification prescribed
4141 by the secretary of state that establishes the person's residence;
4242 and
4343 (3) completes and signs a voter registration
4444 affidavit, in a form prescribed by the secretary of state, that
4545 contains the following oath:
4646 I, ____________, HEREBY CERTIFY UNDER PENALTY OF
4747 PERJURY THAT, TO THE BEST OF MY KNOWLEDGE, I HAVE NOT,
4848 NOR WILL I, CAST MORE THAN ONE BALLOT IN THIS ELECTION.
4949 (c) Persons voting under this section shall be processed
5050 separately at the polling place from persons who are voting under
5151 regular procedures.
5252 (d) The secretary of state shall prescribe the procedures
5353 necessary to implement this section and to ensure the proper and
5454 orderly conduct of elections.
5555 SECTION 3. This Act takes effect September 1, 2017.
