8 | 8 | | related procedures. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 12, Election Code, is |
---|
11 | 11 | | amended by adding Section 12.007 to read as follows: |
---|
12 | 12 | | Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER |
---|
13 | 13 | | REGISTRARS. An election officer serving a polling place for early |
---|
14 | 14 | | voting by personal appearance is a deputy voter registrar and has |
---|
15 | 15 | | the same authority as a regular deputy registrar. |
---|
16 | 16 | | SECTION 2. Chapter 63, Election Code, is amended by adding |
---|
17 | 17 | | Section 63.010 to read as follows: |
---|
18 | 18 | | Sec. 63.010. REGISTRATION AT POLLING PLACE; VOTING |
---|
19 | 19 | | PROCEDURES. (a) This section applies to the conduct of voting and |
---|
20 | 20 | | to the registration of voters notwithstanding and in addition to |
---|
21 | 21 | | other applicable provisions of this code. |
---|
22 | 22 | | (b) A person who would be eligible to vote in an election |
---|
23 | 23 | | under Section 11.001, but for the requirement to be a registered |
---|
24 | 24 | | voter, shall be accepted for voting in the precinct of the person's |
---|
25 | 25 | | residence if, on the day the person offers to vote, the person: |
---|
26 | 26 | | (1) submits a voter registration application that |
---|
27 | 27 | | complies with Section 13.002; |
---|
28 | 28 | | (2) presents the proof of identification required by |
---|
29 | 29 | | Section 63.001 and, if that identification does not establish the |
---|
30 | 30 | | person's residence, one of the following forms of identification: |
---|
31 | 31 | | (A) a driver's license, license to carry a |
---|
32 | 32 | | concealed handgun, or personal identification card issued to the |
---|
33 | 33 | | person by the Department of Public Safety, regardless of whether |
---|
34 | 34 | | the license or card has expired; |
---|
35 | 35 | | (B) official mail addressed to the person by name |
---|
36 | 36 | | from a governmental entity; |
---|
37 | 37 | | (C) a copy of a current utility bill, bank |
---|
38 | 38 | | statement, government check, paycheck, or other government |
---|
39 | 39 | | document that shows the name and address of the voter; or |
---|
40 | 40 | | (D) any other form of identification prescribed |
---|
41 | 41 | | by the secretary of state that establishes the person's residence; |
---|
42 | 42 | | and |
---|
43 | 43 | | (3) completes and signs a voter registration |
---|
44 | 44 | | affidavit, in a form prescribed by the secretary of state, that |
---|
45 | 45 | | contains the following oath: |
---|
46 | 46 | | I, ____________, HEREBY CERTIFY UNDER PENALTY OF |
---|
47 | 47 | | PERJURY THAT, TO THE BEST OF MY KNOWLEDGE, I HAVE NOT, |
---|
48 | 48 | | NOR WILL I, CAST MORE THAN ONE BALLOT IN THIS ELECTION. |
---|
49 | 49 | | (c) Persons voting under this section shall be processed |
---|
50 | 50 | | separately at the polling place from persons who are voting under |
---|
51 | 51 | | regular procedures. |
---|
52 | 52 | | (d) The secretary of state shall prescribe the procedures |
---|
53 | 53 | | necessary to implement this section and to ensure the proper and |
---|
54 | 54 | | orderly conduct of elections. |
---|
55 | 55 | | SECTION 3. This Act takes effect September 1, 2017. |
