55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the appointment of school marshals by public schools
88 and the ammunition approved for use by a school marshal serving a
99 public school or a public junior college.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 37.0811(a) and (d), Education Code, are
1212 amended to read as follows:
1313 (a) The board of trustees of a school district or the
1414 governing body of an open-enrollment charter school may appoint not
1515 more than the greater of:
1616 (1) one school marshal per 200 [400] students in
1717 average daily attendance per campus; or
1818 (2) for each campus, one school marshal per building
1919 of the campus at which students regularly receive classroom
2020 instruction.
2121 (d) Any written regulations adopted for purposes of
2222 Subsection (c) must provide that a school marshal may carry a
2323 concealed handgun as described by Subsection (c), except that if
2424 the primary duty of the school marshal involves regular, direct
2525 contact with students, the marshal may not carry a concealed
2626 handgun but may possess a handgun on the physical premises of a
2727 school in a locked and secured safe within the marshal's immediate
2828 reach when conducting the marshal's primary duty. The written
2929 regulations must also require that a handgun carried by or within
3030 access of a school marshal may be loaded only with frangible duty
3131 ammunition approved for that purpose by the Texas Commission on Law
3232 Enforcement [designed to disintegrate on impact for maximum safety
3333 and minimal danger to others].
3434 SECTION 2. Section 51.220(e), Education Code, is amended to
3535 read as follows:
3636 (e) Any written regulations adopted for purposes of
3737 Subsection (d) must provide that a school marshal may carry a
3838 concealed handgun as described by Subsection (d), except that if
3939 the primary duty of the school marshal involves regular, direct
4040 contact with students, the marshal may not carry a concealed
4141 handgun but may possess a handgun on the physical premises of a
4242 public junior college campus in a locked and secured safe within the
4343 marshal's immediate reach when conducting the marshal's primary
4444 duty. The written regulations must also require that a handgun
4545 carried by or within access of a school marshal may be loaded only
4646 with frangible duty ammunition approved for that purpose by the
4747 Texas Commission on Law Enforcement [designed to disintegrate on
4848 impact for maximum safety and minimal danger to others].
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2017.
