| 10 | 10 | SECTION 1. Subchapter B, Chapter 372, Transportation Code, | |
| 11 | 11 | is amended by adding Section 372.054 to read as follows: | |
| 12 | 12 | Sec. 372.054. MINIMUM BALANCE FOR COLLECTION BY MAIL OF | |
| 13 | 13 | TOLLS AND ADMINISTRATIVE FEES. Notwithstanding Sections | |
| 14 | 14 | 228.0545(c), 228.055(b), 284.0701(b), 366.178(b-2), and | |
| 15 | 15 | 370.177(c), a toll project entity may not: | |
| 16 | 16 | (1) send an invoice, notice of nonpayment, or other | |
| 17 | 17 | communication requiring the payment of an unpaid toll incurred by a | |
| 18 | 18 | vehicle or an administrative fee associated with that unpaid toll | |
| 19 | 19 | unless the total amount of unpaid tolls owed for the vehicle is $10 | |
| 20 | 20 | or more in a calendar year; or | |
| 21 | 21 | (2) increase the amount of an administrative fee or | |
| 22 | 22 | impose an additional fee for an unpaid toll in the period before a | |
| 23 | 23 | communication requiring payment of the toll is sent. | |
| 24 | 24 | SECTION 2. This Act takes effect September 1, 2017. |
