| 9 | 9 | | Elimination System. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 26, Water Code, is amended |
|---|
| 12 | 12 | | by adding Section 26.054 to read as follows: |
|---|
| 13 | 13 | | Sec. 26.054. NEWSPAPER NOTICE OF PUBLIC MEETING FOR NPDES |
|---|
| 14 | 14 | | PERMITS. Newspaper notice that is required for a public meeting |
|---|
| 15 | 15 | | regarding an NPDES permit must include, in addition to other |
|---|
| 16 | 16 | | applicable requirements, publication of the notice: |
|---|
| 17 | 17 | | (1) in a publication that: |
|---|
| 18 | 18 | | (A) is generally circulated in the municipality |
|---|
| 19 | 19 | | or county in which the facility is located or proposed to be |
|---|
| 20 | 20 | | located; and |
|---|
| 21 | 21 | | (B) is published in a language taught in a |
|---|
| 22 | 22 | | bilingual education program required by Subchapter B, Chapter 29, |
|---|
| 23 | 23 | | Education Code, at the elementary or middle school nearest to the |
|---|
| 24 | 24 | | facility or proposed facility for which the permit is sought; or |
|---|
| 25 | 25 | | (2) in Spanish in the same newspaper as the required |
|---|
| 26 | 26 | | notice if a program or publication described by Subdivision (1) |
|---|
| 27 | 27 | | does not exist. |
|---|
| 28 | 28 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 29 | 29 | | an application for a permit that is filed with the Texas Commission |
|---|
| 30 | 30 | | on Environmental Quality on or after the effective date of this Act. |
|---|
| 31 | 31 | | An application for a permit filed before the effective date of this |
|---|
| 32 | 32 | | Act is governed by the law in effect on the date of filing, and that |
|---|
| 33 | 33 | | law is continued in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2017. |
