55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an increase in punishment for certain persons convicted
88 of theft of a trailer, semitrailer, farm tractor, or implement of
99 husbandry.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 31.03(e), Penal Code, is amended to read
1212 as follows:
1313 (e) Except as provided by Subsection (f), an offense under
1414 this section is:
1515 (1) a Class C misdemeanor if the value of the property
1616 stolen is less than $100;
1717 (2) a Class B misdemeanor if:
1818 (A) the value of the property stolen is $100 or
1919 more but less than $750;
2020 (B) the value of the property stolen is less than
2121 $100 and the defendant has previously been convicted of any grade of
2222 theft; or
2323 (C) the property stolen is a driver's license,
2424 commercial driver's license, or personal identification
2525 certificate issued by this state or another state;
2626 (3) a Class A misdemeanor if the value of the property
2727 stolen is $750 or more but less than $2,500;
2828 (4) a state jail felony if:
2929 (A) the value of the property stolen is $2,500 or
3030 more but less than $30,000, or the property is less than 10 head of
3131 sheep, swine, or goats or any part thereof under the value of
3232 $30,000;
3333 (B) regardless of value, the property is stolen
3434 from the person of another or from a human corpse or grave,
3535 including property that is a military grave marker;
3636 (C) the property stolen is a firearm, as defined
3737 by Section 46.01;
3838 (D) the value of the property stolen is less than
3939 $2,500 and the defendant has been previously convicted two or more
4040 times of any grade of theft;
4141 (E) the property stolen is an official ballot or
4242 official carrier envelope for an election; or
4343 (F) the value of the property stolen is less than
4444 $20,000 and the property stolen is:
4545 (i) aluminum;
4646 (ii) bronze;
4747 (iii) copper; or
4848 (iv) brass;
4949 (5) a felony of the third degree if the value of the
5050 property stolen is $30,000 or more but less than $150,000, or the
5151 property is:
5252 (A) cattle, horses, or exotic livestock or exotic
5353 fowl as defined by Section 142.001, Agriculture Code, stolen during
5454 a single transaction and having an aggregate value of less than
5555 $150,000; [or]
5656 (B) 10 or more head of sheep, swine, or goats
5757 stolen during a single transaction and having an aggregate value of
5858 less than $150,000; or
5959 (C) a trailer, semitrailer, farm tractor, or
6060 implement of husbandry, as defined by Section 541.201,
6161 Transportation Code, that has a value of less than $30,000;
6262 (6) a felony of the second degree if:
6363 (A) the value of the property stolen is $150,000
6464 or more but less than $300,000; or
6565 (B) the value of the property stolen is less than
6666 $300,000 and the property stolen is an automated teller machine or
6767 the contents or components of an automated teller machine; or
6868 (7) a felony of the first degree if the value of the
6969 property stolen is $300,000 or more.
7070 SECTION 2. The change in law made by this Act applies only
7171 to an offense committed on or after the effective date of this Act.
7272 An offense committed before the effective date of this Act is
7373 governed by the law in effect on the date the offense was committed,
7474 and the former law is continued in effect for that purpose. For
7575 purposes of this section, an offense was committed before the
7676 effective date of this Act if any element of the offense occurred
7777 before that date.
7878 SECTION 3. This Act takes effect September 1, 2017.
