11 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 10 | | SECTION 1. Subchapter B, Chapter 151, Occupations Code, is |
---|
13 | 11 | | amended by adding Section 151.0521 to read as follows: |
---|
14 | 12 | | Sec. 151.0521. EXEMPTION FOR SPORTS TEAM PHYSICIAN. A |
---|
15 | 13 | | person is exempt from the licensing requirements of this subtitle |
---|
16 | 14 | | and may engage in the practice of medicine in this state if the |
---|
17 | 15 | | person: |
---|
18 | 16 | | (1) is employed or designated as a team physician by a |
---|
19 | 17 | | sports team visiting this state for a specific sporting event; |
---|
20 | 18 | | (2) is licensed to practice medicine in the team's home |
---|
21 | 19 | | state; and |
---|
22 | 20 | | (3) limits the person's practice of medicine in this |
---|
23 | 21 | | state to treating, during the period beginning on the date the team |
---|
24 | 22 | | arrives in this state for the event and ending on the 10th day after |
---|
25 | 23 | | the date of the event: |
---|
26 | 24 | | (A) the members, coaches, and staff of the team; |
---|
27 | 25 | | and |
---|
28 | 26 | | (B) a family member of a person described by |
---|
29 | 27 | | Paragraph (A) if the family member is visiting this state for the |
---|
30 | 28 | | event. |
---|
31 | 29 | | SECTION 2. Section 451.003, Occupations Code, is amended to |
---|
32 | 30 | | read as follows: |
---|
33 | 31 | | Sec. 451.003. APPLICABILITY. This chapter does not apply |
---|
34 | 32 | | to: |
---|
35 | 33 | | (1) a physician licensed by the Texas Medical Board or |
---|
36 | 34 | | engaged in the practice of medicine as authorized by Section |
---|
37 | 35 | | 151.0521; |
---|
38 | 36 | | (2) a dentist, licensed under the laws of this state, |
---|
39 | 37 | | engaged in the practice of dentistry; |
---|
40 | 38 | | (3) a licensed optometrist or therapeutic optometrist |
---|
41 | 39 | | engaged in the practice of optometry or therapeutic optometry as |
---|
42 | 40 | | defined by statute; |
---|
43 | 41 | | (4) an occupational therapist engaged in the practice |
---|
44 | 42 | | of occupational therapy; |
---|
45 | 43 | | (5) a nurse engaged in the practice of nursing; |
---|
46 | 44 | | (6) a licensed podiatrist engaged in the practice of |
---|
47 | 45 | | podiatry as defined by statute; |
---|
48 | 46 | | (7) a physical therapist engaged in the practice of |
---|
49 | 47 | | physical therapy; |
---|
50 | 48 | | (8) a registered massage therapist engaged in the |
---|
51 | 49 | | practice of massage therapy; |
---|
52 | 50 | | (9) a commissioned or contract physician, physical |
---|
53 | 51 | | therapist, or physical therapist assistant in the United States |
---|
54 | 52 | | Army, Navy, Air Force, or Public Health Service; or |
---|
55 | 53 | | (10) an athletic trainer who does not live in this |
---|
56 | 54 | | state, who is licensed, registered, or certified by an authority |
---|
57 | 55 | | recognized by the department, and who provides athletic training in |
---|
58 | 56 | | this state for a period determined by the department. |
---|
59 | 57 | | SECTION 3. This Act takes effect September 1, 2017. |
