97 relating to an exemption from licensing requirements for physicians
108 associated with certain sports teams.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter B, Chapter 151, Occupations Code, is
1311 amended by adding Section 151.0521 to read as follows:
1412 Sec. 151.0521. EXEMPTION FOR SPORTS TEAM PHYSICIAN. A
1513 person is exempt from the licensing requirements of this subtitle
1614 and may engage in the practice of medicine in this state if the
1715 person:
1816 (1) is employed or designated as a team physician by a
1917 sports team visiting this state for a specific sporting event;
2018 (2) is licensed to practice medicine in the team's home
2119 state; and
2220 (3) limits the person's practice of medicine in this
2321 state to treating, during the period beginning on the date the team
2422 arrives in this state for the event and ending on the 10th day after
2523 the date of the event:
2624 (A) the members, coaches, and staff of the team;
2725 and
2826 (B) a family member of a person described by
2927 Paragraph (A) if the family member is visiting this state for the
3028 event.
3129 SECTION 2. Section 451.003, Occupations Code, is amended to
3230 read as follows:
3331 Sec. 451.003. APPLICABILITY. This chapter does not apply
3432 to:
3533 (1) a physician licensed by the Texas Medical Board or
3634 engaged in the practice of medicine as authorized by Section
3735 151.0521;
3836 (2) a dentist, licensed under the laws of this state,
3937 engaged in the practice of dentistry;
4038 (3) a licensed optometrist or therapeutic optometrist
4139 engaged in the practice of optometry or therapeutic optometry as
4240 defined by statute;
4341 (4) an occupational therapist engaged in the practice
4442 of occupational therapy;
4543 (5) a nurse engaged in the practice of nursing;
4644 (6) a licensed podiatrist engaged in the practice of
4745 podiatry as defined by statute;
4846 (7) a physical therapist engaged in the practice of
4947 physical therapy;
5048 (8) a registered massage therapist engaged in the
5149 practice of massage therapy;
5250 (9) a commissioned or contract physician, physical
5351 therapist, or physical therapist assistant in the United States
5452 Army, Navy, Air Force, or Public Health Service; or
5553 (10) an athletic trainer who does not live in this
5654 state, who is licensed, registered, or certified by an authority
5755 recognized by the department, and who provides athletic training in
5856 this state for a period determined by the department.
5957 SECTION 3. This Act takes effect September 1, 2017.
