8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Article 19.01, Code of Criminal Procedure, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Art. 19.01. SELECTION AND SUMMONS OF PROSPECTIVE GRAND | |
12 | 12 | JURORS. The district judge shall direct that 20 to 250 [125] | |
13 | 13 | prospective grand jurors be selected and summoned, with return on | |
14 | 14 | summons, in the same manner as for the selection and summons of | |
15 | 15 | panels for the trial of civil cases in the district courts. The | |
16 | 16 | judge shall try the qualifications for and excuses from service as a | |
17 | 17 | grand juror and impanel the completed grand jury as provided by this | |
18 | 18 | chapter. | |
19 | 19 | SECTION 2. A district judge who on or after the effective | |
20 | 20 | date of this Act directs that prospective grand jurors be selected | |
21 | 21 | and summoned shall comply with the requirements of Article 19.01, | |
22 | 22 | Code of Criminal Procedure, as amended by this Act. A district | |
23 | 23 | judge who before the effective date of this Act directs that | |
24 | 24 | prospective grand jurors be selected and summoned shall comply with | |
25 | 25 | Article 19.01, Code of Criminal Procedure, as it existed | |
26 | 26 | immediately before the effective date of this Act. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2017. |
