55 CONCURRENT RESOLUTION
66 WHEREAS, House Bill No. 1500 has been adopted by the house of
77 representatives and the senate and is being prepared for
88 enrollment; and
99 WHEREAS, The bill contains technical errors that should be
1010 corrected; now, therefore, be it
1111 RESOLVED by the 85th Legislature of the State of Texas, That
1212 the enrolling clerk of the house of representatives be instructed
1313 to correct the enrolled version of House Bill No. 1500 by striking
1414 Section 39.054(a-1), Education Code, as amended in both places by
1515 the bill (Senate Floor Amendment No. 3, pages 2 and 3) and
1616 substituting the following in the first place that subsection is
1717 amended by the bill:
1818 (a-1) In [For purposes of] assigning [an overall]
1919 performance ratings [rating] under Subsection (a), the
2020 commissioner may adjust the overall performance rating of a
2121 district or campus if the performance of the district or campus
2222 under the indicators described by Section 39.053(c), based on
2323 information disaggregated by race, ethnicity, socioeconomic
2424 status, or other factors, does not meet standards established by
2525 the commissioner. The commissioner shall [attribute]:
2626 (1) attribute 55 percent of the performance evaluation
2727 to the achievement indicators for the first, second, and third
2828 domains under Sections 39.053(c)(1)-(3), provided that the
2929 commissioner shall consider either the district's or campus's
3030 performance rating under the first domain or the second domain,
3131 whichever performance rating is higher, unless the district or
3232 campus received a performance rating of F in either domain, in which
3333 case the district or campus may not be assigned an overall
3434 performance rating higher than B;
3535 (2) for middle and junior high school and elementary
3636 campuses and districts that include only those campuses, attribute
3737 35 percent of the performance evaluation to the applicable
3838 achievement indicators for the fourth domain under Section
3939 39.053(c)(4);
4040 (3) for high school campuses and districts that
4141 include those campuses, attribute:
4242 (A) 10 percent of the performance evaluation to
4343 the high school graduation rate achievement indicator described by
4444 Section 39.053(c)(4)(A)(ii); and
4545 (B) 25 percent to the remaining applicable
4646 achievement indicators for the fourth domain under Section
4747 39.053(c)(4); and
4848 (4) attribute 10 percent of the performance evaluation
4949 to the locally selected and evaluated achievement indicators
5050 provided for under the fifth domain under Section 39.053(c)(5).
