44 A JOINT RESOLUTION
55 proposing a constitutional amendment guaranteeing the right to life
66 of unborn children and prohibiting abortion to the fullest extent
77 possible and to be known as the "Life at Conception provision of the
88 Texas Constitution's Bill of Rights".
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 19, Article I, Texas Constitution, is
1111 amended to read as follows:
1212 Sec. 19. DEPRIVATION OF LIFE, LIBERTY, ETC.; DUE COURSE OF
1313 LAW. (a) No citizen of this State shall be deprived of life,
1414 liberty, property, privileges or immunities, or in any manner
1515 disfranchised, except by the due course of the law of the land.
1616 (b) The term ''citizen of this State''
1717 includes each member
1818 of the species homo sapiens at all stages of life, including the
1919 moment of fertilization, or other moment at which an individual
2020 member of the human species comes into being.
2121 (c) The right to life guaranteed by the Constitution is
2222 vested in each human being, born and unborn. Nothing in this Article
2323 shall be construed to require the prosecution of any woman for the
2424 death of her unborn child, a prohibition on in vitro fertilization,
2525 or a prohibition on use of birth control or another means of
2626 preventing fertilization.
2727 (d) To the fullest extent possible, abortion is prohibited
2828 in this State.
2929 (e) Subsections (c) or (d) do not prohibit a person from
3030 receiving an abortion if:
3131 (1) the case is a medical emergency as defined by
3232 Section 171.002, Health and Safety Code; or
3333 (2) the pregnancy was induced by cause or product of
3434 rape or incest.
3535 SECTION 2. This proposed constitutional amendment shall be
3636 submitted to the voters at an election to be held November 7, 2017.
3737 The ballot shall be printed to provide for voting for or against the
3838 following proposition: "The constitutional amendment guaranteeing
3939 the right to life from the moment of conception and, to the fullest
4040 extent possible, prohibiting abortion."
