| 6 | 6 | | of unborn children and prohibiting abortion to the fullest extent |

| 7 | 7 | | possible and to be known as the "Life at Conception provision of the |
|---|
| 8 | 8 | | Texas Constitution's Bill of Rights". |
|---|
| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 19, Article I, Texas Constitution, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 19. DEPRIVATION OF LIFE, LIBERTY, ETC.; DUE COURSE OF |
|---|
| 13 | 13 | | LAW. (a) No citizen of this State shall be deprived of life, |
|---|
| 14 | 14 | | liberty, property, privileges or immunities, or in any manner |
|---|
| 15 | 15 | | disfranchised, except by the due course of the law of the land. |
|---|
| 16 | 16 | | (b) The term ''citizen of this State'' |
|---|
| 17 | 17 | | includes each member |
|---|
| 18 | 18 | | of the species homo sapiens at all stages of life, including the |
|---|
| 19 | 19 | | moment of fertilization, or other moment at which an individual |
|---|
| 20 | 20 | | member of the human species comes into being. |
|---|
| 21 | 21 | | (c) The right to life guaranteed by the Constitution is |
|---|
| 22 | 22 | | vested in each human being, born and unborn. Nothing in this Article |
|---|
| 23 | 23 | | shall be construed to require the prosecution of any woman for the |
|---|
| 24 | 24 | | death of her unborn child, a prohibition on in vitro fertilization, |
|---|
| 25 | 25 | | or a prohibition on use of birth control or another means of |
|---|
| 26 | 26 | | preventing fertilization. |
|---|
| 27 | 27 | | (d) To the fullest extent possible, abortion is prohibited |
|---|
| 28 | 28 | | in this State. |
|---|
| 29 | 29 | | (e) Subsections (c) or (d) do not prohibit a person from |
|---|
| 30 | 30 | | receiving an abortion if: |
|---|
| 31 | 31 | | (1) the case is a medical emergency as defined by |
|---|
| 32 | 32 | | Section 171.002, Health and Safety Code; or |
|---|
| 33 | 33 | | (2) the pregnancy was induced by cause or product of |
|---|
| 34 | 34 | | rape or incest. |
|---|
| 35 | 35 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 36 | 36 | | submitted to the voters at an election to be held November 7, 2017. |
|---|
| 37 | 37 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 38 | 38 | | following proposition: "The constitutional amendment guaranteeing |
|---|
| 39 | 39 | | the right to life from the moment of conception and, to the fullest |
|---|
| 40 | 40 | | extent possible, prohibiting abortion." |
