55 A JOINT RESOLUTION
66 proposing a constitutional amendment to provide for the use and
77 dedication of certain money transferred to the general revenue fund
88 account for emergency medical services and trauma care systems.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 49-g(c), (c-1), and (c-2), Article III,
1111 Texas Constitution, are amended to read as follows:
1212 (c) Not later than the 90th day of each fiscal year, the
1313 comptroller of public accounts shall transfer from the general
1414 revenue fund to the economic stabilization fund, to [and] the state
1515 highway fund, and as provided by general law to an account in the
1616 general revenue fund for emergency medical services and trauma care
1717 systems the sum of the amounts described by Subsections (d) and (e)
1818 of this section, to be allocated as provided by Subsections (c-1)
1919 and (c-2) of this section. However, if necessary and
2020 notwithstanding the allocations prescribed by Subsections (c-1)
2121 and (c-2) of this section, the comptroller shall reduce
2222 proportionately the amounts described by Subsections (d) and (e) of
2323 this section to be transferred and allocated to the economic
2424 stabilization fund to prevent the amount in that fund from
2525 exceeding the limit in effect for that biennium under Subsection
2626 (g) of this section. Revenue transferred to the state highway fund
2727 under this subsection may be used only for constructing,
2828 maintaining, and acquiring rights-of-way for public roadways other
2929 than toll roads. Revenue transferred to the general revenue fund
3030 account under this subsection may be appropriated only for county
3131 and regional emergency medical services, designated trauma
3232 facilities, and trauma care systems as provided by general law.
3333 (c-1) Of the sum of the amounts described by Subsections (d)
3434 and (e) of this section and required to be transferred from the
3535 general revenue fund under Subsection (c) of this section, the
3636 comptroller shall allocate three-eighths [one-half] to the
3737 economic stabilization fund, one-eighth to the general revenue fund
3838 account for emergency medical services and trauma care systems, and
3939 the remainder to the state highway fund, except as provided by
4040 Subsection (c-2) of this section.
4141 (c-2) The legislature by general law shall provide for a
4242 procedure by which the allocation of the sum of the amounts
4343 described by Subsections (d) and (e) of this section may be adjusted
4444 to provide for a transfer to the economic stabilization fund of an
4545 amount greater than the allocation provided for under Subsection
4646 (c-1) of this section with the remainder of that sum, if any,
4747 allocated for transfer to the state highway fund and the general
4848 revenue fund account for emergency medical services and trauma care
4949 systems. The allocation made as provided by that general law is
5050 binding on the comptroller for the purposes of the transfers
5151 required by Subsection (c) of this section.
5252 SECTION 2. The following temporary provision is added to
5353 the Texas Constitution:
5454 TEMPORARY PROVISION. (a) This temporary provision applies
5555 to the constitutional amendment proposed by the 85th Legislature,
5656 Regular Session, 2017, to provide for the transfer of certain
5757 general revenue to the general revenue fund account for emergency
5858 medical services and trauma care systems and for the dedication of
5959 the revenue transferred to that account.
6060 (b) The amendment to Section 49-g, Article III, of this
6161 constitution takes effect immediately on the final canvass of the
6262 election on the amendment. If, between September 1, 2017, and the
6363 effective date of that constitutional amendment, the comptroller of
6464 public accounts has transferred from general revenue to the
6565 economic stabilization fund or the state highway fund amounts in
6666 accordance with Subsections (c), (d), and (e) of that section, as
6767 those subsections existed at the time of the transfer, as soon as
6868 practicable after the effective date of the amendment, the
6969 comptroller shall return the transferred amounts from the economic
7070 stabilization fund and state highway fund to general revenue and
7171 transfer from general revenue to the economic stabilization fund,
7272 the state highway fund, and an account in the general revenue fund
7373 for emergency medical services and trauma care systems amounts in
7474 accordance with the amended provisions and in accordance with
7575 general law, notwithstanding the requirement of Subsection (c) of
7676 that section that the transfers for that fiscal year be made before
7777 the 90th day of the fiscal year beginning September 1, 2017.
7878 (c) This temporary provision expires January 1, 2020.
7979 SECTION 3. This proposed constitutional amendment shall be
8080 submitted to the voters at an election to be held November 7, 2017.
8181 The ballot shall be printed to permit voting for or against the
8282 proposition: "The constitutional amendment providing for the use
8383 and dedication of certain money transferred to the general revenue
8484 fund account for emergency medical services and trauma care systems
8585 to assist county and regional emergency medical services,
8686 designated trauma facilities, and trauma care systems."
