5	5	A JOINT RESOLUTION
6	6	proposing a constitutional amendment to provide for the use and
7	7	dedication of certain money transferred to the general revenue fund
8	8	account for emergency medical services and trauma care systems.
9	9	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Sections 49-g(c), (c-1), and (c-2), Article III,
11	11	Texas Constitution, are amended to read as follows:
12	12	(c) Not later than the 90th day of each fiscal year, the
13	13	comptroller of public accounts shall transfer from the general
14	14	revenue fund to the economic stabilization fund, to [and] the state
15	15	highway fund, and as provided by general law to an account in the
16	16	general revenue fund for emergency medical services and trauma care
17	17	systems the sum of the amounts described by Subsections (d) and (e)
18	18	of this section, to be allocated as provided by Subsections (c-1)
19	19	and (c-2) of this section. However, if necessary and
20	20	notwithstanding the allocations prescribed by Subsections (c-1)
21	21	and (c-2) of this section, the comptroller shall reduce
22	22	proportionately the amounts described by Subsections (d) and (e) of
23	23	this section to be transferred and allocated to the economic
24	24	stabilization fund to prevent the amount in that fund from
25	25	exceeding the limit in effect for that biennium under Subsection
26	26	(g) of this section. Revenue transferred to the state highway fund
27	27	under this subsection may be used only for constructing,
28	28	maintaining, and acquiring rights-of-way for public roadways other
29	29	than toll roads. Revenue transferred to the general revenue fund
30	30	account under this subsection may be appropriated only for county
31	31	and regional emergency medical services, designated trauma
32	32	facilities, and trauma care systems as provided by general law.
33	33	(c-1) Of the sum of the amounts described by Subsections (d)
34	34	and (e) of this section and required to be transferred from the
35	35	general revenue fund under Subsection (c) of this section, the
36	36	comptroller shall allocate three-eighths [one-half] to the
37	37	economic stabilization fund, one-eighth to the general revenue fund
38	38	account for emergency medical services and trauma care systems, and
39	39	the remainder to the state highway fund, except as provided by
40	40	Subsection (c-2) of this section.
41	41	(c-2) The legislature by general law shall provide for a
42	42	procedure by which the allocation of the sum of the amounts
43	43	described by Subsections (d) and (e) of this section may be adjusted
44	44	to provide for a transfer to the economic stabilization fund of an
45	45	amount greater than the allocation provided for under Subsection
46	46	(c-1) of this section with the remainder of that sum, if any,
47	47	allocated for transfer to the state highway fund and the general
48	48	revenue fund account for emergency medical services and trauma care
49	49	systems. The allocation made as provided by that general law is
50	50	binding on the comptroller for the purposes of the transfers
51	51	required by Subsection (c) of this section.
52	52	SECTION 2. The following temporary provision is added to
53	53	the Texas Constitution:
54	54	TEMPORARY PROVISION. (a) This temporary provision applies
55	55	to the constitutional amendment proposed by the 85th Legislature,
56	56	Regular Session, 2017, to provide for the transfer of certain
57	57	general revenue to the general revenue fund account for emergency
58	58	medical services and trauma care systems and for the dedication of
59	59	the revenue transferred to that account.
60	60	(b) The amendment to Section 49-g, Article III, of this
61	61	constitution takes effect immediately on the final canvass of the
62	62	election on the amendment. If, between September 1, 2017, and the
63	63	effective date of that constitutional amendment, the comptroller of
64	64	public accounts has transferred from general revenue to the
65	65	economic stabilization fund or the state highway fund amounts in
66	66	accordance with Subsections (c), (d), and (e) of that section, as
67	67	those subsections existed at the time of the transfer, as soon as
68	68	practicable after the effective date of the amendment, the
69	69	comptroller shall return the transferred amounts from the economic
70	70	stabilization fund and state highway fund to general revenue and
71	71	transfer from general revenue to the economic stabilization fund,
72	72	the state highway fund, and an account in the general revenue fund
73	73	for emergency medical services and trauma care systems amounts in
74	74	accordance with the amended provisions and in accordance with
75	75	general law, notwithstanding the requirement of Subsection (c) of
76	76	that section that the transfers for that fiscal year be made before
77	77	the 90th day of the fiscal year beginning September 1, 2017.
78	78	(c) This temporary provision expires January 1, 2020.
79	79	SECTION 3. This proposed constitutional amendment shall be
80	80	submitted to the voters at an election to be held November 7, 2017.
81	81	The ballot shall be printed to permit voting for or against the
82	82	proposition: "The constitutional amendment providing for the use
83	83	and dedication of certain money transferred to the general revenue
84	84	fund account for emergency medical services and trauma care systems
85	85	to assist county and regional emergency medical services,
86	86	designated trauma facilities, and trauma care systems."
