55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the governing
77 bodies of certain political subdivisions to exempt from ad valorem
88 taxation the real and tangible personal property of businesses
99 during an initial period of operation in this state.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article VIII, Texas Constitution, is amended by
1212 adding Section 1-s to read as follows:
1313 Sec. 1-s. (a) The governing body of a political subdivision
1414 may exempt from ad valorem taxation the real and tangible personal
1515 property of a business during the first 10 years that the business
1616 operates in this state if:
1717 (1) the business first begins operating in this state
1818 on or after January 1, 2018; and
1919 (2) the property is located in a county with a
2020 population of 250,000 or less.
2121 (b) The legislature by general law may provide additional
2222 eligibility requirements for an exemption authorized by this
2323 section.
2424 SECTION 2. The following temporary provision is added to
2525 the Texas Constitution:
2626 TEMPORARY PROVISION. (a) This temporary provision applies
2727 to the constitutional amendment proposed by the 85th Legislature,
2828 Regular Session, 2017, authorizing the governing bodies of certain
2929 political subdivisions to exempt from ad valorem taxation the real
3030 and tangible personal property of businesses during an initial
3131 period of operation in this state.
3232 (b) Section 1-s, Article VIII, of this constitution takes
3333 effect January 1, 2018, and applies only to a tax year beginning on
3434 or after that date.
3535 (c) This temporary provision expires January 1, 2019.
3636 SECTION 3. This proposed constitutional amendment shall be
3737 submitted to the voters at an election to be held November 7, 2017.
3838 The ballot shall be printed to permit voting for or against the
3939 proposition: "The constitutional amendment authorizing the
4040 governing bodies of certain political subdivisions to exempt from
4141 ad valorem taxation the real and tangible personal property of
4242 businesses during an initial period of operation in this state."
