9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 28, Article V, Texas Constitution, is | |
11 | 11 | amended by adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) To fill a vacancy in the office of a District Judge, | |
13 | 13 | the Governor may not appoint a person who within the two years | |
14 | 14 | immediately preceding the date of appointment prosecuted any | |
15 | 15 | criminal case in a district court as a District Attorney, Criminal | |
16 | 16 | District Attorney, County Attorney, or assistant District | |
17 | 17 | Attorney, Criminal District Attorney, or County Attorney. | |
18 | 18 | SECTION 2. This proposed constitutional amendment shall be | |
19 | 19 | submitted to the voters at an election to be held November 7, 2017. | |
20 | 20 | The ballot shall be printed to permit voting for or against the | |
21 | 21 | proposition: "The constitutional amendment prohibiting the | |
22 | 22 | governor from appointing certain prosecuting attorneys to fill a | |
23 | 23 | vacancy of a district judge." |
