55 A JOINT RESOLUTION
66 proposing a constitutional amendment prohibiting the governor from
77 appointing certain prosecuting attorneys to fill a vacancy of a
88 district judge.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28, Article V, Texas Constitution, is
1111 amended by adding Subsection (a-1) to read as follows:
1212 (a-1) To fill a vacancy in the office of a District Judge,
1313 the Governor may not appoint a person who within the two years
1414 immediately preceding the date of appointment prosecuted any
1515 criminal case in a district court as a District Attorney, Criminal
1616 District Attorney, County Attorney, or assistant District
1717 Attorney, Criminal District Attorney, or County Attorney.
1818 SECTION 2. This proposed constitutional amendment shall be
1919 submitted to the voters at an election to be held November 7, 2017.
2020 The ballot shall be printed to permit voting for or against the
2121 proposition: "The constitutional amendment prohibiting the
2222 governor from appointing certain prosecuting attorneys to fill a
2323 vacancy of a district judge."
