| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article IV, Texas Constitution, is amended by |
|---|
| 12 | 12 | | adding Section 12A to read as follows: |
|---|
| 13 | 13 | | Sec. 12A. In making any appointment to a state board, |
|---|
| 14 | 14 | | commission, or other governing body of a state agency, the Governor |
|---|
| 15 | 15 | | shall, to the extent possible, ensure that the gender composition |
|---|
| 16 | 16 | | of the board, commission, or governing body reflects the gender |
|---|
| 17 | 17 | | composition of this state. |
|---|
| 18 | 18 | | SECTION 2. The following temporary provision is added to |
|---|
| 19 | 19 | | the Texas Constitution: |
|---|
| 20 | 20 | | TEMPORARY PROVISION. (a) This temporary provision applies to |
|---|
| 21 | 21 | | the constitutional amendment proposed by the 85th Legislature, |
|---|
| 22 | 22 | | Regular Session, 2017, requiring the governor's appointments to |
|---|
| 23 | 23 | | state boards, commissions, or other governing bodies of state |
|---|
| 24 | 24 | | agencies to reflect the gender composition of this state. |
|---|
| 25 | 25 | | (b) The adoption of the amendment does not affect the |
|---|
| 26 | 26 | | entitlement of a member serving on a state board, commission, or |
|---|
| 27 | 27 | | other governing body of a state agency to continue to carry out the |
|---|
| 28 | 28 | | functions of the board, commission, or governing body for the |
|---|
| 29 | 29 | | remainder of the member's term. Except as otherwise provided by |
|---|
| 30 | 30 | | this subsection, as the terms of the members of the board, |
|---|
| 31 | 31 | | commission, or governing body expire or as a vacancy occurs, the |
|---|
| 32 | 32 | | governor shall appoint members to the board, commission, or |
|---|
| 33 | 33 | | governing body to achieve, as soon as possible, the gender |
|---|
| 34 | 34 | | composition prescribed for the board, commission, or governing body |
|---|
| 35 | 35 | | by this amendment. This subsection does not prohibit a person who is |
|---|
| 36 | 36 | | a member of a state board, commission, or other governing body of a |
|---|
| 37 | 37 | | state agency from being reappointed to the board, commission, or |
|---|
| 38 | 38 | | governing body as provided by law notwithstanding the effect of |
|---|
| 39 | 39 | | that person's reappointment on the gender composition of the board, |
|---|
| 40 | 40 | | commission, or governing body. |
|---|
| 41 | 41 | | (c) This temporary provision expires January 1, 2024. |

| 42 | 42 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 43 | 43 | | submitted to the voters at an election to be held November 7, 2017. |
|---|
| 44 | 44 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 45 | 45 | | proposition: "The constitutional amendment requiring the |
|---|
| 46 | 46 | | governor's appointments to state boards, commissions, or other |
|---|
| 47 | 47 | | governing bodies of state agencies to reflect the gender |
|---|
| 48 | 48 | | composition of this state." |
