55 A JOINT RESOLUTION
66 proposing a constitutional amendment requiring the governor's
77 appointments to state boards, commissions, or other governing
88 bodies of state agencies to reflect the gender composition of this
99 state.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article IV, Texas Constitution, is amended by
1212 adding Section 12A to read as follows:
1313 Sec. 12A. In making any appointment to a state board,
1414 commission, or other governing body of a state agency, the Governor
1515 shall, to the extent possible, ensure that the gender composition
1616 of the board, commission, or governing body reflects the gender
1717 composition of this state.
1818 SECTION 2. The following temporary provision is added to
1919 the Texas Constitution:
2020 TEMPORARY PROVISION. (a) This temporary provision applies to
2121 the constitutional amendment proposed by the 85th Legislature,
2222 Regular Session, 2017, requiring the governor's appointments to
2323 state boards, commissions, or other governing bodies of state
2424 agencies to reflect the gender composition of this state.
2525 (b) The adoption of the amendment does not affect the
2626 entitlement of a member serving on a state board, commission, or
2727 other governing body of a state agency to continue to carry out the
2828 functions of the board, commission, or governing body for the
2929 remainder of the member's term. Except as otherwise provided by
3030 this subsection, as the terms of the members of the board,
3131 commission, or governing body expire or as a vacancy occurs, the
3232 governor shall appoint members to the board, commission, or
3333 governing body to achieve, as soon as possible, the gender
3434 composition prescribed for the board, commission, or governing body
3535 by this amendment. This subsection does not prohibit a person who is
3636 a member of a state board, commission, or other governing body of a
3737 state agency from being reappointed to the board, commission, or
3838 governing body as provided by law notwithstanding the effect of
3939 that person's reappointment on the gender composition of the board,
4040 commission, or governing body.
4141 (c) This temporary provision expires January 1, 2024.
4242 SECTION 3. This proposed constitutional amendment shall be
4343 submitted to the voters at an election to be held November 7, 2017.
4444 The ballot shall be printed to provide for voting for or against the
4545 proposition: "The constitutional amendment requiring the
4646 governor's appointments to state boards, commissions, or other
4747 governing bodies of state agencies to reflect the gender
4848 composition of this state."
