55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the legislature
77 to provide for an exemption from ad valorem taxation of certain
88 property owned by or leased to or by a university research
99 technology corporation.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article VIII, Texas Constitution, is amended by
1212 adding Section 1-t to read as follows:
1313 Sec. 1-t. (a) In this section, "university research
1414 technology corporation" means a special-purpose corporation
1515 created to develop and commercialize technologies that are owned
1616 wholly or partly by a public or private institution of higher
1717 education in this state or by a nonprofit medical center
1818 development corporation with members that are institutions of
1919 higher education in this state.
2020 (b) The legislature by general law may exempt from ad
2121 valorem taxation:
2222 (1) the ownership interest of a university research
2323 technology corporation in real and tangible personal property;
2424 (2) the ownership interest of a nonprofit medical
2525 center development corporation in real and tangible personal
2626 property leased to or used or occupied primarily by a university
2727 research technology corporation; or
2828 (3) the leasehold interest of a university research
2929 technology corporation in real and tangible personal property
3030 leased from a nonprofit medical center development corporation.
3131 (c) The legislature may impose eligibility requirements for
3232 an exemption authorized by this section.
3333 SECTION 2. This proposed constitutional amendment shall be
3434 submitted to the voters at an election to be held November 7, 2017.
3535 The ballot shall be printed to permit voting for or against the
3636 proposition: "The constitutional amendment authorizing the
3737 legislature to provide for an exemption from ad valorem taxation of
3838 certain property owned by or leased to or by a university research
3939 technology corporation."
