132132 applicable standards imposed by this section, other provisions of
133133 this constitution, and laws enacted under this section but is not
134134 limited to modifications necessary to correct legal deficiencies.
135135 (m) In a redistricting plan or modification of a plan
136136 adopted under this section, the commission shall consider the
137137 following criteria, giving priority to each criterion in the order
138138 listed:
139139 (1) districts must be drawn in accordance with the
140140 federal constitution and all applicable federal laws, including the
141141 federal Voting Rights Act of 1965 (52 U.S.C. Section 10101 et seq.);
142142 (2) in addition to the requirements of federal law,
143143 districts must be drawn in a manner that does not discriminate on
144144 the basis of race, color, or membership in a language minority group
145145 by ensuring the voting strength of racial, ethnic, and language
146146 minorities in the districts is not diluted in a manner that deprives
147147 minority voters of an equal opportunity to elect a candidate of
148148 their choice;
149149 (3) each district must be composed of contiguous
150150 territory, and for purposes of this subdivision territory that is
151151 adjoining only at a point is not considered contiguous;
152152 (4) to the extent reasonable, district boundaries may
153153 not divide a community of interest other than a community based on a
154154 relationship with a political party or candidate for public office;
155155 (5) to the extent reasonable, district boundaries must
156156 coincide with the boundaries of political subdivisions of the state
157157 and divide the smallest number of counties, municipalities, and
158158 school districts possible;
159159 (6) each congressional district must contain a
160160 population as nearly equal as possible to the population of any
161161 other district in the plan; and
162162 (7) in a redistricting plan for the Texas Senate or
163163 Texas House of Representatives the overall range of population
164164 deviation from the district with the largest population to the
165165 district with the smallest population may not exceed 2.5 percent.
166166 (n) If a political subdivision must be divided, the
167167 commission shall give preference to dividing a more populous
168168 political subdivision before a less populous one. This subsection
169169 does not apply to a boundary drawn along a county line that divides
170170 a municipality.
171171 (o) The commission may not draw a redistricting plan
172172 purposely to favor or discriminate against a political party or any
173173 other group.
174174 (p) The commission shall provide a process by which the
175175 public may comment on a proposed redistricting plan or proposed
176176 modification of a plan. The commission shall consider those
177177 comments in the adoption or modification of a redistricting plan.
178178 (q) For a reasonable period before the commission considers
179179 a redistricting plan, including a modification of a redistricting
180180 plan, the commission shall make available to the public:
181181 (1) a report that identifies for each district in the
182182 plan:
183183 (A) boundaries;
184184 (B) population;
185185 (C) racial and ethnic composition;
186186 (D) compactness measure;
187187 (E) divided governmental units; and
188188 (F) political performance indexes; and
189189 (2) the total number of:
190190 (A) governmental units of each type that are
191191 divided;
192192 (B) politically balanced districts; and
193193 (C) districts anticipated to lean toward each
194194 political party.
195195 (r) The legislature shall enact laws consistent with this
196196 section to implement this section. The laws may include additional
197197 qualifications for commission members and additional standards
198198 applicable to redistricting plans.
199199 (s) The legislature shall appropriate money or otherwise
200200 provide the commission sufficient facilities and personnel to
201201 enable the commission to carry out its duties.
202202 (t) This section takes effect January 1, 2021. On that
203203 date, the Legislative Redistricting Board is abolished and Section

207207 SECTION 2. Section 7a, Article V, Texas Constitution, is
208208 amended by amending Subsections (e) and (i) and adding Subsection
209209 (j) to read as follows:
210210 (e) Unless the legislature enacts a statewide
211211 reapportionment of the judicial districts following each federal
212212 decennial census, the board shall convene not later than the first
213213 Monday of June of the third year following the year in which the
214214 federal decennial census is taken to make a statewide
215215 reapportionment of the districts. The board shall complete its
216216 work on the reapportionment and file its order with the secretary of
217217 state not later than August 31 of the same year. If the Judicial
218218 Districts Board fails to make a statewide apportionment by that
219219 date, the Texas [Legislative] Redistricting Commission [Board]
220220 established by Article III, Section 28a [28], of this constitution
221221 shall convene on September 1 of the same year to make a statewide
222222 reapportionment of the judicial districts not later than the 90th
223223 [150th] day after the final day for the Judicial Districts Board to
224224 make the reapportionment.
225225 (i) The legislature, the Judicial Districts Board, or the
226226 Texas [Legislative] Redistricting Commission [Board] may not
227227 redistrict the judicial districts to provide for any judicial
228228 district smaller in size than an entire county except as provided by
229229 this section. Judicial districts smaller in size than the entire
230230 county may be created subsequent to a general election where a
231231 majority of the persons voting on the proposition adopt the
232232 proposition "to allow the division of ____________ County into
233233 judicial districts composed of parts of ____________ County." No
234234 redistricting plan may be proposed or adopted by the legislature,
235235 the Judicial Districts Board, or the Texas [Legislative]
236236 Redistricting Commission [Board] in anticipation of a future action
237237 by the voters of any county.
238238 (j) Until January 1, 2021, a reference in this section to
239239 the Texas Redistricting Commission means the Legislative
240240 Redistricting Board established under Article III, Section 28, of
241241 this constitution. This subsection expires January 1, 2021.
242242 SECTION 3. This proposed constitutional amendment shall be
243243 submitted to the voters at an election to be held November 7, 2017.
244244 The ballot shall be printed to permit voting for or against the
245245 following proposition: "The constitutional amendment establishing
246246 the Texas Redistricting Commission to redistrict the Texas
247247 Legislature and Texas congressional districts and revising
248248 procedures for redistricting."
