55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the legislature
77 to permit one or more political subdivisions of this state to exempt
88 from ad valorem taxation a person's inventory held for sale at
99 retail.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1(d), Article VIII, Texas Constitution,
1212 is amended to read as follows:
1313 (d) The Legislature by general law shall exempt from ad
1414 valorem taxation household goods not held or used for the
1515 production of income and personal effects not held or used for the
1616 production of income. The Legislature by general law may exempt
1717 from ad valorem taxation:
1818 (1) all or part of the personal property homestead of a
1919 family or single adult, "personal property homestead" meaning that
2020 personal property exempt by law from forced sale for debt;
2121 (2) subject to Subsections (e) and (g) of this section
2222 and except as provided by Section 1-u of this article, all other
2323 tangible personal property, except structures which are
2424 substantially affixed to real estate and are used or occupied as
2525 residential dwellings and except property held or used for the
2626 production of income;
2727 (3) subject to Subsection (e) of this section, a
2828 leased motor vehicle that is not held primarily for the production
2929 of income by the lessee and that otherwise qualifies under general
3030 law for exemption; and
3131 (4) one motor vehicle, as defined by general law,
3232 owned by an individual that is used in the course of the
3333 individual's occupation or profession and is also used for personal
3434 activities of the owner that do not involve the production of
3535 income.
3636 SECTION 2. Article VIII, Texas Constitution, is amended by
3737 adding Section 1-u to read as follows:
3838 Sec. 1-u. The legislature by general law may authorize the
3939 governing body of one or more political subdivisions of this state
4040 to exempt from ad valorem taxation a person's inventory held for
4141 sale at retail, as defined by general law.
4242 SECTION 3. This proposed constitutional amendment shall be
4343 submitted to the voters at an election to be held November 7, 2017.
4444 The ballot shall be printed to permit voting for or against the
4545 proposition: "The constitutional amendment authorizing the
4646 legislature to permit one or more political subdivisions of this
4747 state to exempt from ad valorem taxation a person's inventory held
4848 for sale at retail."
