55 R E S O L U T I O N
66 WHEREAS, Cannabidiol and cannabidiol-rich plants (CRP) are
77 recognized as important components in treatment for countless
88 patients; however, these substances have been banned at the federal
99 level by the Controlled Substances Act because they are included
1010 under the definition of "marijuana"; and
1111 WHEREAS, Cannabidiol is a substance derived from Cannabis
1212 sativa L., a CRP with a tetrahydrocannabinol (THC) concentration of
1313 not more than 0.3 percent on a dry weight basis; and
1414 WHEREAS, During the 84th Texas Legislature, Senate Bill 339,
1515 which allowed physicians to prescribe low-THC cannabis to patients
1616 diagnosed with intractable epilepsy, was signed into law by
1717 Governor Greg Abbott, who at the time emphasized that low-THC
1818 cannabis does not produce the high associated with smoking
1919 marijuana and that permitting the substance should not be viewed as
2020 a precursor to a broader legalization of marijuana; the bill,
2121 commonly known as the "Texas Compassionate Use Act," noted that the
2222 administration of cannabidiol by means other than smoking has been
2323 the only successful treatment of seizures for many patients with
2424 epilepsy; and
2525 WHEREAS, While marijuana is prohibited under the Controlled
2626 Substances Act, evidence suggests that using an extract of
2727 cannabidiol from CRPs is a remarkably safe option in providing
2828 relief for individuals afflicted by seizures caused by epilepsy;
2929 now, therefore, be it
3030 RESOLVED, That the House of Representatives of the 85th Texas
3131 Legislature hereby respectfully urge the United States Congress to
3232 amend the Controlled Substances Act to exclude cannabidiol and
3333 cannabidiol-rich plants from the definition of "marijuana"; and,
3434 be it further
3535 RESOLVED, That the chief clerk of the house forward official
3636 copies of this resolution to the president of the United States, to
3737 the president of the Senate and the speaker of the House of
3838 Representatives of the United States Congress, and to all the
3939 members of the Texas delegation to Congress with the request that
4040 this resolution be entered in the Congressional Record as a
4141 memorial to the Congress of the United States of America.
