| 8 | 9 | | Section 9(f), to enable the conference committee appointed to |

| 9 | 10 | | resolve the differences on Senate Bill 1289 (the purchase of iron |
|---|
| 10 | 11 | | and steel products made in the United States for certain |
|---|
| 11 | 12 | | governmental entity projects) to consider and take action on the |
|---|
| 12 | 13 | | following matters: |
|---|
| 13 | 14 | | (1) House Rule 13, Section 9(a)(4), is suspended to permit |
|---|
| 14 | 15 | | the committee to add text on a matter not included in either the |
|---|
| 15 | 16 | | house or senate version of the bill by adding, in SECTION 1 of the |
|---|
| 16 | 17 | | bill, the following: |
|---|
| 17 | 18 | | Sec. 2252.2025. REPORT. (a) Not later than December 1, |
|---|
| 18 | 19 | | 2018, the Texas Water Development Board shall electronically submit |
|---|
| 19 | 20 | | to the state auditor a report on all contracts for construction of a |
|---|
| 20 | 21 | | project that received financial assistance under Chapter 15, 16, or |
|---|
| 21 | 22 | | 17, Water Code, during the state fiscal year ending August 31, 2017. |

| 22 | 23 | | The report must include: |
|---|
| 23 | 24 | | (1) the impacts on a political subdivision that has |
|---|
| 24 | 25 | | obtained or applied for financial assistance from the board under |
|---|
| 25 | 26 | | Chapter 15, 16, or 17, Water Code; and |
|---|
| 26 | 27 | | (2) for each project that has obtained financial |
|---|
| 27 | 28 | | assistance as described by this subsection: |
|---|
| 28 | 29 | | (A) the country of origin of the iron and steel |
|---|
| 29 | 30 | | products used in the project, in accordance with 19 U.S.C. Section |
|---|
| 30 | 31 | | 1304; |
|---|
| 31 | 32 | | (B) the cost and quantity of all iron and steel |
|---|
| 32 | 33 | | products received from each country of origin for the project; and |
|---|
| 33 | 34 | | (C) any related bond information, including the |
|---|
| 34 | 35 | | credit rating of general obligation bonds or revenue bonds issued |
|---|
| 35 | 36 | | by the board to finance or refinance projects included in the state |
|---|
| 36 | 37 | | water plan and the potential impact to that credit rating as a |
|---|
| 37 | 38 | | result of the bond issuance by the board. |

| 38 | 39 | | (b) The state auditor shall prepare a summary on the report |
|---|
| 39 | 40 | | submitted under Subsection (a) and electronically submit the |
|---|
| 40 | 41 | | summary to the legislature not later than January 1, 2019. |
|---|
| 41 | 42 | | (c) This section expires September 1, 2019. |
|---|
| 42 | 43 | | Explanation: The change is necessary to require the Texas |
|---|
| 43 | 44 | | Water Development Board to electronically submit to the state |
|---|
| 44 | 45 | | auditor a report on all contracts for construction of projects that |
|---|
| 45 | 46 | | received financial assistance from the board under Chapter 15, 16, |
|---|
| 46 | 47 | | or 17, Water Code, during the state fiscal year ending August 31, |

| 49 | 50 | | (2) House Rule 13, Section 9(a)(1), is suspended to permit |

| 50 | 51 | | the committee to amend text not in disagreement in proposed SECTION |

| 51 | 52 | | 6(b) of the bill, in the transition provisions of the bill, to read |
|---|
| 52 | 53 | | as follows: |

| 53 | 54 | | (b) Subchapter F, Chapter 2252, Government Code, as added by |
|---|
| 54 | 55 | | this Act, does not apply to a project as described by Section 15.432 |
|---|
| 55 | 56 | | or 15.472, Water Code, that the Texas Water Development Board has |
|---|
| 56 | 57 | | formally approved for financial assistance. In this subsection, |
|---|
| 57 | 58 | | the term "formally approved" means any project that is the subject |
|---|
| 58 | 59 | | of a resolution approving an application for financial assistance |
|---|
| 59 | 60 | | adopted by the Texas Water Development Board before May 1, 2019, for |
|---|
| 60 | 61 | | any portion of the financing of the project. |
|---|
| 61 | 62 | | Explanation: The change is necessary to extend the time |
|---|
| 62 | 63 | | before certain contracts are subject to Subchapter F, Chapter 2252, |
|---|
| 63 | 64 | | Government Code, as added by the Act, to allow the Texas Water |
|---|
| 64 | 65 | | Development Board to submit the report and the state auditor to |
|---|
| 65 | 66 | | submit the summary required by Section 2252.2025, Government Code, |
