45 R E S O L U T I O N
56 BE IT RESOLVED by the House of Representatives of the State of
67 Texas, 85th Legislature, Regular Session, 2017, That House Rule 13,
78 Section 9(a), be suspended in part as provided by House Rule 13,
89 Section 9(f), to enable the conference committee appointed to
910 resolve the differences on Senate Bill 1289 (the purchase of iron
1011 and steel products made in the United States for certain
1112 governmental entity projects) to consider and take action on the
1213 following matters:
1314 (1) House Rule 13, Section 9(a)(4), is suspended to permit
1415 the committee to add text on a matter not included in either the
1516 house or senate version of the bill by adding, in SECTION 1 of the
1617 bill, the following:
1718 Sec. 2252.2025. REPORT. (a) Not later than December 1,
1819 2018, the Texas Water Development Board shall electronically submit
1920 to the state auditor a report on all contracts for construction of a
2021 project that received financial assistance under Chapter 15, 16, or
2122 17, Water Code, during the state fiscal year ending August 31, 2017.
2223 The report must include:
2324 (1) the impacts on a political subdivision that has
2425 obtained or applied for financial assistance from the board under
2526 Chapter 15, 16, or 17, Water Code; and
2627 (2) for each project that has obtained financial
2728 assistance as described by this subsection:
2829 (A) the country of origin of the iron and steel
2930 products used in the project, in accordance with 19 U.S.C. Section
3031 1304;
3132 (B) the cost and quantity of all iron and steel
3233 products received from each country of origin for the project; and
3334 (C) any related bond information, including the
3435 credit rating of general obligation bonds or revenue bonds issued
3536 by the board to finance or refinance projects included in the state
3637 water plan and the potential impact to that credit rating as a
3738 result of the bond issuance by the board.
3839 (b) The state auditor shall prepare a summary on the report
3940 submitted under Subsection (a) and electronically submit the
4041 summary to the legislature not later than January 1, 2019.
4142 (c) This section expires September 1, 2019.
4243 Explanation: The change is necessary to require the Texas
4344 Water Development Board to electronically submit to the state
4445 auditor a report on all contracts for construction of projects that
4546 received financial assistance from the board under Chapter 15, 16,
4647 or 17, Water Code, during the state fiscal year ending August 31,
4748 2017, and to require the state auditor to submit to the legislature
4849 a summary of that report.
4950 (2) House Rule 13, Section 9(a)(1), is suspended to permit
5051 the committee to amend text not in disagreement in proposed SECTION
5152 6(b) of the bill, in the transition provisions of the bill, to read
5253 as follows:
5354 (b) Subchapter F, Chapter 2252, Government Code, as added by
5455 this Act, does not apply to a project as described by Section 15.432
5556 or 15.472, Water Code, that the Texas Water Development Board has
5657 formally approved for financial assistance. In this subsection,
5758 the term "formally approved" means any project that is the subject
5859 of a resolution approving an application for financial assistance
5960 adopted by the Texas Water Development Board before May 1, 2019, for
6061 any portion of the financing of the project.
6162 Explanation: The change is necessary to extend the time
6263 before certain contracts are subject to Subchapter F, Chapter 2252,
6364 Government Code, as added by the Act, to allow the Texas Water
6465 Development Board to submit the report and the state auditor to
6566 submit the summary required by Section 2252.2025, Government Code,
6667 as added by the Act.
