| 8 | 8 | | students placed in residential facilities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 29.012, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (f) to read as follows: |
|---|
| 12 | 12 | | (f) A residential facility shall provide to a school |
|---|
| 13 | 13 | | district or open-enrollment charter school that provides |
|---|
| 14 | 14 | | educational services to a student placed in the facility any |
|---|
| 15 | 15 | | information retained by the facility relating to the student's: |
|---|
| 16 | 16 | | (1) school records; |
|---|
| 17 | 17 | | (2) behavioral history; and |
|---|
| 18 | 18 | | (3) record of arrests or indictments or other formal |
|---|
| 19 | 19 | | charges and the disposition of those arrests, indictments, or |
|---|
| 20 | 20 | | charges. |

| 21 | 21 | | SECTION 2. Section 221.056, Human Resources Code, is |
|---|
| 22 | 22 | | amended by adding Subsection (e) to read as follows: |
|---|
| 23 | 23 | | (e) A residential treatment facility established under this |
|---|
| 24 | 24 | | section shall provide to an open-enrollment charter school that |
|---|
| 25 | 25 | | provides educational services to a student placed in the facility |
|---|
| 26 | 26 | | any information retained by the facility relating to the student's: |
|---|
| 27 | 27 | | (1) school records; |
|---|
| 28 | 28 | | (2) behavioral history; and |
|---|
| 29 | 29 | | (3) record of arrests or indictments or other formal |
|---|
| 30 | 30 | | charges and the disposition of those arrests, indictments, or |
|---|
| 31 | 31 | | charges. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2017. |
