55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the disclosure to public schools of certain records of
88 students placed in residential facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 29.012, Education Code, is amended by
1111 adding Subsection (f) to read as follows:
1212 (f) A residential facility shall provide to a school
1313 district or open-enrollment charter school that provides
1414 educational services to a student placed in the facility any
1515 information retained by the facility relating to the student's:
1616 (1) school records;
1717 (2) behavioral history; and
1818 (3) record of arrests or indictments or other formal
1919 charges and the disposition of those arrests, indictments, or
2020 charges.
2121 SECTION 2. Section 221.056, Human Resources Code, is
2222 amended by adding Subsection (e) to read as follows:
2323 (e) A residential treatment facility established under this
2424 section shall provide to an open-enrollment charter school that
2525 provides educational services to a student placed in the facility
2626 any information retained by the facility relating to the student's:
2727 (1) school records;
2828 (2) behavioral history; and
2929 (3) record of arrests or indictments or other formal
3030 charges and the disposition of those arrests, indictments, or
3131 charges.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2017.
