66 AN ACT
77 relating to commissioned security officers employed by the board of
88 trustees of a school district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.081(a), Education Code, is amended to
1111 read as follows:
1212 (a) The board of trustees of any school district may employ
1313 security personnel and may commission peace officers to carry out
1414 this subchapter. If a board of trustees authorizes a person
1515 employed as security personnel to carry a weapon, the person must be
1616 a commissioned peace officer or a commissioned security officer as
1717 defined by Section 1702.002, Occupations Code. The jurisdiction of
1818 a peace officer or security personnel under this section shall be
1919 determined by the board of trustees and may include all territory in
2020 the boundaries of the school district and all property outside the
2121 boundaries of the district that is owned, leased, or rented by or
2222 otherwise under the control of the school district and the board of
2323 trustees that employ the peace officer or security personnel.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2017.
