55 AN ACT
66 relating to the transfer of the licensing and regulation of certain
77 counseling professions to the Texas Department of Licensing and
88 Regulation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 502.002, Occupations Code, is amended by
1111 amending Subdivisions (2), (3), and (5) and adding Subdivision
1212 (3-a) to read as follows:
1313 (2) "Commission" ["Commissioner"] means the Texas
1414 Commission of Licensing and Regulation [commissioner of state
1515 health services].
1616 (3) "Department" means the Texas Department of
1717 Licensing and Regulation [Department of State Health Services].
1818 (3-a) "Executive director" means the executive
1919 director of the department.
2020 (5) "Licensed marriage and family therapist
2121 associate" means an individual who offers to provide marriage and
2222 family therapy for compensation under the supervision of a
2323 commission-approved [board-approved] supervisor.
2424 SECTION 2. The heading to Subchapter D, Chapter 502,
2525 Occupations Code, is amended to read as follows:
2626 SUBCHAPTER D. [BOARD] POWERS AND DUTIES
2727 SECTION 3. Section 502.151, Occupations Code, is amended to
2828 read as follows:
2929 Sec. 502.151. GENERAL POWERS AND DUTIES [OF BOARD]. (a)
3030 The executive director shall administer and enforce this chapter.
3131 (b) The commission [board] shall:
3232 (1) determine the qualifications and fitness of a
3333 license applicant under this chapter; and
3434 (2) adopt a code of professional ethics for license
3535 holders.
3636 SECTION 4. Section 502.157, Occupations Code, is amended to
3737 read as follows:
3838 Sec. 502.157. ANNUAL REGISTRY. (a) The department [board]
3939 shall annually prepare a registry of all license holders.
4040 (b) The department [board] shall make the registry
4141 available to the public, license holders, and other state agencies.
4242 SECTION 5. Section 502.159, Occupations Code, is amended to
4343 read as follows:
4444 Sec. 502.159. EX PARTE COMMUNICATION PROHIBITED. A
4545 commission [board] member or department employee [who performs
4646 functions for the board and] who is assigned to make a decision, a
4747 finding of fact, or a conclusion of law in a proceeding pending
4848 before the commission [board] may not directly or indirectly
4949 communicate with a party to the proceeding or the party's
5050 representative unless notice and an opportunity to participate are
5151 given to each party to the proceeding.
5252 SECTION 6. Section 502.252, Occupations Code, is amended to
5353 read as follows:
5454 Sec. 502.252. LICENSE APPLICATION. (a) An applicant for a
5555 license must:
5656 (1) file a written application in the manner and [with
5757 the board] on a form prescribed by the executive director [board];
5858 and
5959 (2) pay the appropriate application fee.
6060 (b) To qualify for a license as a licensed marriage and
6161 family therapist associate, a person must:
6262 (1) be at least 18 years of age;
6363 (2) have completed a graduate internship in marriage
6464 and family therapy, or an equivalent internship, as approved by the
6565 commission [board];
6666 (3) pass the license examination and jurisprudence
6767 examination determined by the commission [board];
6868 (4) hold a master's or doctoral degree in marriage and
6969 family therapy or in a related mental health field with coursework
7070 and training determined by the commission [board] to be
7171 substantially equivalent to a graduate degree in marriage and
7272 family therapy from a regionally accredited institution of higher
7373 education or an institution of higher education approved by the
7474 commission [board];
7575 (5) be of good moral character;
7676 (6) have not been convicted of a felony or a crime
7777 involving moral turpitude;
7878 (7) not use drugs or alcohol to an extent that affects
7979 the applicant's professional competency;
8080 (8) not have had a license or certification revoked by
8181 a licensing agency or by a certifying professional organization;
8282 and
8383 (9) not have engaged in fraud or deceit in applying for
8484 a license under this chapter.
8585 (c) An applicant is eligible to apply for a license as a
8686 licensed marriage and family therapist if the person:
8787 (1) meets the requirements of Subsection (b);
8888 (2) after receipt of a degree described by Subsection
8989 (b)(4), has completed two years of work experience in marriage and
9090 family therapist services that includes at least 3,000 hours of
9191 clinical practice of which:
9292 (A) at least 1,500 hours consist of direct
9393 clinical services; and
9494 (B) at least 750 hours consist of direct clinical
9595 services to couples or families; and
9696 (3) has completed, in a manner acceptable to the
9797 commission [board], at least 200 hours of supervised provision of
9898 direct clinical services by the applicant, 100 hours of which must
9999 be supervised on an individual basis.
100100 SECTION 7. Sections 502.253(a), (b), and (c), Occupations
101101 Code, are amended to read as follows:
102102 (a) The department [board] shall investigate each
103103 application and any other information submitted by the applicant.
104104 (b) Not later than the 90th day after the date the
105105 department [board] receives the completed application from a person
106106 seeking a license as a licensed marriage and family therapist
107107 associate, the department [board] shall notify the applicant
108108 whether the application has been accepted or rejected.
109109 (c) An applicant for a license as a licensed marriage and
110110 family therapist associate is eligible to take the examination if
111111 the applicant:
112112 (1) is enrolled in a graduate internship described by
113113 Section 502.252(b)(2) and provides proof to the department [board]
114114 that the applicant is a student in good standing in an educational
115115 program described by Section 502.252(b)(4); or
116116 (2) has completed the internship described by
117117 Subdivision (1).
118118 SECTION 8. Sections 502.254(b) and (d), Occupations Code,
119119 are amended to read as follows:
120120 (b) An applicant for a license as a licensed marriage and
121121 family therapist associate under Section 502.252(b) must:
122122 (1) file an application in the manner and on a form
123123 prescribed by the executive director [board] not later than the
124124 90th day before the date of the examination; and
125125 (2) pay the examination fee [set by the executive
126126 commissioner of the Health and Human Services Commission by rule].
127127 (d) The department [board] shall have any written portion of
128128 an examination validated by an independent testing professional.
129129 SECTION 9. Section 502.2541, Occupations Code, is amended
130130 to read as follows:
131131 Sec. 502.2541. JURISPRUDENCE EXAMINATION. (a) The
132132 department [board] shall develop and administer at least twice each
133133 calendar year a jurisprudence examination to determine an
134134 applicant's knowledge of this chapter, [board] rules adopted under
135135 this chapter, and any other applicable laws of this state affecting
136136 the applicant's practice of marriage and family therapy.
137137 (b) The commission [board] shall adopt rules to implement
138138 this section, including rules related to the development and
139139 administration of the examination, examination fees, guidelines
140140 for reexamination, grading the examination, and providing notice of
141141 examination results.
142142 SECTION 10. Section 502.2545, Occupations Code, is amended
143143 to read as follows:
144144 Sec. 502.2545. WAIVER OF EXAMINATION FOR CERTAIN
145145 APPLICANTS. (a) The department [board] may waive the requirement
146146 that an applicant for a license as a licensed marriage and family
147147 therapist pass the examination required by Section 502.254 if the
148148 applicant:
149149 (1) is a provisional license holder under Section
150150 502.259 and the department [board] determines that the applicant
151151 possesses sufficient education and professional experience to
152152 receive a license without further examination; or
153153 (2) holds a license issued by another licensing agency
154154 in a profession related to the practice of marriage and family
155155 therapy and the department [board] determines that the applicant
156156 possesses sufficient education and professional experience to
157157 receive a license without satisfying the examination requirements
158158 of this chapter.
159159 (b) The commission [board] may adopt rules necessary to
160160 administer this section, including rules under Subsection (a)(2)
161161 prescribing the professions that are related to the practice of
162162 marriage and family therapy.
163163 SECTION 11. Section 502.256(b), Occupations Code, is
164164 amended to read as follows:
165165 (b) If an applicant fails the examination two or more times,
166166 the department [board] may require the applicant to:
167167 (1) complete additional courses of study designated by
168168 the department [board]; and
169169 (2) present satisfactory evidence of completion of the
170170 required courses.
171171 SECTION 12. Section 502.257, Occupations Code, is amended
172172 to read as follows:
173173 Sec. 502.257. ISSUANCE OF LICENSE. The department [board]
174174 shall issue a license as a licensed marriage and family therapist
175175 associate or licensed marriage and family therapist, as
176176 appropriate, to an applicant who:
177177 (1) complies with the requirements of this chapter;
178178 (2) passes the licensing examination, unless the
179179 department [board] exempts the person from the examination
180180 requirement; and
181181 (3) pays the required fees.
182182 SECTION 13. Section 502.259, Occupations Code, is amended
183183 to read as follows:
184184 Sec. 502.259. PROVISIONAL LICENSE. (a) The department
185185 [board] may grant a provisional license to practice as a marriage
186186 and family therapist in this state without examination to an
187187 applicant who is licensed or otherwise registered as a marriage and
188188 family therapist by another state or jurisdiction if the
189189 requirements to be licensed or registered in the other state or
190190 jurisdiction were, on the date the person was licensed or
191191 registered, substantially equal to the requirements of this
192192 chapter.
193193 (b) An applicant for a provisional license must:
194194 (1) be licensed in good standing as a marriage and
195195 family therapist in another state or jurisdiction that has
196196 licensing requirements that are substantially equal to the
197197 requirements of this chapter;
198198 (2) have passed a national or other examination that:
199199 (A) is recognized by the commission [board]; and
200200 (B) relates to marriage and family therapy; and
201201 (3) be sponsored by a person licensed under this
202202 chapter [by the board] with whom the provisional license holder may
203203 practice under this section.
204204 (c) An applicant may be excused from the requirement of
205205 Subsection (b)(3) if the department [board] determines that
206206 compliance with that subsection constitutes a hardship to the
207207 applicant.
208208 (d) A provisional license is valid until the date the
209209 department [board] approves or denies the provisional license
210210 holder's application for a license under Section 502.257. The
211211 department [board] shall complete processing of a provisional
212212 license holder's application for a license not later than the 180th
213213 day after the date the provisional license is issued. The
214214 department [board] may extend this period to allow for the receipt
215215 and tabulation of pending examination results.
216216 (e) The department [board] shall issue a license under
217217 Section 502.257 to a provisional license holder if:
218218 (1) the provisional license holder passes the
219219 examination required by Section 502.254;
220220 (2) the department [board] verifies that the
221221 provisional license holder satisfies the academic and experience
222222 requirements of this chapter; and
223223 (3) the provisional license holder satisfies any other
224224 license requirements under this chapter.
225225 SECTION 14. Section 502.261(b), Occupations Code, is
226226 amended to read as follows:
227227 (b) Each license holder shall notify the department [board]
228228 of the license holder's current address.
229229 SECTION 15. Section 502.301(a), Occupations Code, is
230230 amended to read as follows:
231231 (a) A license issued under this chapter is subject to
232232 biennial renewal. [The board shall adopt a system under which
233233 licenses expire on various dates during the year.]
234234 SECTION 16. Section 502.351, Occupations Code, is amended
235235 to read as follows:
236236 Sec. 502.351. GROUNDS FOR DISCIPLINARY ACTIONS. The
237237 commission or executive director [board] shall reprimand a license
238238 holder, place on probation a person whose license has been
239239 suspended, refuse to renew a person's license, or suspend or revoke
240240 a holder's license if the person:
241241 (1) is convicted of a misdemeanor involving moral
242242 turpitude or a felony;
243243 (2) obtains or attempts to obtain a license by fraud or
244244 deception;
245245 (3) uses drugs or alcohol to an extent that affects the
246246 license holder's professional competence;
247247 (4) performs professional duties in a grossly
248248 negligent manner;
249249 (5) is adjudicated as mentally incompetent by a court;
250250 (6) practices in a manner that is detrimental to the
251251 public health or welfare;
252252 (7) advertises in a manner that tends to deceive or
253253 defraud the public;
254254 (8) has a license or certification revoked by a
255255 licensing agency or a certifying professional organization;
256256 (9) violates this chapter or a rule or code of ethics
257257 adopted under this chapter; or
258258 (10) commits an act for which liability exists under
259259 Chapter 81, Civil Practice and Remedies Code.
260260 SECTION 17. Section 502.357, Occupations Code, is amended
261261 to read as follows:
262262 Sec. 502.357. GROUNDS FOR REFUSING RENEWAL. The department
263263 [board] may refuse to renew the license of a person who fails to pay
264264 an administrative penalty imposed under Subchapter F, Chapter 51,
265265 [I] unless enforcement of the penalty is stayed or a court has
266266 ordered that the administrative penalty is not owed.
267267 SECTION 18. Section 502.358, Occupations Code, is amended
268268 to read as follows:
269269 Sec. 502.358. REFUND. (a) Subject to Subsection (b), the
270270 commission or executive director [board] may order a license holder
271271 to pay a refund to a consumer as provided in an agreement resulting
272272 from an informal settlement conference instead of or in addition to
273273 imposing an administrative penalty under this chapter.
274274 (b) The amount of a refund ordered as provided in an
275275 agreement resulting from an informal settlement conference may not
276276 exceed the amount the consumer paid to the license holder for a
277277 service regulated by this chapter. The commission or executive
278278 director [board] may not require payment of other damages or
279279 estimate harm in a refund order.
280280 SECTION 19. Section 502.453, Occupations Code, is amended
281281 to read as follows:
282282 Sec. 502.453. CIVIL PENALTY. (a) A person who violates
283283 this chapter or a rule or order adopted [by the board] under this
284284 chapter is liable for a civil penalty not to exceed $1,000 a day.
285285 (b) At the request of the commission [board] or executive
286286 director [department], the attorney general shall bring an action
287287 to recover a civil penalty authorized under this section.
288288 SECTION 20. Section 503.002, Occupations Code, is amended
289289 by amending Subdivisions (1) and (2) and adding Subdivision (2-a)
290290 to read as follows:
291291 (1) "Commission" ["Board"] means the Texas Commission
292292 of Licensing and Regulation [State Board of Examiners of
293293 Professional Counselors].
294294 (2) "Department" means the Texas Department of
295295 Licensing and Regulation [State Health Services].
296296 (2-a) "Executive director" means the executive
297297 director of the department.
298298 SECTION 21. The heading to Subchapter E, Chapter 503,
299299 Occupations Code, is amended to read as follows:
300300 SUBCHAPTER E. [BOARD] POWERS AND DUTIES
301301 SECTION 22. Section 503.201, Occupations Code, is amended
302302 to read as follows:
303303 Sec. 503.201. GENERAL POWERS AND DUTIES. (a) The executive
304304 director shall administer and enforce this chapter.
305305 (b) The commission [board] shall:
306306 (1) determine the qualifications and fitness of an
307307 applicant for a license, license renewal, or provisional license;
308308 (2) examine for, deny, approve, issue, revoke,
309309 suspend, suspend on an emergency basis, place on probation, and
310310 renew the license of an applicant or license holder under this
311311 chapter;
312312 (3) adopt and publish a code of ethics;
313313 (4) by rule adopt a list of authorized counseling
314314 methods or practices that a license holder may undertake or
315315 perform; and
316316 (5) adopt an official seal.
317317 (c) [(b)] The commission or executive director [board] may
318318 request and shall receive the assistance of a state educational
319319 institution or other state agency.
320320 SECTION 23. Section 503.207, Occupations Code, is amended
321321 to read as follows:
322322 Sec. 503.207. LICENSE HOLDER REGISTRY. (a) Each year the
323323 department [board] shall prepare a registry of persons licensed
324324 under this chapter. The registry must include listings of any
325325 specializations permitted by law or by commission [board] rule.
326326 The registry shall be made available on request to a license holder,
327327 another state agency, or a member of the public.
328328 (b) A person licensed under this chapter shall inform the
329329 department [board] of the person's current address at all times.
330330 SECTION 24. Section 503.208, Occupations Code, is amended
331331 to read as follows:
332332 Sec. 503.208. COMPETENT PERFORMANCE OF PROFESSIONAL
333333 DUTIES. The commission [board] shall identify the key factors for
334334 the competent performance by a license holder of the license
335335 holder's professional duties.
336336 SECTION 25. Section 503.302, Occupations Code, is amended
337337 to read as follows:
338338 Sec. 503.302. QUALIFICATIONS FOR LICENSE. (a) A person
339339 qualifies for a license under this chapter if the person:
340340 (1) is at least 18 years old;
341341 (2) has a master's or doctoral degree in counseling or
342342 a related field;
343343 (3) has successfully completed a graduate degree at a
344344 regionally accredited institution of higher education and the
345345 number of graduate semester hours required by commission [board]
346346 rule, which may not be less than 48 hours and must include 300 clock
347347 hours of supervised practicum that:
348348 (A) is primarily counseling in nature; and
349349 (B) meets the specific academic course content
350350 and training standards established by the commission [board];
351351 (4) has completed the number of supervised experience
352352 hours required by commission [board] rule, which may not be less
353353 than 3,000 hours working in a counseling setting that meets the
354354 requirements established by the commission [board] after the
355355 completion of the graduate program described by Subdivision (3);
356356 (5) [except as provided by Subsection (b),] passes the
357357 license examination and jurisprudence examination required by this
358358 chapter;
359359 (6) submits an application in the manner and on a form
360360 prescribed [as required] by the executive director [board],
361361 accompanied by the required application fee; and
362362 (7) meets any other requirement prescribed by the
363363 commission [board].
364364 (b) [(d)] In establishing the standards described by
365365 Subsection (a)(3)(B), the commission [board] shall review and
366366 consider the standards as developed by the appropriate professional
367367 association.
368368 (c) [(e)] The commission [board] may require the statements
369369 on a license application to be made under oath.
370370 SECTION 26. Section 503.303(b), Occupations Code, is
371371 amended to read as follows:
372372 (b) The department [board] shall accept an individual
373373 course from an art therapy program accredited through the American
374374 Art Therapy Association as satisfying the education requirements
375375 under Section 503.302(a)(3) if at least 75 percent of the course
376376 content is substantially equivalent to the content of a course
377377 required by commission [board] rule.
378378 SECTION 27. Section 503.304, Occupations Code, is amended
379379 to read as follows:
380380 Sec. 503.304. REVIEW OF APPLICATION. (a) Not later than
381381 the 30th day before the examination date, after investigation of a
382382 license application and review of other evidence submitted, the
383383 department [board] shall notify the applicant that the application
384384 and evidence submitted are:
385385 (1) satisfactory and accepted; or
386386 (2) unsatisfactory and rejected.
387387 (b) If the department [board] rejects an application, the
388388 department [board] shall state in the notice the reasons for the
389389 rejection.
390390 SECTION 28. Section 503.305, Occupations Code, is amended
391391 to read as follows:
392392 Sec. 503.305. LICENSE EXAMINATION. (a) The department
393393 [board] shall administer examinations to determine the competence
394394 of qualified applicants at least twice each calendar year.
395395 (b) The department [board] shall contract with a nationally
396396 recognized testing organization to develop and administer a written
397397 professional counselor licensing examination to applicants who
398398 apply for a license under this chapter.
399399 SECTION 29. Section 503.3055, Occupations Code, is amended
400400 to read as follows:
401401 Sec. 503.3055. JURISPRUDENCE EXAMINATION. (a) The
402402 department [board] shall develop and administer at least twice each
403403 calendar year a jurisprudence examination to determine an
404404 applicant's knowledge of this chapter, commission [board] rules,
405405 and any other applicable laws of this state affecting the
406406 applicant's professional counseling practice.
407407 (b) The commission [board] shall adopt rules to implement
408408 this section, including rules related to the development and
409409 administration of the examination, examination fees, guidelines
410410 for reexamination, grading the examination, and providing notice of
411411 examination results.
412412 SECTION 30. Sections 503.310(a), (c), and (d), Occupations
413413 Code, are amended to read as follows:
414414 (a) On application and payment of applicable fees, the
415415 department [board] may issue a provisional license to a person who
416416 holds a license as a counselor or art therapist issued by another
417417 state or by a jurisdiction acceptable to the commission [board].
418418 (c) An applicant is not required to comply with Subsection
419419 (b)(3) if the department [board] determines that compliance with
420420 that subsection is a hardship to the applicant.
421421 (d) A provisional license is valid until the date the
422422 department [board] approves or denies the provisional license
423423 holder's application for a license under Section 503.311.
424424 SECTION 31. Section 503.311, Occupations Code, is amended
425425 to read as follows:
426426 Sec. 503.311. ISSUANCE OF LICENSE TO PROVISIONAL LICENSE
427427 HOLDER. (a) The department [board] shall issue a license to the
428428 holder of a provisional license who applies for a license if:
429429 (1) the department [board] verifies that the applicant
430430 has the academic and experience requirements for a regular license
431431 under this chapter; and
432432 (2) the applicant satisfies any other license
433433 requirements under this chapter.
434434 (b) The department [board] must complete the processing of a
435435 provisional license holder's application for a license not later
436436 than the later of:
437437 (1) the 180th day after the date the provisional
438438 license is issued; or
439439 (2) the date licenses are issued following completion
440440 of the examination.
441441 SECTION 32. Section 503.313, Occupations Code, is amended
442442 to read as follows:
443443 Sec. 503.313. RETIREMENT STATUS. The commission [board] by
444444 rule may adopt a system for placing a person licensed under this
445445 chapter on retirement status.
446446 SECTION 33. Section 503.314(b), Occupations Code, is
447447 amended to read as follows:
448448 (b) A license certificate issued under this chapter [by the
449449 board] is the property of the department [board] and must be
450450 surrendered on demand.
451451 SECTION 34. Section 503.351, Occupations Code, is amended
452452 to read as follows:
453453 Sec. 503.351. RENEWAL; ELIGIBILITY. A person licensed
454454 under this chapter may renew the license biennially if the person:
455455 (1) is not in violation of this chapter when the person
456456 applies for renewal; and
457457 (2) fulfills the continuing education requirements
458458 [established by the board].
459459 SECTION 35. Sections 503.401(a) and (b), Occupations Code,
460460 are amended to read as follows:
461461 (a) A person licensed under this chapter is subject to
462462 disciplinary action under this section if the person:
463463 (1) violates this chapter or a rule or code of ethics
464464 adopted under this chapter [by the board];
465465 (2) commits an act for which the license holder would
466466 be liable under Chapter 81, Civil Practice and Remedies Code;
467467 (3) is legally committed to an institution because of
468468 mental incompetence from any cause; or
469469 (4) directly or indirectly offers to pay or agrees to
470470 accept remuneration to or from any person for securing or
471471 soliciting a patient or patronage.
472472 (b) If a person is subject to disciplinary action under this
473473 section, the commission or executive director [board] shall:
474474 (1) revoke or suspend the person's license, including
475475 a suspension on an emergency basis;
476476 (2) refuse to renew the person's license;
477477 (3) suspend the person's license and place the person
478478 on probation with the license suspension probated; or
479479 (4) reprimand the person.
480480 SECTION 36. Section 503.407, Occupations Code, is amended
481481 to read as follows:
482482 Sec. 503.407. REFUND. (a) Subject to Subsection (b), the
483483 commission or executive director [board] may order a license holder
484484 to pay a refund to a consumer as provided in an agreement resulting
485485 from an informal settlement conference instead of or in addition to
486486 imposing an administrative penalty under this chapter.

493493 SECTION 37. Section 503.453, Occupations Code, is amended
494494 to read as follows:
495495 Sec. 503.453. REPORT OF ALLEGED OFFENSE. The department
496496 [board] shall notify the appropriate prosecuting attorney of an
497497 alleged offense committed under this chapter.
498498 SECTION 38. Section 504.001, Occupations Code, is amended
499499 by amending Subdivisions (5), (7), (8), and (9) to read as follows:
500500 (5) "Commission" ["Commissioner"] means the Texas
501501 Commission of Licensing and Regulation [commissioner of state
502502 health services].
503503 (7) "Department" means the Texas Department of
504504 Licensing and Regulation [State Health Services].
505505 (8) "Executive director [commissioner]" means the
506506 executive director [commissioner] of the department [Health and
507507 Human Services Commission].
508508 (9) "Peer assistance program" means a program approved
509509 by the commission [department] under Section 504.057.
510510 SECTION 39. The heading to Subchapter B, Chapter 504,
511511 Occupations Code, is amended to read as follows:
512512 SUBCHAPTER B. POWERS AND DUTIES [OF EXECUTIVE COMMISSIONER AND
513513 DEPARTMENT]
514514 SECTION 40. Section 504.051, Occupations Code, is amended
515515 to read as follows:
516516 Sec. 504.051. GENERAL POWERS AND DUTIES [OF EXECUTIVE
517517 COMMISSIONER]. (a) The executive director [commissioner] shall
518518 administer and enforce this chapter.
519519 (b) The commission shall establish:
520520 (1) [adopt rules as necessary for the performance of
521521 its duties under this chapter;
522522 [(2) establish] standards of conduct and ethics for
523523 persons licensed under this chapter; and
524524 (2) [(3) establish] any additional criteria for peer
525525 assistance programs for chemical dependency counselors that the
526526 commission [executive commissioner] determines necessary.
527527 SECTION 41. Section 504.052, Occupations Code, is amended
528528 to read as follows:
529529 Sec. 504.052. DISCRIMINATION PROHIBITED. In taking an
530530 action or making a decision under this chapter, the commission,
531531 executive director [commissioner, commissioner], and department
532532 shall do so without regard to the sex, race, religion, national
533533 origin, color, or political affiliation of the person
534534 affected. For purposes of this section, taking an action or making
535535 a decision under this chapter includes:
536536 (1) considering a license application;
537537 (2) conducting an examination;
538538 (3) adopting or enforcing a rule; and
539539 (4) conducting a disciplinary proceeding.
540540 SECTION 42. Section 504.055(d), Occupations Code, is
541541 amended to read as follows:
542542 (d) The department may charge a fee in an amount set by the
543543 commission [executive commissioner] by rule for the roster
544544 published under this section.
545545 SECTION 43. Sections 504.057(a) and (b), Occupations Code,
546546 are amended to read as follows:
547547 (a) The commission [department] shall approve one or more
548548 peer assistance programs established [by the department or a
549549 professional association] in accordance with Chapter 467, Health
550550 and Safety Code, from which persons licensed under this chapter may
551551 seek assistance.
552552 (b) The commission [department] shall approve a peer
553553 assistance program that:
554554 (1) meets the minimum criteria established [by the
555555 executive commissioner or department] under Chapter 467, Health and
556556 Safety Code;
557557 (2) meets any additional criteria established by the
558558 commission [executive commissioner or department] for chemical
559559 dependency counselors licensed under this chapter; and
560560 (3) is designed to assist a chemical dependency
561561 counselor whose ability to perform a professional service is
562562 impaired by abuse of or dependency on drugs or alcohol.
563563 SECTION 44. Section 504.058(a), Occupations Code, is
564564 amended to read as follows:
565565 (a) The department [executive commissioner] shall add a
566566 surcharge of not more than $10 to the license or license renewal fee
567567 for a license under this chapter to fund approved peer assistance
568568 programs for chemical dependency counselors. Money collected from
569569 the surcharge shall be remitted to the comptroller for deposit to
570570 the credit of the chemical dependency counselor account. The
571571 chemical dependency counselor account is an account in the general
572572 revenue fund.
573573 SECTION 45. Section 504.1515(a), Occupations Code, is
574574 amended to read as follows:
575575 (a) A person seeking a license as a chemical dependency
576576 counselor shall register with the department as a counselor intern
577577 by submitting, in the manner prescribed by [a form acceptable to]
578578 the executive director [department], the following:
579579 (1) an application fee and a background investigation
580580 fee;
581581 (2) a completed, signed, dated, and notarized
582582 application on a form prescribed by the executive director
583583 [department];
584584 (3) a recent full-face wallet-sized photograph of the
585585 applicant;
586586 (4) two sets of fingerprints submitted [completed in
587587 accordance with department instructions] on a form prescribed
588588 [cards issued] by the executive director [department];
589589 (5) documentation verifying the applicant
590590 successfully completed:
591591 (A) 270 total hours of approved curricula
592592 described by Section 504.152(a)(3)(A) [504.152(3)(A)]; and
593593 (B) 300 hours of approved supervised field work
594594 practicum described by Section 504.152(a)(3)(C) [504.152(3)(C)];
595595 and
596596 (6) documentation verifying the applicant received a
597597 high school diploma or its equivalent.
598598 SECTION 46. Section 504.152(a), Occupations Code, is
599599 amended to read as follows:
600600 (a) To be eligible for a license under this chapter, a
601601 person must:
602602 (1) be at least 18 years of age;
603603 (2) hold an associate degree or a more advanced
604604 degree;
605605 (3) have completed:
606606 (A) 135 hours, or nine semester hours, specific
607607 to substance abuse disorders and treatment and an additional 135
608608 hours, or nine semester hours, specific or related to chemical
609609 dependency counseling;
610610 (B) 4,000 hours of approved supervised
611611 experience working with chemically dependent persons; and
612612 (C) 300 hours of approved supervised field work
613613 practicum;
614614 (4) provide two letters of reference from chemical
615615 dependency counselors;
616616 (5) pass a written examination approved by the
617617 department;
618618 (6) submit a case presentation to the test
619619 administrator;
620620 (7) be determined by the department to be worthy of the
621621 public trust and confidence;
622622 (8) successfully complete the chemical dependency
623623 counselor examination under Section 504.156;
624624 (9) sign a written agreement to comply with the
625625 standards of ethics approved by the commission [department]; and
626626 (10) provide to the department written assurance that
627627 the applicant has access to a peer assistance program.
628628 SECTION 47. Section 504.1521(b), Occupations Code, is
629629 amended to read as follows:
630630 (b) The commission [executive commissioner] shall adopt
631631 rules necessary to:
632632 (1) register clinical training institutions that meet
633633 the criteria established by the commission [executive
634634 commissioner] to protect the safety and welfare of the people of
635635 this state; and
636636 (2) certify clinical supervisors who hold
637637 certification credentials approved by the commission [department]
638638 or by a person designated by the commission [department], such as
639639 the International Certification and Reciprocity Consortium or
640640 another person that meets the criteria established by the
641641 commission [executive commissioner] to protect the safety and
642642 welfare of the people of this state.
643643 SECTION 48. Sections 504.1525(a) and (b), Occupations Code,
644644 are amended to read as follows:
645645 (a) Except as provided by Subsection (b), the department may
646646 not issue a license, registration, or certification under this
647647 chapter to an applicant who has been:
648648 (1) convicted or placed on community supervision
649649 during the three years preceding the date of application in any
650650 jurisdiction for an offense equal to a Class B misdemeanor
651651 specified by commission [department] rule;
652652 (2) convicted or placed on community supervision in
653653 any jurisdiction for an offense equal to or greater than a Class A
654654 misdemeanor specified by commission [department] rule; or
655655 (3) found to be incapacitated by a court on the basis
656656 of a mental defect or disease.
657657 (b) The department may issue a license, registration, or
658658 certification to a person convicted or placed on community
659659 supervision in any jurisdiction for a drug or alcohol offense
660660 described by Subsection (a)(1) or (2) if the commission or
661661 executive director [department] determines that the applicant has
662662 successfully completed participation in an approved peer
663663 assistance program.
664664 SECTION 49. Sections 504.155(a), (b), and (c), Occupations
665665 Code, are amended to read as follows:
666666 (a) An application for a license under this chapter must:
667667 (1) be submitted in the manner and on a form prescribed
668668 [and furnished] by the executive director [department]; and
669669 (2) contain a statement made under oath of the
670670 applicant's education, experience, and other qualifications
671671 established by the commission [department] as required for a
672672 license under this chapter.
673673 (b) The commission or executive director [department] may
674674 require additional information regarding the quality, scope, and
675675 nature of the experience and competence of the applicant if the
676676 commission or executive director [department] determines that a
677677 person's application lacks sufficient information for
678678 consideration by the department.
679679 (c) The department may obtain criminal history record
680680 information relating to an applicant for a license under this
681681 chapter from the Department of Public Safety and the Federal Bureau
682682 of Investigation. The department may deny an application for a
683683 license if the applicant fails to provide two complete sets of
684684 fingerprints on a form prescribed by the executive director
685685 [department].
686686 SECTION 50. The heading to Section 504.157, Occupations
687687 Code, is amended to read as follows:
688688 Sec. 504.157. [EXAMINATION RESULTS;] REEXAMINATION.
689689 SECTION 51. Section 504.157(d), Occupations Code, is
690690 amended to read as follows:
691691 (d) The commission [executive commissioner] by rule shall
692692 establish the criteria under which an applicant may take a
693693 subsequent examination under Subsection (c).
694694 SECTION 52. Section 504.201(a), Occupations Code, is
695695 amended to read as follows:
696696 (a) A license issued under this chapter expires on the
697697 second anniversary of the date of issuance. [The executive
698698 commissioner by rule shall adopt a system under which licenses
699699 expire on various dates during the year.]
700700 SECTION 53. Section 504.2025(b), Occupations Code, is
701701 amended to read as follows:
702702 (b) The commission or executive director [department] may
703703 renew a license under this chapter if the commission or executive
704704 director [department] determines that the person has successfully
705705 completed participation in an approved peer assistance program
706706 subsequent to the conviction or placement on community supervision
707707 for an offense described by Section 504.1525(b).
708708 SECTION 54. Section 504.2026(b), Occupations Code, is
709709 amended to read as follows:
710710 (b) The commission or executive director [department] may
711711 waive the requirement of Subsection (a) if the commission or
712712 executive director [department] determines that a peer assistance
713713 program is not reasonably available to the license holder.
714714 SECTION 55. Section 504.205(d), Occupations Code, is
715715 amended to read as follows:
716716 (d) Except for the number of hours required, the commission
717717 [executive commissioner] may not adopt a rule [under Subsection
718718 (a)] that distinguishes between the continuing education
719719 requirements for a license holder subject to Subsection (b) and a
720720 license holder subject to Subsection (c).
721721 SECTION 56. Sections 504.206(b) and (d), Occupations Code,
722722 are amended to read as follows:
723723 (b) The commission [department] shall recognize, prepare,
724724 or administer a training component that satisfies the requirement
725725 of Subsection (a) for use in continuing education for chemical
726726 dependency counselors.
727727 (d) In developing the training component, the commission
728728 [department] may, to the extent appropriate, consider the training
729729 course relating to hepatitis C developed by the Department of State
730730 Health Services [department] under Section 94.002, Health and
731731 Safety Code.
732732 SECTION 57. Section 504.251, Occupations Code, is amended
733733 to read as follows:
734734 Sec. 504.251. GROUNDS FOR LICENSE, REGISTRATION, OR
735735 CERTIFICATION DENIAL OR DISCIPLINARY ACTION. The commission or
736736 executive director [department] shall refuse to issue a license,
737737 registration, or certification [issued by the department] to an
738738 applicant, refuse to renew a person's license, registration, or
739739 certification [holder's license, registration, or certification
740740 issued by the department], or take disciplinary action against the
741741 holder of a license, registration, or certification [issued by the
742742 department] if the applicant or license, registration, or
743743 certification holder:
744744 (1) violates or assists another to violate this
745745 chapter or a rule adopted under this chapter;
746746 (2) circumvents or attempts to circumvent this chapter
747747 or a rule adopted under this chapter;
748748 (3) directly or indirectly participates in a plan to
749749 evade this chapter or a rule adopted under this chapter;
750750 (4) has a license to practice chemical dependency
751751 counseling in another jurisdiction refused, suspended, or revoked
752752 for a reason that the commission or executive director [department]
753753 determines would constitute a violation of this chapter or a rule
754754 adopted under this chapter;
755755 (5) engages in false, misleading, or deceptive conduct
756756 as defined by Section 17.46, Business & Commerce Code;
757757 (6) engages in conduct that discredits or tends to
758758 discredit the profession of chemical dependency counseling;
759759 (7) directly or indirectly reveals a confidential
760760 communication made to the person by a client or recipient of
761761 services, except as required by law;
762762 (8) refuses to perform an act or service the person is
763763 licensed, registered, or certified to perform under this chapter on
764764 the basis of the client's or recipient's age, sex, race, religion,
765765 national origin, color, or political affiliation; or
766766 (9) commits an act for which liability exists under
767767 Chapter 81, Civil Practice and Remedies Code.
768768 SECTION 58. Sections 504.255(a) and (c), Occupations Code,
769769 are amended to read as follows:
770770 (a) A person whose license, registration, or certification
771771 application is denied under Section 504.1525, whose license,
772772 registration, or certification renewal is refused under Section
773773 504.2025, or whose license, registration, or certification is
774774 suspended [under Section 504.2525] may appeal the denial, refusal
775775 to renew, or suspension on the grounds that:
776776 (1) the sole basis for the [department's]
777777 determination is a conviction or placement on community supervision
778778 for an offense described by Section 504.1525; and
779779 (2) sufficient time, as determined by commission
780780 [department] rule, has expired since the date of the conviction or
781781 placement.
782782 (c) After a hearing under this section, the commission or
783783 executive director [department] may determine that the person is
784784 entitled to a license, registration, or certification under this
785785 chapter.
786786 SECTION 59. The heading to Subchapter H, Chapter 504,
787787 Occupations Code, is amended to read as follows:
788788 SUBCHAPTER H. CIVIL PENALTY [OTHER PENALTIES AND ENFORCEMENT
789789 PROVISIONS]
790790 SECTION 60. Section 504.351, Occupations Code, is amended
791791 to read as follows:
792792 Sec. 504.351. [INJUNCTIVE RELIEF;] CIVIL PENALTY. A
793793 person who violates [(a) If it appears that a person has violated,
794794 is violating,] or threatens [is threatening] to violate this
795795 chapter or a rule adopted under this chapter is liable for a civil
796796 penalty of [, the department or the attorney general at the request
797797 of the department may institute an action in district court for an
798798 injunction, a civil penalty, or both.
799799 [(b) On application for injunctive relief and a finding that
800800 a person is violating or threatening to violate this chapter or a
801801 rule adopted under this chapter, the district court may grant
802802 injunctive relief as the facts warrant. The department is not
803803 required to give an appeal bond in an appeal of an action seeking
804804 injunctive relief under this section.
805805 [(c) The amount of a civil penalty imposed under this
806806 section may] not [be] less than $50 or more than $500 for each day of
807807 the violation.
808808 SECTION 61. Section 505.002, Occupations Code, is amended
809809 to read as follows:
810810 Sec. 505.002. DEFINITIONS. In this chapter:
811811 (1) "Commission" means the Texas Commission of
812812 Licensing and Regulation.
813813 (2) ["Board" means the Texas State Board of Social
814814 Worker Examiners.
815815 [(3)] "Council on Social Work Education" means the
816816 national organization that is primarily responsible for the
817817 accreditation of schools of social work in the United States or its
818818 successor approved by the commission [board].
819819 (3) [(4)] "Department" means the Texas Department of
820820 Licensing and Regulation [State Health Services].
821821 (4) "Executive director" means the executive director
822822 of the department.
823823 (5) [(4-a)] "Licensed baccalaureate social worker"
824824 means a person who holds a baccalaureate social worker license
825825 issued [by the board] under this chapter.
826826 (6) [(4-b)] "Licensed clinical social worker" means a
827827 person who holds a clinical social worker license issued [by the
828828 board] under this chapter.
829829 (7) [(5)] "Licensed master social worker" means a
830830 person who holds a master social worker license issued [by the
831831 board] under this chapter.
832832 (8) [(6)] "Licensed social worker" means a person who
833833 holds a social worker license issued [by the board] under this
834834 chapter.
835835 (9) "Social worker" means a person who holds any
836836 license issued [by the board] under this chapter.
837837 SECTION 62. Section 505.201, Occupations Code, is amended
838838 to read as follows:
839839 Sec. 505.201. GENERAL RULEMAKING AND ENFORCEMENT
840840 AUTHORITY. (a) The executive director shall administer and
841841 enforce this chapter.
842842 (b) The commission [board] may:
843843 (1) [adopt and enforce rules necessary to perform the
844844 board's duties under this chapter;
845845 [(2)] establish standards of conduct and ethics for
846846 license holders; and
847847 (2) [(3)] ensure strict compliance with and
848848 enforcement of this chapter.
849849 [(b) In adopting rules under this section, the board shall
850850 consider the rules and procedures of the department. The board
851851 shall adopt procedural rules, which may not be inconsistent with
852852 similar rules and procedures of the department.]
853853 (c) The commission [board] by rule may define a term not
854854 defined under Section 505.002 if a definition is necessary to
855855 administer or enforce this chapter.
856856 (d) [(e)] For each type of license issued under this
857857 chapter, the commission [board] shall establish:
858858 (1) the minimum eligibility requirements;
859859 (2) educational requirements;
860860 (3) professional experience criteria;
861861 (4) supervision requirements; and
862862 (5) independent practice criteria.
863863 (e) [(f)] The commission [board] shall establish procedures
864864 for recognition of independent practice.
865865 SECTION 63. Section 505.205, Occupations Code, is amended
866866 to read as follows:
867867 Sec. 505.205. ROSTER OF LICENSE HOLDERS. (a) The
868868 department [board] shall prepare and publish at its discretion a
869869 roster that contains the name and address of each person licensed
870870 under this chapter.
871871 (b) The department [board] shall mail a copy of the roster
872872 to each license holder.
873873 (c) The department [board] may not include in the roster the
874874 name and address of a person who is delinquent in the payment of a
875875 fee required under this chapter on the date the roster is sent for
876876 printing.
877877 SECTION 64. Section 505.206, Occupations Code, is amended
878878 to read as follows:
879879 Sec. 505.206. ROSTER OF INDEPENDENT SOCIAL WORKERS. The
880880 department [board] shall publish a roster of persons recognized
881881 under Section 505.307 as qualified for the independent practice of
882882 social work.
883883 SECTION 65. Section 505.301, Occupations Code, is amended
884884 to read as follows:
885885 Sec. 505.301. ESTABLISHMENT OF SPECIALTY AREA. (a) The
886886 commission [board] may establish within the scope of social work
887887 practice and this chapter specialty areas of social work for
888888 license holders under this chapter who are licensed in good
889889 standing if establishment of the specialty areas:
890890 (1) is necessary to promote the public interest; and
891891 (2) assists the public in identifying qualified
892892 persons in a social work practice specialty.
893893 (b) The commission [board] may not authorize a specialty
894894 area within the practice of social work unless the commission
895895 [board] sets the minimum qualifications for social work practice
896896 with appropriate supervision and examination [, as determined by
897897 the board].
898898 (c) The commission [board] may not establish a specialty
899899 area of social work or a specialty area identification that
900900 conflicts with a state licensing law.
901901 SECTION 66. Section 505.302(a), Occupations Code, is
902902 amended to read as follows:
903903 (a) In establishing a specialty area of social work, the
904904 commission [board] shall:
905905 (1) define the scope of the specialty;
906906 (2) establish qualifications for specialty area
907907 practitioners that describe, in accordance with Subdivision (1),
908908 the scope of the specialty area;
909909 (3) adopt rules of conduct to ensure strict compliance
910910 with and enforcement of this chapter; and
911911 (4) adopt rules for the suspension or revocation of an
912912 order of recognition of specialty.
913913 SECTION 67. Sections 505.303(a) and (c), Occupations Code,
914914 are amended to read as follows:
915915 (a) The commission [board] shall establish a specialty area
916916 for the practice of clinical social work that is available only to a
917917 licensed master social worker who satisfies the minimum number of
918918 years of active social work practice with appropriate supervision
919919 and clinical examination, as determined by the commission [board].
920920 (c) For purposes of Subchapter C, Chapter 1451, Insurance
921921 Code:
922922 (1) a person recognized as qualified for the
923923 independent practice of clinical social work may use the title
924924 "Licensed Clinical Social Worker" or another title approved by the
925925 commission [board]; and
926926 (2) a commission-approved [board-approved] title
927927 under this subsection has the same meaning and effect as the title
928928 "Licensed Clinical Social Worker."
929929 SECTION 68. Section 505.304, Occupations Code, is amended
930930 to read as follows:
931931 Sec. 505.304. ORDER OF RECOGNITION OF SPECIALTY. (a) The
932932 commission [board] shall prescribe the name, design, and content of
933933 an order of recognition of specialty.
934934 (b) An order of recognition of specialty must:
935935 (1) state the full name of the person recognized in the
936936 order; and
937937 (2) state the official specialty serial number [;
938938 [(3) include the presiding officer's signature; and
939939 [(4) include the board's official seal].
940940 SECTION 69. Section 505.305, Occupations Code, is amended
941941 to read as follows:
942942 Sec. 505.305. RECOGNITION OF SPECIALTY; ISSUANCE OF ORDER.
943943 (a) The department [board] shall recognize a social worker as
944944 qualified for the practice of a specialty area of social work if the
945945 social worker satisfies the recognition requirements established
946946 by the commission [board] and the department [board] determines
947947 that the person is worthy of the public trust in performing services
948948 within the scope of the specialty area.
949949 (b) The department [board] shall issue an order of
950950 recognition of specialty to a social worker who is recognized as
951951 qualified for the practice of a specialty area of social work. The
952952 order of recognition of specialty evidences the state's recognition
953953 of the social worker as a specialty social work practitioner under
954954 the identification or title designated by the commission [board].
955955 SECTION 70. Section 505.306, Occupations Code, is amended
956956 to read as follows:
957957 Sec. 505.306. PROHIBITED USE OF SPECIALTY AREA
958958 IDENTIFICATION OR TITLE. If the commission [board] establishes a
959959 specialty area of social work, a social worker may not use the
960960 specialty area identification or title designated by the commission
961961 [board] unless the person is recognized as qualified for the
962962 practice of the specialty area under this chapter.
963963 SECTION 71. Section 505.307, Occupations Code, is amended
964964 to read as follows:
965965 Sec. 505.307. INDEPENDENT PRACTICE RECOGNITION; MINIMUM
966966 QUALIFICATIONS. (a) The commission [board] shall establish
967967 procedures for recognizing a social worker qualified for the
968968 independent practice of social work.
969969 (b) A social worker may not be recognized as qualified for
970970 the independent practice of social work unless the person satisfies
971971 the requirements of social work education, experience, and
972972 supervision as determined by the commission [board].
973973 SECTION 72. Section 505.352, Occupations Code, is amended
974974 to read as follows:
975975 Sec. 505.352. LICENSE APPLICATION. A person may apply for a
976976 license under this chapter by submitting an application to the
977977 department [board]. The application must:
978978 (1) be in the manner and on a form prescribed by the
979979 executive director [board]; and
980980 (2) contain statements made under oath regarding the
981981 applicant's education and experience and any other information
982982 required by the department [board] that qualifies the applicant for
983983 a license.
984984 SECTION 73. Section 505.353, Occupations Code, is amended
985985 to read as follows:
986986 Sec. 505.353. ELIGIBILITY. (a) To be eligible for a
987987 license under this chapter, an applicant must:
988988 (1) be at least 18 years of age;
989989 (2) be worthy of the public trust and confidence;
990990 (3) satisfy the education and experience requirements
991991 under this section; and
992992 (4) pass the licensing examination conducted by the
993993 department [board] under Section 505.354 and the jurisprudence
994994 examination conducted by the department [board] under Section
995995 505.3545.
996996 (b) An applicant may take the licensing examination
997997 conducted by the department [board] under Section 505.354 for:
998998 (1) a master social worker license if the applicant
999999 possesses a doctoral or master's degree in social work from a
10001000 graduate program that is accredited by or is in candidacy for
10011001 accreditation by the Council on Social Work Education;
10021002 (2) a baccalaureate social worker license if the
10031003 applicant possesses a baccalaureate degree in social work from an
10041004 educational program that is accredited by or is in candidacy for
10051005 accreditation by the Council on Social Work Education; or
10061006 (3) a clinical social worker license if the applicant
10071007 possesses a doctoral or master's degree in social work from an
10081008 accredited graduate program approved by the commission [board] and
10091009 meets the qualifications for clinical social work practice [as
10101010 determined by the board] under this chapter.
10111011 (c) The department [board] may require an applicant to
10121012 submit documentary evidence of the quality, scope, and nature of
10131013 the applicant's experience and competence to:
10141014 (1) determine the credibility and acceptability of the
10151015 applicant's professional or technical experience or competence;
10161016 and
10171017 (2) ensure the public safety, health, and welfare.
10181018 SECTION 74. Sections 505.354(a), (b), and (e), Occupations
10191019 Code, are amended to read as follows:
10201020 (a) The department [board], at least once each calendar
10211021 year, shall prepare and administer an examination to assess an
10221022 applicant's qualifications for a license under this chapter.
10231023 (b) Each license examination shall be conducted in a manner
10241024 that is determined by the department [board] and is fair and
10251025 impartial to each applicant and school or system of social work.
10261026 (e) The department [board] shall have the written portion of
10271027 the examination, if any, validated by an independent testing
10281028 entity.
10291029 SECTION 75. Section 505.3545, Occupations Code, is amended
10301030 to read as follows:
10311031 Sec. 505.3545. JURISPRUDENCE EXAMINATION. (a) The
10321032 department [board] shall develop and administer at least twice each
10331033 calendar year a jurisprudence examination to determine an
10341034 applicant's knowledge of this chapter, [board] rules adopted under
10351035 this chapter, and any other applicable laws of this state affecting
10361036 the applicant's social work practice.
10371037 (b) The commission [board] shall adopt rules to implement
10381038 this section, including rules related to the development and
10391039 administration of the examination, examination fees, guidelines
10401040 for reexamination, grading the examination, and providing notice of
10411041 examination results.
10421042 SECTION 76. Section 505.356, Occupations Code, is amended
10431043 to read as follows:
10441044 Sec. 505.356. REEXAMINATION. The commission [board] by
10451045 rule shall establish:
10461046 (1) a limit on the number of times an applicant who
10471047 fails an examination may retake the examination;
10481048 (2) the requirements for retaking an examination; and
10491049 (3) alternative methods of examining applicants'
10501050 competency.
10511051 SECTION 77. Section 505.3575, Occupations Code, is amended
10521052 to read as follows:
10531053 Sec. 505.3575. ISSUANCE OF LICENSES TO CERTAIN OUT-OF-STATE
10541054 APPLICANTS. (a) Notwithstanding any other licensing requirement
10551055 of this subchapter:
10561056 (1) the department [board] may not require an
10571057 applicant who is licensed in good standing in another state to pass
10581058 a licensing examination conducted [by the board] under Section
10591059 505.354 if an applicant with substantially equivalent experience
10601060 who resides in this state would not be required to take the
10611061 licensing examination; and
10621062 (2) the department [board] may issue a license to an
10631063 applicant who is currently licensed in another state to
10641064 independently practice social work if:
10651065 (A) after an assessment, the department [board]
10661066 determines that the applicant:
10671067 (i) demonstrates sufficient experience and
10681068 competence;
10691069 (ii) has passed the jurisprudence
10701070 examination conducted [by the board] under Section 505.3545; and
10711071 (iii) at the time of the application, is in
10721072 good standing with the regulatory agency of the state in which the
10731073 applicant is licensed; and
10741074 (B) the applicant presents to the department
10751075 [board] credentials that the applicant obtained from a national
10761076 accreditation organization and the department [board] determines
10771077 that the requirements to obtain the credentials are sufficient to
10781078 minimize any risk to public safety.
10791079 (b) When assessing the experience and competence of an
10801080 applicant for the purposes of this section, the department [board]
10811081 may take into consideration any supervision received by the
10821082 applicant in another state or jurisdiction if the department
10831083 [board] determines that the supervision would be taken into
10841084 consideration for the purpose of licensing or certification in the
10851085 state or jurisdiction in which the applicant received the
10861086 supervision.
10871087 SECTION 78. Section 505.358, Occupations Code, is amended
10881088 to read as follows:
10891089 Sec. 505.358. PROVISIONAL LICENSE. (a) A person may apply
10901090 for a provisional license as a social worker by paying the
10911091 appropriate fee and filing an application with the department in
10921092 the manner and on a form prescribed by the executive director
10931093 [board]. The department [board] may issue a provisional license to
10941094 a person who meets the requirements of this section.
10951095 (b) An applicant for a provisional license must:
10961096 (1) be licensed or certified in good standing as a
10971097 social worker in another state that has licensing or certification
10981098 requirements determined by the department [board] to be
10991099 substantially equivalent to the requirements of this chapter;
11001100 (2) have passed a national or other examination
11011101 recognized by the commission [board] relating to the practice of
11021102 social work; and
11031103 (3) be sponsored by a person licensed under this
11041104 chapter with whom the provisional license holder may practice
11051105 social work.
11061106 (c) An applicant is not required to comply with Subsection
11071107 (b)(3) if the department [board] determines that compliance
11081108 constitutes a hardship to the applicant.
11091109 (d) A provisional license is valid until the date the
11101110 department [board] approves or denies the provisional license
11111111 holder's application for a license under Section 505.359.
11121112 SECTION 79. Section 505.359, Occupations Code, is amended
11131113 to read as follows:
11141114 Sec. 505.359. ISSUANCE OF LICENSE TO PROVISIONAL LICENSE
11151115 HOLDER. (a) The department [board] shall issue an appropriate
11161116 license to a provisional license holder:
11171117 (1) who passes the licensing examination under Section
11181118 505.354 and the jurisprudence examination under Section 505.3545;
11191119 (2) for whom the department [board] verifies that the
11201120 person satisfies the academic and experience requirements under
11211121 Section 505.353; and
11221122 (3) who satisfies any other license requirements under
11231123 this chapter.
11241124 (b) The department [board] shall complete the processing of
11251125 a provisional license holder's application for a license not later
11261126 than the 180th day after the date the provisional license is issued
11271127 or the date licenses are issued after successful completion of the
11281128 next licensing and jurisprudence examinations, whichever date is
11291129 later.
11301130 (c) The department [board] may waive a license requirement
11311131 for an applicant who is licensed or certified in another state if
11321132 this state has entered into a reciprocity agreement with that
11331133 state.
11341134 SECTION 80. The heading to Subchapter H, Chapter 505,
11351135 Occupations Code, is amended to read as follows:

11421142 of recognition of specialty issued under this chapter is valid for
11431143 two years.
11441144 [(a-1) The board by rule shall adopt a system under which
11451145 licenses and orders of recognition of specialty expire on various
11461146 dates during the year.
11471147 [(b) In the year in which the expiration date of an order of
11481148 recognition of specialty is changed, the total renewal fee is
11491149 payable.]
11501150 SECTION 82. Section 505.405, Occupations Code, is amended
11511151 to read as follows:
11521152 Sec. 505.405. GROUNDS FOR REFUSING RENEWAL. The department
11531153 [board] may refuse to renew the license of a person who fails to pay
11541154 an administrative penalty imposed under Subchapter F, Chapter 51,
11551155 [K] unless enforcement of the penalty is stayed or a court has
11561156 ordered that the administrative penalty is not owed.

11651165 executive director [board] shall deny an application for a license
11661166 or order of recognition of specialty and shall revoke or suspend,
11671167 including a suspension on an emergency basis, a license or order,
11681168 place a holder of a license or order that has been suspended on
11691169 probation, refuse to renew a person's license, or reprimand a
11701170 holder of a license or order for:
11711171 (1) violating this chapter or a rule adopted [by the
11721172 board] under this chapter;
11731173 (2) circumventing or attempting to circumvent the
11741174 requirements of this chapter or a rule adopted [by the board] under
11751175 this chapter;
11761176 (3) directly or indirectly participating in a scheme
11771177 to evade the requirements of this chapter or a rule adopted [by the
11781178 board] under this chapter;
11791179 (4) engaging in unethical conduct;
11801180 (5) engaging in conduct that discredits or tends to
11811181 discredit the social work profession;
11821182 (6) performing an act, allowing an omission, or making
11831183 an assertion or representation that is fraudulent, deceitful, or
11841184 misleading or that tends to create a misleading impression;
11851185 (7) knowingly associating with or permitting the use
11861186 of a license holder's professional services or identification in
11871187 connection with an enterprise that the person knows or should have
11881188 known in the exercise of reasonable diligence violates this chapter
11891189 or a rule adopted [by the board] under this chapter;
11901190 (8) knowingly associating with or permitting the use
11911191 of a license holder's name, professional services or
11921192 identification, or endorsement in connection with an enterprise
11931193 that the person knows or should have known in the exercise of
11941194 reasonable diligence is a trade, business, or professional practice
11951195 of a fraudulent, deceitful, or misleading nature;
11961196 (9) directly or indirectly revealing or causing to be
11971197 revealed a confidential communication transmitted to the license
11981198 holder by a client or other recipient of the license holder's
11991199 services unless revealing the communication is required by law;
12001200 (10) having been denied an application for a license
12011201 or certificate to practice social work in another jurisdiction for
12021202 a reason that the commission or executive director [board]
12031203 determines would be a violation of this chapter or a rule adopted
12041204 [by the board] under this chapter;
12051205 (11) holding a license or certificate in another
12061206 jurisdiction that is suspended or revoked for a reason that the
12071207 commission or executive director [board] determines would be a
12081208 violation of this chapter or a rule adopted [by the board] under
12091209 this chapter;
12101210 (12) having been convicted of a felony in this state,
12111211 another state, or the United States;
12121212 (13) refusing to perform an act or service within the
12131213 scope of the license holder's license solely because of the
12141214 recipient's age, sex, race, religion, national origin, color, or
12151215 political affiliation; or
12161216 (14) committing an act for which liability exists
12171217 under Chapter 81, Civil Practice and Remedies Code.
12181218 SECTION 85. Section 505.454, Occupations Code, is amended
12191219 to read as follows:
12201220 Sec. 505.454. SANCTIONS FOR HOLDER OF EXPIRED LICENSE OR
12211221 ORDER OF RECOGNITION OF SPECIALTY. [(a)] A person who holds an
12221222 expired license or order of recognition of specialty under this
12231223 chapter is subject to a sanction under this chapter if the
12241224 commission or executive director [board] determines that the person
12251225 violated this chapter or a rule adopted [by the board] under this
12261226 chapter during the period in which the license or order was valid.
12271227 [(b) Sections 505.455(b) and (c) and 505.456 apply to a
12281228 disciplinary proceeding against a person under this section.]
12291229 SECTION 86. Section 505.458, Occupations Code, is amended
12301230 to read as follows:
12311231 Sec. 505.458. REFUND. (a) Subject to Subsection (b), the
12321232 commission or executive director [board] may order a license holder
12331233 to pay a refund to a consumer as provided in an agreement resulting
12341234 from an informal settlement conference instead of or in addition to
12351235 imposing an administrative penalty under this chapter.
12361236 (b) The amount of a refund ordered as provided in an
12371237 agreement resulting from an informal settlement conference may not
12381238 exceed the amount the consumer paid to the license holder for a
12391239 service regulated by this chapter. The commission or executive
12401240 director [board] may not require payment of other damages or
12411241 estimate harm in a refund order.
12421242 SECTION 87. Section 505.504, Occupations Code, is amended
12431243 to read as follows:
12441244 Sec. 505.504. CIVIL PENALTY. (a) A person who violates or
12451245 threatens to violate this chapter, a rule adopted [by the board]
12461246 under this chapter, or an order issued [by the board or department]
12471247 under this chapter is liable to the state for a civil penalty of not
12481248 less than $50 or more than $500 for each day of violation.
12491249 (b) At the request of the commission or executive director
12501250 [board or department], the attorney general shall initiate and
12511251 conduct an action in a district court in the state's name to obtain
12521252 a civil penalty under this section.
12531253 SECTION 88. Section 505.505, Occupations Code, is amended
12541254 to read as follows:
12551255 Sec. 505.505. APPEAL BOND NOT REQUIRED. The [board or]
12561256 department is not required to post an appeal bond in any action
12571257 arising under this chapter.

14731473 SECTION 96. (a) A rule or fee of the Department of State
14741474 Health Services that relates to a program transferred under this
14751475 Act and that is in effect on the effective date of this Act remains
14761476 in effect until changed by the Texas Commission of Licensing and
14771477 Regulation.
14781478 (b) A license, registration, or certification issued by the
14791479 Department of State Health Services relating to a program
14801480 transferred under this Act is continued in effect as a license,
14811481 registration, or certification of the Texas Department of Licensing
14821482 and Regulation after the effective date of this Act.
14831483 (c) A complaint, investigation, contested case, or other
14841484 proceeding before the Department of State Health Services relating
14851485 to a program transferred under this Act that is pending on the
14861486 effective date of this Act is transferred without change in status
14871487 to the Texas Commission of Licensing and Regulation or Texas
14881488 Department of Licensing and Regulation, as appropriate.
14891489 SECTION 97. (a) As soon as practicable after the effective
14901490 date of this Act, the Department of State Health Services and the
14911491 Texas Department of Licensing and Regulation shall adopt a
14921492 transition plan to provide for the orderly transfer of powers,
14931493 duties, functions, programs, and activities under this Act. The
14941494 transition plan must provide for each program to be transferred on
14951495 or before September 1, 2018.
14961496 (b) The Department of State Health Services shall provide
14971497 the Texas Department of Licensing and Regulation with access to any
14981498 systems or information necessary for the Texas Department of
14991499 Licensing and Regulation to accept a program transferred under this
15001500 Act.
15011501 (c) On the date specified in the transition plan required
15021502 under Subsection (a) of this section for the transfer of a
15031503 particular program to the Texas Department of Licensing and
15041504 Regulation, if applicable, the existing board associated with the
15051505 program is abolished.
15061506 (d) On the date specified in the transition plan required
15071507 under Subsection (a) of this section for the transfer of a
15081508 particular program to the Texas Department of Licensing and
15091509 Regulation, all full-time equivalent employee positions at the
15101510 Department of State Health Services that primarily concern the
15111511 administration or enforcement of the program being transferred
15121512 become positions at the Texas Department of Licensing and
15131513 Regulation. The Texas Department of Licensing and Regulation shall
15141514 post the positions for hiring and, when filling the positions,
15151515 shall give consideration to, but is not required to hire, an
15161516 applicant who, immediately before the date of the transfer, was an
15171517 employee at the Department of State Health Services primarily
15181518 involved in administering or enforcing the transferred program.
15191519 SECTION 98. To the extent of any conflict, this Act prevails
15201520 over another Act of the 85th Legislature, Regular Session, 2017,
15211521 relating to nonsubstantive additions to and corrections in enacted
15221522 codes.
15231523 SECTION 99. This Act takes effect September 1, 2017.
