| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Subchapter D, Chapter 22, Transportation Code, |

| 11 | 9 | | is amended by adding Section 22.091 to read as follows: |

| 12 | 10 | | Sec. 22.091. CONFIDENTIALITY OF CERTAIN INFORMATION |
|---|
| 13 | 11 | | COLLECTED BY JOINT BOARD. Personal identifying information |
|---|
| 14 | 12 | | collected by a joint board for which the constituent agencies are |
|---|
| 15 | 13 | | populous home-rule municipalities is confidential and not subject |
|---|
| 16 | 14 | | to disclosure under Chapter 552, Government Code, if the |
|---|
| 17 | 15 | | information collected is in relation to a commercial online payment |
|---|
| 18 | 16 | | system and includes a person's: |
|---|
| 19 | 17 | | (1) name, address, e-mail address, or phone number; |
|---|
| 20 | 18 | | (2) account number, password, payment transaction |
|---|
| 21 | 19 | | activity, toll or charge record, or credit, debit, or other payment |
|---|
| 22 | 20 | | card number; or |
|---|
| 23 | 21 | | (3) other personal financial information. |
|---|
| 24 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 26 | | Act takes effect September 1, 2017. |
