55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to evaluation of public schools based on academic
88 achievement and financial resources.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.057(a), Education Code, is amended to
1111 read as follows:
1212 (a) The commissioner may authorize special accreditation
1313 investigations to be conducted:
1414 (1) when excessive numbers of absences of students
1515 eligible to be tested on state assessment instruments are
1616 determined;
1717 (2) when excessive numbers of allowable exemptions
1818 from the required state assessment instruments are determined;
1919 (3) in response to complaints submitted to the agency
2020 with respect to alleged violations of civil rights or other
2121 requirements imposed on the state by federal law or court order;
2222 (4) in response to established compliance reviews of
2323 the district's financial accounting practices and state and federal
2424 program requirements;
2525 (5) when extraordinary numbers of student placements
2626 in disciplinary alternative education programs, other than
2727 placements under Sections 37.006 and 37.007, are determined;
2828 (6) in response to an allegation involving a conflict
2929 between members of the board of trustees or between the board and
3030 the district administration if it appears that the conflict
3131 involves a violation of a role or duty of the board members or the
3232 administration clearly defined by this code;
3333 (7) when excessive numbers of students in special
3434 education programs under Subchapter A, Chapter 29, are assessed
3535 through assessment instruments developed or adopted under Section
3636 39.023(b);
3737 (8) in response to an allegation regarding or an
3838 analysis using a statistical method result indicating a possible
3939 violation of an assessment instrument security procedure
4040 established under Section 39.0301, including for the purpose of
4141 investigating or auditing a school district under that section;
4242 (9) when a significant pattern of decreased academic
4343 performance has developed as a result of the promotion in the
4444 preceding two school years of students who did not perform
4545 satisfactorily as determined by the commissioner under Section
4646 39.0241(a) on assessment instruments administered under Section
4747 39.023(a), (c), or (l);
4848 (10) when excessive numbers of students eligible to
4949 enroll fail to complete an Algebra II course or any other advanced
5050 course as determined by the commissioner;
5151 (11) when academic return on financial resources
5252 [resource allocation practices] as evaluated under Section 39.059
5353 indicates [39.0821 indicate] a potential for significant
5454 improvement [in resource allocation];
5555 (12) when a disproportionate number of students of a
5656 particular demographic group is graduating with a particular
5757 endorsement under Section 28.025(c-1);
5858 (13) when an excessive number of students is
5959 graduating with a particular endorsement under
6060 Section 28.025(c-1);
6161 (14) in response to a complaint submitted to the
6262 agency with respect to alleged inaccurate data that is reported
6363 through the Public Education Information Management System (PEIMS)
6464 or through other reports required by state or federal law or rule or
6565 court order and that is used by the agency to make a determination
6666 relating to public school accountability, including accreditation,
6767 under this chapter; or
6868 (15) as the commissioner otherwise determines
6969 necessary.
7070 SECTION 2. Subchapter C, Chapter 39, Education Code, is
7171 amended by adding Section 39.059 to read as follows:
7272 Sec. 39.059. ACADEMIC ACHIEVEMENT AND FINANCIAL RESOURCES
7373 EVALUATION. (a) The agency shall develop a statistical model to
7474 evaluate a campus and district's academic return on financial
7575 resources.
7676 (b) In evaluating a campus and district under this section,
7777 the agency shall:
7878 (1) evaluate and integrate existing academic
7979 accountability and financial data; and
8080 (2) rank the results of the evaluation under
8181 Subdivision (1) to compare the relative performance of districts
8282 and campuses with similar financial resources.
8383 (c) Based on the ranking under Subsection (b)(2), and in
8484 accordance with rules adopted by the commissioner, the commissioner
8585 shall assign each campus and district a rating of A, B, C, D, or F.
8686 (d) Not later than August 15 of each year, the rating of each
8787 district and campus under this section shall be made publicly
8888 available along with the performance ratings awarded to the
8989 district or campus under Section 39.054(a).
9090 SECTION 3. Section 39.0821, Education Code, is repealed.
9191 SECTION 4. This Act applies beginning with the 2017-2018
9292 school year.
9393 SECTION 5. This Act takes effect immediately if it receives
9494 a vote of two-thirds of all the members elected to each house, as
9595 provided by Section 39, Article III, Texas Constitution. If this
9696 Act does not receive the vote necessary for immediate effect, this
9797 Act takes effect September 1, 2017.
