6	6	AN ACT
7	7	relating to evaluation of public schools based on academic
8	8	achievement and financial resources.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 39.057(a), Education Code, is amended to
11	11	read as follows:
12	12	(a) The commissioner may authorize special accreditation
13	13	investigations to be conducted:
14	14	(1) when excessive numbers of absences of students
15	15	eligible to be tested on state assessment instruments are
16	16	determined;
17	17	(2) when excessive numbers of allowable exemptions
18	18	from the required state assessment instruments are determined;
19	19	(3) in response to complaints submitted to the agency
20	20	with respect to alleged violations of civil rights or other
21	21	requirements imposed on the state by federal law or court order;
22	22	(4) in response to established compliance reviews of
23	23	the district's financial accounting practices and state and federal
24	24	program requirements;
25	25	(5) when extraordinary numbers of student placements
26	26	in disciplinary alternative education programs, other than
27	27	placements under Sections 37.006 and 37.007, are determined;
28	28	(6) in response to an allegation involving a conflict
29	29	between members of the board of trustees or between the board and
30	30	the district administration if it appears that the conflict
31	31	involves a violation of a role or duty of the board members or the
32	32	administration clearly defined by this code;
33	33	(7) when excessive numbers of students in special
34	34	education programs under Subchapter A, Chapter 29, are assessed
35	35	through assessment instruments developed or adopted under Section
36	36	39.023(b);
37	37	(8) in response to an allegation regarding or an
38	38	analysis using a statistical method result indicating a possible
39	39	violation of an assessment instrument security procedure
40	40	established under Section 39.0301, including for the purpose of
41	41	investigating or auditing a school district under that section;
42	42	(9) when a significant pattern of decreased academic
43	43	performance has developed as a result of the promotion in the
44	44	preceding two school years of students who did not perform
45	45	satisfactorily as determined by the commissioner under Section
46	46	39.0241(a) on assessment instruments administered under Section
47	47	39.023(a), (c), or (l);
48	48	(10) when excessive numbers of students eligible to
49	49	enroll fail to complete an Algebra II course or any other advanced
50	50	course as determined by the commissioner;
51	51	(11) when academic return on financial resources
52	52	[resource allocation practices] as evaluated under Section 39.059
53	53	indicates [39.0821 indicate] a potential for significant
54	54	improvement [in resource allocation];
55	55	(12) when a disproportionate number of students of a
56	56	particular demographic group is graduating with a particular
57	57	endorsement under Section 28.025(c-1);
58	58	(13) when an excessive number of students is
59	59	graduating with a particular endorsement under
60	60	Section 28.025(c-1);
61	61	(14) in response to a complaint submitted to the
62	62	agency with respect to alleged inaccurate data that is reported
63	63	through the Public Education Information Management System (PEIMS)
64	64	or through other reports required by state or federal law or rule or
65	65	court order and that is used by the agency to make a determination
66	66	relating to public school accountability, including accreditation,
67	67	under this chapter; or
68	68	(15) as the commissioner otherwise determines
69	69	necessary.
70	70	SECTION 2. Subchapter C, Chapter 39, Education Code, is
71	71	amended by adding Section 39.059 to read as follows:
72	72	Sec. 39.059. ACADEMIC ACHIEVEMENT AND FINANCIAL RESOURCES
73	73	EVALUATION. (a) The agency shall develop a statistical model to
74	74	evaluate a campus and district's academic return on financial
75	75	resources.
76	76	(b) In evaluating a campus and district under this section,
77	77	the agency shall:
78	78	(1) evaluate and integrate existing academic
79	79	accountability and financial data; and
80	80	(2) rank the results of the evaluation under
81	81	Subdivision (1) to compare the relative performance of districts
82	82	and campuses with similar financial resources.
83	83	(c) Based on the ranking under Subsection (b)(2), and in
84	84	accordance with rules adopted by the commissioner, the commissioner
85	85	shall assign each campus and district a rating of A, B, C, D, or F.
86	86	(d) Not later than August 15 of each year, the rating of each
87	87	district and campus under this section shall be made publicly
88	88	available along with the performance ratings awarded to the
89	89	district or campus under Section 39.054(a).
90	90	SECTION 3. Section 39.0821, Education Code, is repealed.
91	91	SECTION 4. This Act applies beginning with the 2017-2018
92	92	school year.
93	93	SECTION 5. This Act takes effect immediately if it receives
94	94	a vote of two-thirds of all the members elected to each house, as
95	95	provided by Section 39, Article III, Texas Constitution. If this
96	96	Act does not receive the vote necessary for immediate effect, this
97	97	Act takes effect September 1, 2017.
