66 AN ACT
77 relating to prohibiting certain physician questions regarding
88 firearms.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 164, Occupations Code, is
1111 amended by adding Section 164.0525 to read as follows:
1212 Sec. 164.0525. INQUIRY INTO GUN OWNERSHIP PROHIBITED. (a)
1313 In this section, "patient" has the meaning provided by Section
1414 159.001.
1515 (b) A physician, other than a psychiatrist, may not:
1616 (1) inquire into, or ask a patient to disclose,
1717 whether a firearm is located or stored on property owned by or under
1818 the patient's control, including the patient's home; and
1919 (2) require that information described by Subdivision
2020 (1) be disclosed before providing treatment to the patient.
2121 (c) The board may take disciplinary action against a
2222 physician who violates Subsection (b).
2323 SECTION 2. Section 164.0525, Occupations Code, as added by
2424 this Act, applies only to conduct that occurs on or after the
2525 effective date of this Act. Conduct that occurs before the
2626 effective date of this Act is governed by the law in effect on the
2727 date the conduct occurred, and the former law is continued in effect
2828 for that purpose.
2929 SECTION 3. This Act takes effect September 1, 2017.
