| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 164, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 164.0525 to read as follows: |
|---|
| 12 | 12 | | Sec. 164.0525. INQUIRY INTO GUN OWNERSHIP PROHIBITED. (a) |
|---|
| 13 | 13 | | In this section, "patient" has the meaning provided by Section |
|---|
| 14 | 14 | | 159.001. |
|---|
| 15 | 15 | | (b) A physician, other than a psychiatrist, may not: |
|---|
| 16 | 16 | | (1) inquire into, or ask a patient to disclose, |
|---|
| 17 | 17 | | whether a firearm is located or stored on property owned by or under |
|---|
| 18 | 18 | | the patient's control, including the patient's home; and |
|---|
| 19 | 19 | | (2) require that information described by Subdivision |
|---|
| 20 | 20 | | (1) be disclosed before providing treatment to the patient. |
|---|
| 21 | 21 | | (c) The board may take disciplinary action against a |
|---|
| 22 | 22 | | physician who violates Subsection (b). |
|---|
| 23 | 23 | | SECTION 2. Section 164.0525, Occupations Code, as added by |
|---|
| 24 | 24 | | this Act, applies only to conduct that occurs on or after the |
|---|
| 25 | 25 | | effective date of this Act. Conduct that occurs before the |
|---|
| 26 | 26 | | effective date of this Act is governed by the law in effect on the |
|---|
| 27 | 27 | | date the conduct occurred, and the former law is continued in effect |
|---|
| 28 | 28 | | for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2017. |
