66 AN ACT
77 relating to the suspension of a driver's license issued to a person
88 who fails to pay an administrative penalty imposed by the Texas
99 Funeral Service Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 651.551(a), Occupations Code, is amended
1212 to read as follows:
1313 (a) The commission may assess an administrative penalty
1414 against a person, regardless of whether the person holds a license
1515 issued [regulated] under this chapter, if the commission determines
1616 that the person has violated this chapter or a rule adopted under
1717 this chapter.
1818 SECTION 2. Section 651.556, Occupations Code, is amended to
1919 read as follows:
2020 Sec. 651.556. COLLECTION OF PENALTY. (a) On the
2121 commission's request, the attorney general shall bring a civil
2222 action to recover an administrative penalty owed under this
2323 chapter.
2424 (b) The commission may, in addition to making a request
2525 under Subsection (a), notify the Department of Public Safety that a
2626 person owes an administrative penalty imposed under this chapter
2727 and that the person failed to pay the penalty when due. On receipt
2828 of notice from the commission, the department shall suspend a
2929 driver's license issued by the department to the person who is the
3030 subject of the notice. The commission shall notify the department
3131 after the person pays the penalty and the department shall
3232 reinstate the person's driver's license.
3333 SECTION 3. This Act takes effect September 1, 2017.
