7 | 7 | | relating to the suspension of a driver's license issued to a person |

8 | 8 | | who fails to pay an administrative penalty imposed by the Texas |

9 | 9 | | Funeral Service Commission. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 651.551(a), Occupations Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (a) The commission may assess an administrative penalty |
---|
14 | 14 | | against a person, regardless of whether the person holds a license |
---|
15 | 15 | | issued [regulated] under this chapter, if the commission determines |
---|
16 | 16 | | that the person has violated this chapter or a rule adopted under |
---|
17 | 17 | | this chapter. |
---|
18 | 18 | | SECTION 2. Section 651.556, Occupations Code, is amended to |
---|
19 | 19 | | read as follows: |
---|
20 | 20 | | Sec. 651.556. COLLECTION OF PENALTY. (a) On the |
---|
21 | 21 | | commission's request, the attorney general shall bring a civil |
---|
22 | 22 | | action to recover an administrative penalty owed under this |
---|
23 | 23 | | chapter. |
---|
24 | 24 | | (b) The commission may, in addition to making a request |
---|
25 | 25 | | under Subsection (a), notify the Department of Public Safety that a |
---|
26 | 26 | | person owes an administrative penalty imposed under this chapter |
---|
27 | 27 | | and that the person failed to pay the penalty when due. On receipt |
---|
28 | 28 | | of notice from the commission, the department shall suspend a |
---|
29 | 29 | | driver's license issued by the department to the person who is the |
---|
30 | 30 | | subject of the notice. The commission shall notify the department |
---|
31 | 31 | | after the person pays the penalty and the department shall |
---|
32 | 32 | | reinstate the person's driver's license. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2017. |
