| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 555, Health and Safety Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter F to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER F. SALE OF REAL PROPERTY |
|---|
| 13 | 13 | | Sec. 555.201. OPTION TO PURCHASE REAL PROPERTY. (a) If the |
|---|
| 14 | 14 | | commission, the department, or another state agency or entity |
|---|
| 15 | 15 | | offers for sale real property owned by the state on which a state |
|---|
| 16 | 16 | | supported living center is located, the real property must be |
|---|
| 17 | 17 | | offered for sale to the city and county in which the real property |
|---|
| 18 | 18 | | is located before the real property is offered for sale to the |
|---|
| 19 | 19 | | general public. If the city or county purchases the real property, |
|---|
| 20 | 20 | | the purchase price may not be less than market value. |
|---|
| 21 | 21 | | (b) Subsection (a) may not be construed as requiring the |
|---|
| 22 | 22 | | commission, the department, or another state agency or entity to |
|---|
| 23 | 23 | | offer real property owned by the state on which a state supported |
|---|
| 24 | 24 | | living center is located to the city and county in which the real |
|---|
| 25 | 25 | | property is located before offering the real property for sale to a |
|---|
| 26 | 26 | | state agency. |

| 27 | 27 | | SECTION 2. Section 31.158(c)(1), Natural Resources Code, is |
|---|
| 28 | 28 | | amended to read as follows: |
|---|
| 29 | 29 | | (1) The sale or lease shall be by sealed bid, by public |
|---|
| 30 | 30 | | auction, or as provided by Subsection (d); provided, however, the |
|---|
| 31 | 31 | | School Land Board shall have the first option to purchase such real |
|---|
| 32 | 32 | | property pursuant to Section 31.159 of this code and the city and |
|---|
| 33 | 33 | | county in which the real property is located shall have the option |
|---|
| 34 | 34 | | to purchase such real property pursuant to Section 555.201, Health |
|---|
| 35 | 35 | | and Safety Code. Subdivisions (2)-(7) apply only to a sale or lease |
|---|
| 36 | 36 | | by sealed bid or public auction. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2017. |
