66 AN ACT
77 relating to volunteer firefighter supervision of outdoor burning of
88 waste consisting of plant growth.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 382.018(d), Health and Safety Code, is
1111 amended to read as follows:
1212 (d) The commission may not control or prohibit outdoor
1313 burning of waste consisting of trees, brush, grass, leaves, branch
1414 trimmings, or other plant growth if:
1515 (1) the person burning the waste is doing so at a site:
1616 (A) designated for consolidated burning of waste
1717 generated from specific residential properties;
1818 (B) located in a county with a population of less
1919 than 50,000;
2020 (C) located outside of a municipality; and
2121 (D) supervised at the time of the burning by:
2222 (i) an employee of a fire department who is
2323 part of the fire protection personnel, as defined by Section
2424 419.021, Government Code, of the department and is acting in the
2525 scope of the person's employment; or
2626 (ii) a volunteer firefighter acting in the
2727 scope of the firefighter's volunteer duties; and
2828 (2) the waste was generated from a property for which
2929 the site is designated.
3030 SECTION 2. This Act takes effect September 1, 2017.
