1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the persons authorized to make an anatomical gift.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 692A.002(13), Health and Safety Code, is
1616 amended to read as follows:
1717 (13) "Guardian" means a person appointed by a court to
1818 make decisions regarding the support, care, education, health, or
1919 welfare of an individual. The term does not include:
2020 (A) a guardian ad litem;
2121 (B) a procurement organization; or
2222 (C) any person associated with the hospital in
2323 possession of the decedent's body other than a person described by
2424 Section 692A.009(a)(2), (3), (4), (5), (6), or (7).
2525 SECTION 2. Section 692A.009, Health and Safety Code, is
2626 amended by amending Subsection (a) and adding Subsection (d) to
2727 read as follows:
2828 (a) Subject to Subsections (b) and (c) and unless barred by
2929 Section 692A.007 or Section 692A.008, an anatomical gift of a
3030 decedent's body or part for the purpose of transplantation,
3131 therapy, research, or education may be made by any member of the
3232 following classes of persons who is reasonably available, in the
3333 order of priority listed:
3434 (1) an agent of the decedent at the time of death who
3535 could have made an anatomical gift under Section 692A.004(2)
3636 immediately before the decedent's death;
3737 (2) the spouse of the decedent;
3838 (3) adult children of the decedent;
3939 (4) parents of the decedent;
4040 (5) adult siblings of the decedent;
4141 (6) adult grandchildren of the decedent;
4242 (7) grandparents of the decedent;
4343 (8) an adult who exhibited special care and concern
4444 for the decedent other than a person associated with the hospital in
4545 possession of the decedent's body; and
4646 (9) the persons who were acting as the guardians of the
4747 person of the decedent at the time of death[;
4848 [(10) the hospital administrator; and
4949 [(11) any other person having the authority to dispose
5050 of the decedent's body].
5151 (d) A procurement organization may not petition a court to
5252 become the decedent's guardian or to otherwise be authorized to
5353 make an anatomical gift of the decedent's body or part.
5454 SECTION 3. Section 692A.009, Health and Safety Code, as
5555 amended by this Act, applies only to an anatomical gift made on or
5656 after the effective date of this Act. An anatomical gift made
5757 before the effective date of this Act is governed by the law in
5858 effect immediately before the effective date of this Act, and that
5959 law is continued in effect for that purpose.
6060 SECTION 4. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2017.
