55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for theft offenses involving certain
88 metals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.03(e), Penal Code, is amended to read
1111 as follows:
1212 (e) Except as provided by Subsection (f), an offense under
1313 this section is:
1414 (1) a Class C misdemeanor if the value of the property
1515 stolen is less than $100;
1616 (2) a Class B misdemeanor if:
1717 (A) the value of the property stolen is $100 or
1818 more but less than $750;
1919 (B) the value of the property stolen is less than
2020 $100 and the defendant has previously been convicted of any grade of
2121 theft; or
2222 (C) the property stolen is a driver's license,
2323 commercial driver's license, or personal identification
2424 certificate issued by this state or another state;
2525 (3) a Class A misdemeanor if the value of the property
2626 stolen is $750 or more but less than $2,500;
2727 (4) a state jail felony if:
2828 (A) the value of the property stolen is $2,500 or
2929 more but less than $30,000, or the property is less than 10 head of
3030 sheep, swine, or goats or any part thereof under the value of
3131 $30,000;
3232 (B) regardless of value, the property is stolen
3333 from the person of another or from a human corpse or grave,
3434 including property that is a military grave marker;
3535 (C) the property stolen is a firearm, as defined
3636 by Section 46.01;
3737 (D) the value of the property stolen is less than
3838 $2,500 and the defendant has been previously convicted two or more
3939 times of any grade of theft;
4040 (E) the property stolen is an official ballot or
4141 official carrier envelope for an election; or
4242 (F) the value of the property stolen is less than
4343 $30,000 [$20,000] and the property [stolen] is:
4444 (i) aluminum, bronze, copper, or brass
4545 stolen from:
4646 (a) a structure owned or operated by a
4747 telecommunications provider, as defined by Section 51.002,
4848 Utilities Code; or
4949 (b) a structure in which the stolen
5050 property was used to provide basic local telecommunications
5151 service, as defined by Section 51.002, Utilities Code; or
5252 (ii) regulated material, as defined by
5353 Section 1956.001, Occupations Code, stolen from:
5454 (a) a public utility or
5555 telecommunications provider, as those terms are defined by Section
5656 51.002, Utilities Code; or
5757 (b) a cable service provider or video
5858 service provider, as those terms are defined by Section 66.002,
5959 Utilities Code [bronze;
6060 [(iii) copper; or
6161 [(iv) brass];
6262 (5) a felony of the third degree if the value of the
6363 property stolen is $30,000 or more but less than $150,000, or the
6464 property is:
6565 (A) cattle, horses, or exotic livestock or exotic
6666 fowl as defined by Section 142.001, Agriculture Code, stolen during
6767 a single transaction and having an aggregate value of less than
6868 $150,000; or
6969 (B) 10 or more head of sheep, swine, or goats
7070 stolen during a single transaction and having an aggregate value of
7171 less than $150,000;
7272 (6) a felony of the second degree if:
7373 (A) the value of the property stolen is $150,000
7474 or more but less than $300,000; or
7575 (B) the value of the property stolen is less than
7676 $300,000 and the property stolen is an automated teller machine or
7777 the contents or components of an automated teller machine; or
7878 (7) a felony of the first degree if the value of the
7979 property stolen is $300,000 or more.
8080 SECTION 2. The change in law made by this Act applies only
8181 to an offense committed on or after the effective date of this Act.
8282 An offense committed before the effective date of this Act is
8383 governed by the law in effect on the date the offense was committed,
8484 and the former law is continued in effect for that purpose. For
8585 purposes of this section, an offense was committed before the
8686 effective date of this Act if any element of the offense occurred
8787 before that date.
8888 SECTION 3. This Act takes effect September 1, 2017.
