66 AN ACT
77 relating to the ownership and local regulation of trees and timber.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Title 6, Natural Resources Code, is amended by
1010 adding Chapter 154 to read as follows:
1111 CHAPTER 154. OWNERSHIP AND LOCAL REGULATION OF TREES AND TIMBER
1212 Sec. 154.001. DEFINITIONS. In this chapter:
1313 (1) "Governmental entity" means a political
1414 subdivision of the state, including:
1515 (A) a municipality; and
1616 (B) a county.
1717 (2) "Removal of a tree" means the harvesting, cutting,
1818 or destruction of a tree, including the damaging of a tree in a way
1919 that will cause the death of the tree on or before the first
2020 anniversary of the date of the damage, as determined by a
2121 governmental entity.
2222 Sec. 154.002. OWNERSHIP OF TREES AND TIMBER. A landowner
2323 owns all trees and timber located on the landowner's land as real
2424 property until cut or otherwise removed from the land, unless
2525 otherwise provided by a contract, bill of sale, deed, mortgage,
2626 deed of trust, or other legally binding document.
2727 Sec. 154.003. LOCAL REGULATION OF TREES AND TIMBER. (a) A
2828 governmental entity may not:
2929 (1) prohibit a landowner from trimming or removing
3030 trees or timber located on the landowner's land; or
3131 (2) assess a fee against a landowner who removes trees
3232 or timber from the landowner's land.
3333 (b) Notwithstanding any other law, a municipality may not
3434 regulate the trimming or removal of trees or timber in the
3535 extraterritorial jurisdiction of the municipality.
3636 SECTION 2. This Act takes effect September 1, 2017.
