| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Article 2, Chapter 1029, Acts of the 76th |
|---|
| 11 | 9 | | Legislature, Regular Session, 1999, is amended by adding Section |
|---|
| 12 | 10 | | 2.08 to read as follows: |
|---|
| 13 | 11 | | Sec. 2.08. ACTION ON CERTIFICATION OF UNOPPOSED CANDIDATES. |
|---|
| 14 | 12 | | (a) On receipt of the certification required by Section 2.052, |
|---|
| 15 | 13 | | Election Code, the board may declare each unopposed candidate for |
|---|
| 16 | 14 | | the board elected to the office. |
|---|
| 17 | 15 | | (b) If a declaration is made under Subsection (a), the |
|---|
| 18 | 16 | | election is not held for that candidate's voting district. |
|---|
| 19 | 17 | | (c) The ballots used at a separate election held at the same |
|---|
| 20 | 18 | | time as an election that would have been held if the candidates were |
|---|
| 21 | 19 | | not declared elected under this section shall include the offices |
|---|
| 22 | 20 | | and names of the candidates declared elected under this section |
|---|
| 23 | 21 | | listed separately after the measures or contested races in the |
|---|
| 24 | 22 | | separate election under the heading "Unopposed Candidates Declared |
|---|
| 25 | 23 | | Elected." The candidates shall be grouped in the same relative |
|---|
| 26 | 24 | | order prescribed for the ballot generally. No votes are cast in |
|---|
| 27 | 25 | | connection with the candidates. |
|---|
| 28 | 26 | | (d) The secretary of state by rule may prescribe any |
|---|
| 29 | 27 | | additional procedures necessary to accommodate a particular voting |
|---|
| 30 | 28 | | system or ballot style and to facilitate the efficient and |
|---|
| 31 | 29 | | cost-effective implementation of this section. |
|---|
| 32 | 30 | | (e) A certificate of election shall be issued to each |
|---|
| 33 | 31 | | candidate in the same manner and at the same time as provided for a |
|---|
| 34 | 32 | | candidate elected at the election. The candidate must qualify for |
|---|
| 35 | 33 | | the office in the same manner as provided for a candidate elected at |
|---|
| 36 | 34 | | the election. |
|---|
| 37 | 35 | | (f) Section 2.053, Election Code, does not apply to an |
|---|
| 38 | 36 | | election for the board of directors of the authority. |
|---|
| 39 | 37 | | SECTION 2. This Act takes effect September 1, 2017. |
