| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 1602.254, Occupations Code, is amended |
|---|
| 12 | 12 | | by adding Subsection (b-1) to read as follows: |
|---|
| 13 | 13 | | (b-1) The hours of instruction required under Subsection |
|---|
| 14 | 14 | | (b)(3) may be fulfilled wholly or partly through credit hours. The |
|---|
| 15 | 15 | | commission by rule shall establish a method for fairly equating |
|---|
| 16 | 16 | | credit hours with clock hours of instruction. |
|---|
| 17 | 17 | | SECTION 2. Section 1603.102, Occupations Code, is amended |
|---|
| 18 | 18 | | to read as follows: |
|---|
| 19 | 19 | | Sec. 1603.102. SANITATION RULES. (a) The commission shall |
|---|
| 20 | 20 | | establish sanitation rules to prevent the spread of an infectious |
|---|
| 21 | 21 | | or contagious disease. |
|---|
| 22 | 22 | | (b) The rules adopted under this section applicable to an |
|---|
| 23 | 23 | | individual or facility regulated under Chapter 1602 must be |
|---|
| 24 | 24 | | consistent with the standards and terminology related to safety and |
|---|
| 25 | 25 | | sanitation that are commonly used in the cosmetology industry. |
|---|
| 26 | 26 | | SECTION 3. Section 1603.256(c), Occupations Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (c) The following persons may administer a practical |
|---|
| 29 | 29 | | examination required under this subchapter: |
|---|
| 30 | 30 | | (1) the department; [or] |
|---|
| 31 | 31 | | (2) a person with whom the department contracts under |
|---|
| 32 | 32 | | Section 1603.252; or |
|---|
| 33 | 33 | | (3) a private beauty culture school or a vocational |
|---|
| 34 | 34 | | cosmetology program in a public school licensed under Chapter 1602. |
|---|
| 35 | 35 | | SECTION 4. Not later than March 1, 2018, the Texas |
|---|
| 36 | 36 | | Commission of Licensing and Regulation shall adopt rules as |
|---|
| 37 | 37 | | necessary to implement Section 1602.254(b-1), Occupations Code, as |
|---|
| 38 | 38 | | added by this Act, and Section 1603.256(c), Occupations Code, as |
|---|
| 39 | 39 | | amended by this Act. |
|---|
| 40 | 40 | | SECTION 5. The change in law made by this Act to Section |
|---|
| 41 | 41 | | 1603.256(c), Occupations Code, applies only to a practical |
|---|
| 42 | 42 | | examination administered on or after September 1, 2018. |
|---|
| 43 | 43 | | SECTION 6. This Act takes effect September 1, 2017. |
