8 | 8 | | lottery game. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 466, Government Code, is |
---|
11 | 11 | | amended by adding Section 466.0271 to read as follows: |
---|
12 | 12 | | Sec. 466.0271. APPRENTICESHIP TRAINING PROGRAM GAME. (a) |
---|
13 | 13 | | The commission shall operate an instant-ticket lottery game to |
---|
14 | 14 | | benefit apprenticeship training programs funded under Chapter 133, |
---|
15 | 15 | | Education Code. |
---|
16 | 16 | | (b) The commission shall: |
---|
17 | 17 | | (1) determine the ticket price, payout amounts, and |
---|
18 | 18 | | manner in which the game is conducted; |
---|
19 | 19 | | (2) make tickets to the game available for sale |
---|
20 | 20 | | continuously to the extent practicable; and |
---|
21 | 21 | | (3) change the design or theme of the game regularly to |
---|
22 | 22 | | ensure that the game remains competitive with other instant-ticket |
---|
23 | 23 | | lottery games offered by the commission. |
---|
24 | 24 | | (c) The commission shall market and advertise the lottery |
---|
25 | 25 | | game operated under this section in a manner intended to inform the |
---|
26 | 26 | | public that the game tickets are available for purchase and that the |
---|
27 | 27 | | game proceeds are used to fund apprenticeship training programs in |
---|
28 | 28 | | this state. The Texas Workforce Commission may make |
---|
29 | 29 | | recommendations to the Texas Lottery Commission relating to the |
---|
30 | 30 | | marketing and advertising of the game. |
---|
31 | 31 | | (d) The commission shall encourage each sales agent that |
---|
32 | 32 | | sells tickets to instant-ticket games or similar types of lottery |
---|
33 | 33 | | games to sell tickets to the game operated under this section. |
---|
34 | 34 | | (e) An organization otherwise eligible to receive money |
---|
35 | 35 | | from the state lottery account attributable to a lottery game |
---|
36 | 36 | | authorized by this section may not receive the money if the |
---|
37 | 37 | | organization conducts illegal gambling or operates illegal |
---|
38 | 38 | | gambling devices as defined by Chapter 47, Penal Code, or allows the |
---|
39 | 39 | | conduct of illegal gambling or the operation of illegal gambling |
---|
40 | 40 | | devices on its property or in its facilities. |
---|
41 | 41 | | SECTION 2. Section 466.355(b), Government Code, is amended |
---|
42 | 42 | | to read as follows: |
---|
43 | 43 | | (b) Money in the state lottery account may be used only for |
---|
44 | 44 | | the following purposes and shall be distributed as follows: |
---|
45 | 45 | | (1) the payment of prizes to the holders of winning |
---|
46 | 46 | | tickets; |
---|
47 | 47 | | (2) the payment of costs incurred in the operation and |
---|
48 | 48 | | administration of the lottery, including any fees received by a |
---|
49 | 49 | | lottery operator, provided that the costs incurred in a fiscal |
---|
50 | 50 | | biennium may not exceed an amount equal to 12 percent of the gross |
---|
51 | 51 | | revenue accruing from the sale of tickets in that biennium; |
---|
52 | 52 | | (3) the establishment of a pooled bond fund, lottery |
---|
53 | 53 | | prize reserve fund, unclaimed prize fund, and prize payment |
---|
54 | 54 | | account; and |
---|
55 | 55 | | (4) the balance, after creation of a reserve |
---|
56 | 56 | | sufficient to pay the amounts needed or estimated to be needed under |
---|
57 | 57 | | Subdivisions (1) through (3), to be transferred on or before the |
---|
58 | 58 | | 15th day of each month as follows: |
---|
59 | 59 | | (A) the portion of the balance attributable to |
---|
60 | 60 | | the lottery game operated under Section 466.027 to the fund for |
---|
61 | 61 | | veterans' assistance established by Section 434.017; [and] |
---|
62 | 62 | | (B) the portion of the balance attributable to |
---|
63 | 63 | | the lottery game under Section 466.0271 to an account in the general |
---|
64 | 64 | | revenue fund to be appropriated to the Texas Workforce Commission |
---|
65 | 65 | | to support apprenticeship training programs in accordance with |
---|
66 | 66 | | Chapter 133, Education Code; and |
---|
67 | 67 | | (C) the remainder to the foundation school fund. |
---|
68 | 68 | | SECTION 3. (a) Section 466.355(b), Government Code, as |
---|
69 | 69 | | amended by this Act, applies only to a transfer from the state |
---|
70 | 70 | | lottery account made on or after January 1, 2018. |
---|
71 | 71 | | (b) The Texas Lottery Commission shall establish and begin |
---|
72 | 72 | | selling tickets to the lottery game as required by Section |
---|
73 | 73 | | 466.0271, Government Code, as added by this Act, not later than |
---|
74 | 74 | | January 1, 2018. |
---|
75 | 75 | | SECTION 4. This Act takes effect immediately if it receives |
---|
76 | 76 | | a vote of two-thirds of all the members elected to each house, as |
---|
77 | 77 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
78 | 78 | | Act does not receive the vote necessary for immediate effect, this |
---|
79 | 79 | | Act takes effect September 1, 2017. |
