| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 601, Government Code, is amended by |
|---|
| 11 | 11 | | adding Section 601.010 to read as follows: |
|---|
| 12 | 12 | | Sec. 601.010. ADOPTION OF TERM LIMIT FOR CERTAIN LOCAL |
|---|
| 13 | 13 | | OFFICERS REQUIRED. (a) The governing body of a political |
|---|
| 14 | 14 | | subdivision shall adopt a limit on the number of terms that a person |
|---|
| 15 | 15 | | may serve for each elected office of that subdivision as provided by |
|---|
| 16 | 16 | | this section. |
|---|
| 17 | 17 | | (b) The term limit adopted under this section must ensure |
|---|
| 18 | 18 | | that a person may not serve longer than 12 years in an office, |
|---|
| 19 | 19 | | regardless of whether the person serves consecutive terms. |
|---|
| 20 | 20 | | (c) Service in the same office for a different precinct or |
|---|
| 21 | 21 | | place is counted toward the limit described by Subsection (b). |
|---|
| 22 | 22 | | (c-1) A term that begins before January 1, 2019, is not |
|---|
| 23 | 23 | | counted in determining whether a person is eligible to serve as an |
|---|
| 24 | 24 | | officer of a political subdivision. This subsection expires |
|---|
| 25 | 25 | | February 1, 2035. |
|---|
| 26 | 26 | | (c-2) A political subdivision shall establish the term |
|---|
| 27 | 27 | | limits as required by Subsection (a) not later than January 1, 2018. |
|---|
| 28 | 28 | | This subsection expires January 1, 2019. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect on the date on which the |
|---|
| 30 | 30 | | constitutional amendment proposed by the 85th Legislature, Regular |
|---|
| 31 | 31 | | Session, 2017, requiring a political subdivision of this state to |
|---|
| 32 | 32 | | limit the number of terms for which a person may be elected to hold |
|---|
| 33 | 33 | | an office of the political subdivision is approved by the voters. |
|---|
| 34 | 34 | | If that amendment is not approved by the voters, this Act has no |
|---|
| 35 | 35 | | effect. |
